A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CITY MANAGER TO SIGN OR RENEW ALL
REQUIRED CONTRACTS, AGREEMENTS, AND PURCHASE ORDERS DURING THE
RECESS PERIOD FROM THE LAST CITY COMMISSION MEETING IN NOVEMBER
2025 THROUGH THE FIRST REGULAR COMMISSION MEETING IN JANUARY 2026,
SUBJECT TO AFTER -THE -FACT RATIFICATION AT THE JANUARY 2026 CITY
COMMISSION MEETING; REQUIRING LEGAL REVIEW BY THE CITY ATTORNEY
FOR SAID CONTRACTS, AGREEMENTS, AND PURCHASE ORDERS; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Sunny Isles Beach City Commission is not scheduled to meet between
November 20, and the next regular meeting in January 2026 ("Recess"); and
WHEREAS, the City Commission wishes to grant the City Manager with the authority to
execute all necessary and required contracts, agreements, and purchase orders during the
Recess, provided that said contracts, agreements, and purchase orders are first approved as to
form and legal sufficiency by the City Attorney prior to execution; and
WHEREAS, the City Manager will report back to the City Commission at the first regular
City Commission meeting in January 2026, seeking after -the -fact ratification of any actions
relating to the aforementioned authorization.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, THAT:
Section 1. Authority of City Manager and CitV Attorney, The City Manager is hereby
authorized to sign or renew all required contracts, agreements, and purchase orders during the
Recess period, subject to after -the -fact ratification at the January 2026 City Commission
Meeting, provided that said contracts, agreements, and purchase orders are first approved as
to form and legal sufficiency by the City Attorney prior to execution.
Section 2. Effective Date. This Resolution shall become effective upon adoption.

MEMORANDUM

RE: Authorization of the City Manager to Execute Required Agreements During
Recess Period
RECOMMENDATION:
Staff recommends approval of this resolution.
REASONS:
On November 21, 2024, via Resolution No. 2024-3766, the City Commission set the Regular City
Commission Meetings schedule for calendar year 2025, with December being chosen as the recess
month. Since there is no regular Commission meeting schedule until January 2026, there may be new or
existing agreements that require approval. This Resolution authorizes the City Manager to execute all
new or amended agreements during the recess, provided they are first approved as to form and legal
sufficiency by the City Attorney. This Resolution further provides that all new and amended agreements
that would normally require Commission approval are ratified by the City Commission at the next
regularly scheduled meeting in January 2026.
