HomeMy WebLinkAboutReso 2014-2336RESOLUTION NO. 2014- ';L A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A LETTER AGREEMENT WITH JAY CARROLL OF CARROLL ELECTRIC, VENDOR 91873, AUTHORIZING THE SPENDING AUTHORITY TO PROVIDE ELECTRICAL CONSULTING SERVICES, IN AN AMOUNT NOT TO EXCEED FIFTY THOUSAND DOLLARS (S50,000.00), ATTACHED HERETO AS EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 21. 2013 via Resolution No. 2013 -2159 the City Commission approved a Letter Agreement with Jay Carroll of Carroll Electric to provide electrical consulting services when necessary throughout the City: and WHEREAS, staff has recommended Jay Carroll of Carroll Electric based on his relevant experience, qualifications, and past performances; and WHEREAS, Jay Carroll is willing and able to perform said services; and WHEREAS, the City Commission wishes to renew the Letter Agreement with Jay Carroll authorizing the spending authority to provide Electrical Consulting Services, in an amount not to exceed Fifty Thousand Dollars (550,000.00), attached hereto as Exhibit "A ". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Letter Agreement. The City Commission hereby approves the Letter Agreement with Jay Carroll of Carroll Electric. Vendor-91873), authorizing the spending authority to provide Electrical Consulting Services, in an amount not to exceed Fifty Thousand Dollars (S50,000.00). attached hereto as Exhibit "A ". Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. Russo time electrician position. As such, the City is willing to retain you as a consultant to City Manager provide Electrical Consulting Services (`Services ") which includes the folloswing Hans Ottinot Scope of Services and Plans and Sketches: City Attorney Jane A. Hines a. Electrical and electronic installations and repairs, alterations and testin= to City Clerk, MMC maintain the folloswing systems on an on -call basis: electrical, alarm, communication. time HVAC controls, energy management wiring. refrigeration, internal and external lighting. switch gear. emergency generators and transfer switches. transformers. distribution, computer and data networking circuits, theatrical lighting and sound. motors, emergency lighting and all other electrical apparatus. devices. fixtures. and wiring systems owned or operated by the City (collectively referred to "Scope of Services'); and b. Read and interpret plans, sketches. and blueprints: prepare cost and time estimates for all types of electrical work; and recommend and order related supplies, equipment and materials required for performance of duties (collectively referred to as "Plans and Sketches'). The Citv agrees to enter into this Letter Agreement between the City and yourself. i.e. Jay Carroll (`Consultant "), subject to the following terms and conditions: I . The City arurees to compensate you for your Services at the rate of Seventy Dollars (570.00) per hour. on an "as needed" basis: 2. Consultant will be paid by the City on a bi- weekly basis for Services rendered: 3. Consultant shall be required to submit detailed billing invoices, with each job detailing the number of hours preformed. in order to be paid by the City: 4. The dates and times the Services must be provided shall be mutuall agreed upon by the City and Consultant: 6. All Services to be performed by Consultant including the dates. times and locations. shall be directed through. and approved in advance by; the City Manager or Assistant City Manager for Department of Public Works and Capital Improvement Projects: 7. The terms on this Letter Agreement shall commence on the day succeeding approval of this Letter Agreement by the City Manager or his designee and shall continue on an annual basis up to 3 years: 8. The City shall have right to terminate. with or without cause, the Services then remaining to be performed by the Consultant upon written notice to the Consultant. In such an event. the Consultant shall be compensated only for the Services satisfactorily performed up to the written notice date of termination: 9. The Consultant is an independent contractor and shall be treated as such for all purposes. Nothing contained herein or anv action of the parties shall be construed to constitute or to render the Consultant an employee, partner, agent. shareholder. officer or in any other capacity other than as an independent contractor. Consultant shall be responsible for any and all of its own expenses in performing its Services. The City shall have no duty to withhold any Federal income taxes or pay Social Security services. Consultant shall furnish its own transportation, office and other supplies as necessary in carrying out its duties under this Letter Agreement: and 10. The terms and conditions of this Letter Agreement shall prevail over the terms and conditions of any other documents. 11. This Letter Agreement is subject to the approval of the City Commission. Russo, City Manager FROM: Bill Evans, Public Works Director DATE: 11120/2014 RE: Re -New the Letter Agreement with Carroll Electric to Provide Electrical Consulting Services. RECOMMENDATION: Staff is recommending the City Commission re -new the attached letter agreement authorizing the spending authority for the use of consultant Jay Carroll of Carroll Electric to provide electrical consulting services. REASONS: On October 29, 2013 the City endorsed a Letter Agreement for Electrical Consulting Services with Carroll Electric. The City is in the process of hiring an electrician to do every day electrical needs, however, the City is in need of an experienced, licensed electrician for complex electrical jobs throughout the City. As such, the City is willing to continue to retain Jay Carroll of Carroll Electric as a consultant to provide electrical consultant services throughout the City in an amount not to exceed Fifty Thousand Dollars (S50,000.00) The consultant is required to submit a detailed billing invoices with each job detailing the number of hours performed with the date and times. All services to be performed shall be directed through and approved in advance by the City Manager or the Public Works Director.
