PZ2025-16) SUBMITTED BY ST. TROPEZ BEACH DEVELOPERS, LLC, TO ALLOW A VARIANCE FROM THE REQUIREMENTS OF §265-56.A.(2) OF THE CITY'S LAND DEVELOPMENT REGULATIONS TO PERMIT TWO (2) MONUMENT SIGNS ON A SINGLE PARCEL, AND TO DECREASE THE REQUIRED MONUMENT SIGN SETBACK, FROM 6 FEET TO 3 FEET AND 1 INCH FROM THE RIGHT-OF-WAY, AT THE PROPERTY LOCATED AT 16690 COLLINS AVENUE, SUNNY ISLES BEACH, FLORIDA; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, St. Tropez Beach Developers, LLC (the "Applicant") submitted a zoning variance application, numbered PZ2025-16 (the "Application"), to the City of Sunny Isles Beach, Florida ("City") requesting the following: a. approval of a sign variance to allow two (2) monument signs on a single parcel, where only one (1) is permitted, pursuant to Section §265-63.1 and §265-56.A.(2) of the City of Sunny Isles Beach Land Development Regulations; and b. approval of a sign variance to decrease the monument sign setback from 6' to 3'-1" from the right-of-way, pursuant to Section §265-63.1 and §265-56.A.(5) of the City of Sunny Isles Beach Land Development Regulations; Legal Description: Lot 35 and all of Island 35, Lot 36 and Lot A, of BELLA VISTA SUBDIVISION, SECOND REVISED, according to the plat thereof as recorded in Plat Book 50, Page 76, less that part of Lot A conveyed by Deed dated June 5, 1947, recorded in deed Book 2026, Page 297 for right of way for State Road No. 140 and less that portion of Lot 36 and Lot A as described in Condemnation Proceeding Civil Case No. 86-02173, of the Public Records of Miami - Dade County, Florida. Also described as: Lot 35 and all of Island 35, Lot 36 and Tract A, of BELLA VISTA SUBDIVISION, SECOND REVISED, according to the plat thereof as recorded in Plat Book 50, Page 76, less that part of Tract A conveyed by Deed dated June 5, 1947, recorded in deed Book 2026, Page 297 for right of way for State Road No. 140 and less that portion of Lot 36 and Tract A as described in Condemnation Proceeding Civil Case No. 86-02173, of the Public Records of Miami - Dade County, Florida. Address: 16690 Collins Avenue, Sunny Isles Beach, Florida Folio: 31-2214-007-0350 WHEREAS, the public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the information contained in the City's Planning and Zoning Department Staff Report; and WHEREAS, notice was provided to all interested parties regarding the Application; and WHEREAS, on January 15, 2026, the City Commission conducted a public hearing on the Application; and WHEREAS, the City Commission reviewed the Application, the written and oral information provided by the Planning and Zoning Department and finds that the Application meets the criteria for variance under the Land Development Regulations and the Comprehensive Master Plan of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Findings and Conclusions. Based upon an analysis of the application and the standards for approval for a variance under the Land Development Regulations and the Comprehensive Master Plan of the City, the City Commission makes the following findings and conclusions: The application for variance approval seeking the following variance: a. a variance to allow two (2) monument signs on a single parcel, where only one (1) is permitted; and b. a variance to decrease the monument sign setback from 6' to 3'-1" from the right- of-way 2 377 is consistent with the City's Comprehensive Plan and generally consistent with the City's Land Development Regulations. Section 3. Approval. The Applicant's request for approval of the following variance: a. a variance to allow two (2) monument signs on a single parcel, where only one (1) is permitted; and b. a variance to decrease the monument sign setback from 6' to 3'-1" from the right- of-way is hereby APPROVED, subject to the following conditions: That the plans in the approval be substantially in accordance with that submitted for public hearing, which are entitled "Monument Sign Milton Tower Rose Cafe" prepared by Ferrin Signs, consisting of five (5) sheets date stamped December 30, 2025. Plans are subject to revisions based on comments provided by zoning staff of the City of Sunny Isles Beach. Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the Planning and Zoning Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations. Should revisions in the plans result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 3. That the Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. 4. That the approved site plan shall remain valid for a period of 24-months from the date of the site plan modification approval. If no building permit is issued within the 24-month time period, the site plan shall be considered null and void and of no force and effect. Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provisions and such holding shall not affect the validity of the remaining potions of this Resolution. 