HomeMy WebLinkAboutZoning Resolution 26-Z-224RESOLUTION NO. 2026- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE ZONING APPLICATION FOR CONDITIONAL USE APPROVAL (PZ2025-15), SUBMITTED BY DEZER BLUE GRASS, LLC, TO ALLOW AN OFF -SITE TEMPORARY SALES CENTER ON PROPERTY LOCATED AT 18325 COLLINS AVENUE; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Dezer Blue Grass, LLC ("Applicant") submitted a zoning application (PZ2025- 15) ("Application"), to the City of Sunny Isles Beach, Florida ("City") for a temporary sales center to be located at the following property: LEGAL: The North 100 Feet of Tract "O", and also the South 100 Feet of the North 200 Feet of Tract "O", North Biscayne Beach Amended, according to the Plat thereof recorded in Plat Book 44, Page 42 of the Public Records of Miami -Dade County, Florida, the foregoing being the same property previously submitted to condominium in the Declaration of Condominium of Blue Grass Beach Club, a motel condominium, recorded in Official Records Book 12326, Page 1959 of the Public Records of Miami -Dade County, Florida. ADDRESS: 18325 Collins Avenue, Sunny Isles Beach FOLIO: 31-2202-003-0220 WHEREAS, the Applicant's site plan application requests the following: Pursuant to Sections §265-13 and §265-14 of the City of Sunny Isles Beach Land Development Regulations, approval of a conditional use for an off -site temporary sales center; and. WHEREAS, a public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the information contained in the City's Planning & Zoning Department Staff Report; and WHEREAS, notice was provided to all interested parties regarding the Application; and WHEREAS, on February 19, 2026, the City Commission conducted a public hearing on the Application; and 457 WHEREAS, the City Commission reviewed the Application, the written and oral recommendations of the Planning & Zoning Department and finds that the Application meets the criteria for conditional use under the Land Development Regulations and the Comprehensive Plan of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Findings and Conclusions. Based upon an analysis of the application and the standards for approval for a conditional use approval under the Land Development Regulations and the Comprehensive Plan of the City, the City Commission makes the following findings and conclusions: The Application for conditional use approval for an off -site temporary sales center to be -located on property located at 18325 Collins Avenue is consistent with the Land Development Regulations and the Comprehensive Plan of the City of Sunny Isles Beach. Section 3. Approval. The Applicant's request for approval of a conditional use for an off - site temporary sales center to be located on property located at 18325 Collins Avenue, is hereby APPROVED. Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provisions and such holding shall not affect the validity of the remaining potions of this Resolution. Section 6. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 7. Effective Date. This Resolution shall become effective upon adoption. The existing sales center supporting the Bentley Residences will remain on the southern half of the lot. The application requires conditional use approval for an off -site sales center, a setback variance, and site plan approval. The Applicant also requests the use of graphics on a temporary construction fence. SITE INFORMATION Location: 18325 Collins Avenue' Land Area: 2.45 acres (106,685 sq. ft.) Folio: 31-2202-003-0220 Site Description: The property is a rectangular lot located on the east side of Collins Avenue. It was developed in 1951 with the Bluegrass motel with 80 guest rooms and four commercial units. The motel was converted into a condo -motel in 1983. In 2014, The City Commission approved the Residences by Armani Casa temporary sales center via resolution 2014-2354, which proposed demolishing the southern half of the Bluegrass condominium and constructing a one-story, 8,114 sq. ft. sales center in its place. In 2021, the City Commission approved a request for the sales center to be expanded and repurposed for the Bentley Residences via resolution 2021-3212. REQUESTS 1. Pursuant to Sections §265-13 and §265-14 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting approval of conditional use for an off -site temporary sales center. 2. Pursuant to Section §265-18 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting site plan approval for a one-story temporary sales center with 4,480 square feet of floor area. 3. Pursuant to Section §265-35 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a variance to reduce the north side setback from 20' to 11'. 4. Pursuant to Section §265-57 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting the use of murals and graphics on a temporary construction fence. IV. CONDITIONAL AND TEMPORARY USE REVIEW The Temporary Use Code Section §265-14.B. states that a temporary sales center which is located off -site from the development project that it is supporting must be treated as a conditional use and therefore requires review and approval by the City Commission. The following analysis compares the proposed temporary sales center use against the Conditional Use review criteria of Code Section §265-13.