RESOLUTION NO. 2025 - �Z <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984, TO EXPEND FORFEITURE FUNDS <br />FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT TO <br />PURCHASE FIELD FORCE AND RIOT CONTROL GEAR AND EQUIPMENT, IN AN <br />AMOUNT NOT TO EXCEED TWO HUNDRED SEVENTY-NINE THOUSAND SIX <br />HUNDRED SEVENTY-FOUR DOLLARS AND FORTY-THREE CENTS ($279,674.43), <br />ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements to purchase field force and riot control <br />gear and equipment, in an amount not to exceed Two Hundred Seventy -Nine Thousand Six <br />Hundred Seventy -Four Dollars and Forty -Three Cents ($279,674.43), attached hereto as Exhibit <br />„A„ <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Federally Forfeited Monies. Based on the certification, attached <br />hereto as Exhibit "A", the Chief of Police is hereby authorized to spend Two Hundred Seventy -Nine <br />Thousand Six Hundred Seventy -Four Dollars and Forty -Three Cents ($279,674.43), from the <br />established Department of Justice federal forfeitures account to purchase field force and riot <br />control gear and equipment. <br />Section 2.