3 378 Section 6. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 7. Effective Date. This Resolution shall become effective upon adoption. PROJECT SUMMARY Application Number: PZ2025-16 Application Summary: The Applicant is requesting approval for a new 10 sq. ft. monument sign facing Sunny Isles Boulevard at the Milton Tower development project. Installation of the proposed monument sign requires a modification to the previously approved site plan and two sign ordinance variances. Applicant/Owner: St. Tropez Beach Developers, LLC. Initial approval of the St. Tropez development project was pursuant to Resolution No. 05-Z-91, adopted on March 22, 2005, which consisted of Phase I for three residential towers with a commercial area on the ground floor. The Applicant proposed a fourth Residential Tower at 16690 Collins Avenue which was approved pursuant to Resolution No. 06-Z-101 adopted on July 20, 2006. Over time, several site plan modifications were approved allowing the Applicant to continue with the phasing of the projects (Resolution No. 12-Z-133 adopted on November 15, 2012, Resolution No. 13-Z-137, adopted on October 17, 2013, Resolution No. 15-Z-151 adopted on April 16, 2015, and Page 2 of 8 346 IV. Pursuant to Section §265-18 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a Site Plan Modification to increase the number of monument signs from one (1) to two (2). 2. Pursuant to Sections §265-63.1 and §265-56.A.(2) of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting approval of a sign variance to allow two (2) monument signs on a single parcel, where only one (1) is permitted. 3. Pursuant to Sections §265-63.1 and §265-56.A.(5) of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting approval of a sign variance to decrease the monument sign setback from 6' to 3'-1" from the right-of-way. ZONING REVIEW The following is a review of the relevant Land Development Regulations for installation of the proposed monument sign facing Sunny Isles Boulevard, within an existing planter box adjacent to the sidewalk. The plans reviewed are entitled "Monument Sign Milton Tower Rose Cafe", prepared by Ferrin Signs consisting of five (5) sheets, date stamped December 30, 2025. The first is to allow two monument signs, when only one is permissible. Code Sec. 265-56.A.(2) limits the number of monument signs to one per parcel, except, "If parcel has 300 feet or more of street frontage and more than one two-way access point, one additional sign may be permitted." This parcel does not have 300 feet or more of street frontage and only has one access point onto Collins Avenue. The second sign ordinance variance is to reduce the required setback from 6' to 3'-1" from the right-of-way. The following are the standards of review for sign ordinance variances, from code Sec. 265-63.1: (1) The variance is not contrary to the public interest; (2) Special conditions and circumstances do not result from actions of the applicant; (3) A literal enforcement of the provisions of this chapter may result in unnecessary hardship. V. FINAL ANALYSIS The original site plan approval for Milton Tower included one monument sign facing Collins Avenue. According to code Sec. 265-18.1., a change to the development's signage is considered a major site plan modification. Therefore, the proposal to add a second monument sign to the property is a major site plan modification and is subject to the City Commission's approval. First, the property is a corner lot with frontages on two multi -lane arterial roadways. The proposed monument sign will face Sunny Isles Blvd., which is a four -lane roadway and visibility to the ground floor commercial areas is limited. Having two street frontages along multi -lane roadways is a special condition that does not result from the actions of the Applicant and it is not contrary to the public interest to have a monument on both streets. However, literal enforcement of the provisions of the sign ordinance to be restricted to one monument sign for the property would not result in an unnecessary hardship. Second, the proposed monument sign is small in size, at 10 sq. ft., and is to be located within an existing planter box. The setback reduction will not impact any site visibility triangles for vehicles, as there are no driveways proximate to the proposed sign location. Therefore, the reduction of the required setback is not contrary to the public interest. However, there is not a special condition that merits the setback reduction, nor would literal enforcement of the 6' setback requirement result in unnecessary hardship. Staff has compiled the relevant facts of the requested site plan modification and sign ordinance variance and recommends the application be presented to City Commission for consideration along with the conditions of Section VI.