(C): (1) The proposed use shall be consistent with the Comprehensive Plan. (2) The establishment, maintenance or operation of the proposed use shall not be detrimental to or endanger the public health, safety, or general welfare. (3) The proposed use shall be consistent with the community character of the immediate neighborhood of the proposed use. (4) Utilities, roadway capacity, drainage, and other necessary public facilities, including police, fire and emergency services, shall exist at the City's adopted levels of service, or will be available concurrent with demand as provided for in the requirements of these LDRs. Page 3 of 12 347 February 19, 2026 PZ2025-15 (5) Adequate measures exist or shall be taken to provide ingress and egress to the proposed use in a manner that minimizes traffic congestion in the public streets. (6) The establishment of the conditional use shall not impede the development of surrounding properties for uses permitted in the zoning district. (7) The design of the proposed use shall minimize adverse effects, including visual impacts, of the proposed use on adjacent property through the use of building orientation, setbacks, buffers, landscaping and other design criteria. The proposed temporary sales center use is consistent with Objective 1 of the Future Land Use Element, which states the City shall encourage in -fill development and redevelopment of underutilized or obsolete developments. The remaining portion of the Bluegrass motel -condo is mostly vacant, particularly the commercial unit fronting Collins Avenue. The temporary sales center is supporting sales for the proposed Miami Beach Club development project located at 19051 Collins Avenue and Policy 14B of the Future Land Use Element states the Mixed Use — Resort future land use category is designed to encourage development and redevelopment within the area east of Collins Avenue for uses such as residential. Therefore, this use is consistent with the intent and objectives of the Comprehensive Plan. The proposed temporary structure will redevelop the remainder of the property with a temporary sales center and will not be detrimental to or endanger the public health, safety, or general welfare, as it is in harmony with the surrounding character of condominiums, sales centers, retail, hotel, and condominium uses. The proposed site plan utilizes the existing driveway that connects to the intersection with Collins Avenue and 183rd Street for ingress and egress. The project has adequate sidewalks to provide pedestrian connectivity into the site. The design of the structure is a one-story building setback 221' from Collins Avenue with ample landscaping. Temporary Use Code Section §265-14.F. provides the following review criteria: (1) The temporary use must be compatible with the surrounding land uses, (2) A parking problem must not be created. If off -site parking is to be utilized, permission must be in writing from the owner of the property utilized. Said owner must demonstrate that the parking requirement of the temporary use does not cause the loss of legally required parking spaces for his/her site. (3) An applicant may not receive a temporary use permit for garage sales, seasonal sales, sidewalk/parking lot sales, fireworks displays and show and carnivals, fairs, concerts, circuses or similar events on the same property more than three times within a calendar year. The temporary sales center use meets the above criteria. It is compatible with the surrounding mix of land uses, which includes residential, apartment -hotel, retail, and sales centers developed at various heights and intensities. The sales center will provide adequate parking on -site. Page 4 of 12 348 February 19, 2026 PZ2025-15 V. ZONING SITE PLAN REVIEW The following is an analysis of the proposed site plan with the site development standards of the MU-R, "Mixed Use - Resort" zoning district, and other applicable Land Development Regulations. The plans reviewed are on file, and may be examined, in the City Clerk's Office and the architectural plans are entitled "Miami Beach Club Sales Center", prepared by Cohen, Freedman, Encinosa & Associates Architects, PA, stamped received January 23, 2026, consisting of ten (10) sheets; survey prepared by Fortin, Leavy, Skiles, Inc., stamped received December 2, 2025, consisting of one (1) sheet; landscape plans entitled, "Miami Beach Club Sales Center," prepared by Enea Landscape Architecture, Inc., stamped received January 23, 2026, consisting of ten (10) sheets; civil plans entitled, "Civil Design Plans for Sales Center — Sunny Isles," prepared by Kimley Horn, stamped received January 23, 2026, consisting of thirteen (13) sheets. Included in the site plan application is a request to utilize graphics on the temporary construction fences along Collins Avenue, which per Code Section §135-6 requires City Commission approval. VI. VARIANCE REVIEW The Applicant has requested one variance from the Land Development Regulations, which is to reduce the north side setback