A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CITY
ATTORNEY TO RETAIN MIGUEL DEGRANDY OF HOLLAND
AND KNIGHT TO REPRESENT THE CITY CLERK IN THE CASE
STYLED LEWIS J. THALER V. GEORGE "BUD" SCHOLL,
PENELOPE TOWNSEND, IN HER CAPACITY AS SUPERVISOR
OF ELECTIONS OF MIAMI -DADE COUNTY, AND JANE HINES,
IN HER CAPACITY AS CITY CLERK OF SUNNY ISLES BEACH;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on or about November 17. 2014, a lawsuit was filed to contest the recent
mayoral elections held on November 4. 2014: and
WHEREAS, the City Clerk, Jane Hines, was named as a defendant in her official capaciq ;

WHEREAS, the City Commission wishes to grant the City Attorney with the authority to
hire special counsel to represent the City Clerk in this matter.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authoritv of the Citv Attomev. The City Commission hereby provides the City
Attorney with the authority to hire Miguel Degrandy of Holland and Knight to represent the City
Clerk, Jane Hines, in the pending case styled as Thaler v. Scholl. et al.. Case No. 14- 29339- CA -01.
Section 2. Effective Date. This Resolution will become effective upon adoption.

RE: Resolution authorizing the Citv Attorney to retain Miguel DeGrandv of Holland
& Knight to represent the City Clerk in the Case Styled Lewis J. Thaler v. George

RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
On or about November 17. 2014._ a lawsuit was filed to contest the recent election for the
Mayor's position. The City Clerk was recently served with the Complaint relating the lawsuit.
The serving of the Complaint on the City Clerk is a clear indication that this cause will proceed
before the Court. As such. I request the authority of the City Commission to retain special
counsel because the costs may exceed the $26.000 spending limit provided to the City Attorney.
