A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN ART
DONATION AGREEMENT WITH JOSEPH MILTON FOR THE SCULPTURE KNOWN
AS "MARIPOSAS AZULES" BY MANOLO VALDES; AUTHORIZING THE CITY
MANAGER AND CITY ATTORNEY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Joseph Milton is the owner of an art sculpture known as "Mariposas Azules"
by Manolo Valdes (the "Sculpture"); and
WHEREAS, St. Tropez Beach Developers LLC (the "Owners"), are the owners of the
property located at 16690 Collins Avenue (the "Property"); and
WHEREAS, the Sculpture is currently located on the northeast corner of the Property;
and
WHEREAS, Joseph Milton has approached the City of Sunny Isles Beach (the "City") with
an offer to donate the Sculpture; and
WHEREAS, the Sculpture was the required Art in Public Places component of the
Owners development project approved in 2019 by Resolution No. 2019-3009; and
WHEREAS, the Sculpture is substantial in size, requires ongoing maintenance, and is
located on private property; and
WHEREAS, these and other factors, including but not limited to, liability, insurance, and
licensing, must be negotiated and agreed to with Joseph Milton and the Owner if it is the desire
of the City Commission to accept the donation; and
WHEREAS, the City Commission wishes to authorize the City Manager to negotiate the
terms of a proposed donation agreement with Joseph Milton and the Owner and present the
final proposed agreement for approval by the City Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authorization of City Manager. The City Manager is hereby authorized to
negotiate the terms of a donation agreement and present the final agreement for approval by
the City Commission.
Section 2. Effective Date. This Resolution will become effective upon adoption.

RE: Authorize the City Manager to Negotiate an Agreement to Accept a Donation
of an Art Sculpture
RECOMMENDATION:
This item is presented for your consideration.
REASONS:
The City was approached with an offer of a donation of an art sculpture. This sculpture, Mariposas
Azules by Manolo Valdes, is currently installed at the southwest corner of Sunny Isles Blvd and State
Road A1A / Collins Avenue. It was the required Art in Public Places component of the Milton Office
Towers development project approved in 2019 by Resolution #2019-3009. The piece is substantial in
size and requires on -going maintenance. It is also located on private property. These and other factors,
such as liability, will need to be negotiated and agreed to with the donor if it is the desire of this
Commission to accept this donation. Approval of this resolution authorizes the City Manager to
negotiate those terms and present the final agreement for your approval.
ADDITIONAL INFORMATION:
This piece was reviewed, appraised and approved by the former Public Arts Advisory Committee and
subsequently by the City Commission.
FUNDING SOURCE:
Funding may be required for items such as premiums for liability insurance coverage, maintenance,
damages, relocation, etc. These expenses could be covered through the Art Fund and will require a
budget amendment when approved.