from 20' to 11'. The variance request is reviewed against the following criteria from Code Section §265-15.G.: A variance shall be granted only where competent and substantial evidence presented in the particular case shows that all of the following are met. (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district. (2) The special conditions and circumstances do not result from the actions of the petitioner. (3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant. (4) The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs. (5) Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district. (6) The variance, if granted, is the minimum variance that makes possible the reasonable use of the land, building or structure. (7) The grant of the variance is in harmony with the general intent and purpose of these LDRs, is not injurious to the neighborhood, or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. Page 6 of 12 350 February 19, 2026 PZ2025-15 The proposed variance meets some, but not all, of the above criteria. The proposed structure is temporary and significantly smaller in size than what is permissible in this zoning district, which is a special circumstance not applicable to other structures or buildings in the same zoning district. However, literal interpretation and application of the setbacks does not deprive the Applicant of rights commonly enjoyed by other properties, as the property is a rectangular shaped lot of ample size to accommodate a structure. Granting the variance is not injurious to the neighborhood, or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. VII. FINAL ANALYSIS Conditional and Temporary Use The proposed temporary off -site sales center is consistent with the City's Comprehensive Plan and Land Development Regulations, specifically the review criteria for conditional uses and temporary uses. Variance The requested variance to reduce the north side setback from 20' to 11' complies with some, but not all of the Land Development Regulations, specifically Sections §265-15.G, which outlines the review standards for variance applications. Literal interpretation of the development and sign standards would not deprive the Applicant of rights commonly enjoyed by other properties and are not essential to enable reasonable use of the land, as a sales center can reasonably be constructed without them. However, granting the variances would not harm the neighborhood, negatively impact public safety or welfare, or significantly diminish or impair property values in the surrounding area. Site Plan The proposed site plan application is consistent with the City's Comprehensive Plan and Land Development Regulations, with the exception of the requested north side setback variance. The request for graphics on the temporary construction fence is reasonable, as the development projects along Collins Avenue have commonly utilized graphics on the fencing. Staff has compiled the relevant facts of the requested conditional use, temporary use, variances, and site plan approval and recommends that the application is presented to City Commission for consideration. Vill. CONDITIONS If the City approves this application, the application will be subject to the following conditions set forth below: Conditions to be completed before below grade or building permits are issued: Page 7 of 12 351 February 19, 2026 PZ2025-15 That the plans be substantially in accordance with that submitted for public hearing, which are entitled "Miami Beach Club Sales Center", prepared by Cohen, Freedman, Encinosa & Associates Architects, PA, stamped received January 23, 2026, consisting of ten (10) sheets; survey prepared by Fortin, Leavy, Skiles, Inc., stamped received December 2, 2025, consisting of one (1) sheet; landscape plans entitled, "Miami Beach Club Sales Center," prepared by Enea Landscape Architecture, Inc., stamped received January 23, 2026, consisting of ten (10) sheets; civil plans entitled, "Civil Design Plans for Sales Center — Sunny Isles," prepared by Kimley Horn, stamped received January 23, 2026, consisting of thirteen (13) sheets. 2. Upon the submittal of an application for a building permit, the plans submitted shall be approved by the Planning and Zoning Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 3. That the Applicant complies with all conditions and permit requirements, including but not limited to, Miami -Dade County DERM, Florida Department of Transportation (FDOT), the Miami -Dade County Fire Department (MDFD), Water and Sewer Departments, etc. 4. That the Applicant shall submit an updated Demolition and Construction Staging and Traffic Management Plan, before commencing any construction activity. The staging plan shall provide a schedule of activities such as, parking arrangements, lane closures, sidewalk closures, any other required activity that may provoke an impact at the surrounding areas. The staging plan shall include arrangements to mitigate against construction trucks idling, driving through, or parking in the Golden Shores neighborhood: The parking arrangements set forth in the staging plan shall provide that construction personnel shall not park their private vehicles nor walk through the Golden Shores neighborhood to access the project. The staging plan should be approved administratively by the City Manager or designee. 5. That the Applicant shall address comments provided by the City's traffic consultants, Calvin, Giordano & Associates, Inc., regarding traffic issues per the memo dated February 5, 2026. All comments are to be addressed prior to issuance of building permit. 6. That the Applicant shall address comments provided by the City's civil engineering consultants, Calvin, Giordano & Associates, Inc., regarding civil issues per the memo dated February 5, 2026. 7. That palms along Collins Avenue be at least 12' clear -wood Medjool Palms or shall Page 8 of 12 352 February 19, 2026 PZ2025-15 match adjacent palms' heights, to be consistent with the City Streetscape Master Plan. 8. If approved, the Applicant must submit a separate building permit prior to installation of murals or graphics on temporary construction fencing to be approved administratively by the City Manager or designee. 9. That the Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. Other Conditions: 10. That the Applicant obtains a Certificate of Occupancy and a Certificate of Use from the City upon compliance with all terms and conditions. The Certificate of Occupancy and Certificate of Use shall be subject to cancellation upon violation of any of the conditions. 11. That the approved site plan shall remain valid for a period of 24-months from the date of the site plan modification approval. If no building permit is issued within the 24-month time period, the site plan shall be considered null and void and of no force and effect. 12. That the Applicant complies with all City Ordinances, County, State and Federal Laws and Regulations applicable to development and permit approvals. Please show and label dimensions on the site plan per the FDOT determination letter, as applicable. 2. Please provide correspondence from Miami -Dade County (MDC) Water Control confirming the stormwater management system requirements for the site. 3. Please provide signed and sealed drainage report including a narrative stating the MDC DERM criteria and how the criteria are met in the proposed design. Include the calculations in the report. Show how the trench drain will not act as an overflow into the ROW. 5. On,C-300, the existing elevations on the existing sidewalk in the ROW are shown as 4.59, 4.64; however, C-300 shows two proposed elevations of 6.22 and 6.18 ME, match existing. The elevations have about a 1.57' difference so this is not a match existing 357 condition. Please address this issue. 6. The existing elevations in the ROW on the survey, 6.16, 6.22, vary from the existing elevations shown on C-300, 4.59, 4.64. Please address this. Please submit a survey that is consistent with the civil plans. 7. The survey states that the elevations are in NGVD. C-300 note #11 states it is in NGVD; however, the elevations are inconsistent. Please address this on C-300. 8. Revisit the proposed grades for the ADA stall. Show elevations at all four corners of the stall and access aisle not exceeding 2% slope in any direction. Currently, the 8.97 TOC will exceed the allowable slope with the elevations shown. 9. Provide the FDOT curb ramp and FDOT detectable warning strip details. Please provide the curb detail(s). 10. Dimension the front and back of the building entrances and walkways and label the uses of the areas. 11. Label and dimension if there is an access to the beach. 12. Specifically, Applicant proposes to construct the Sales Center on the northern portion of the Property, in support of the forthcoming Miami Beach Club multifamily redevelopment project ("Multifamily Project") that will be located at 19051 Collins Avenue (Folio: 31-2202-016-0001). This application also contains lesser requests for (a) a variance to allow the Sales Center building to deviate from the 20' side setback on the north to allow a 14' building setback (I V building overhang setback); and (2) temporary construction fencing including murals or graphics pursuant to Section 265-57, as further depicted in the exemplary imagery within the enclosed plans. The Property is currently improved with an existing sales center building that serves another multifamily project in the City — namely, The Bentley Residences (which is currently under construction). The existing sales center was approved and constructed pursuant to Resolution 2021-3212. The existing sales center is located within the southern portion of the Property and is proposed to remain under the current Application. The proposed new Sales Center is proposed to be constructed within the northern portion of the Property, as further detailed in the plans provided with this Application. 363 Page 2 of 4 The proposed Sales Center is consistent with the provisions of Section 265-14 of the Code relating to Temporary Uses, as well as the requirements set forth in the City Code for site plan approval, including conformance with the character of development in the surrounding area, general layout of the site, and architectural design of the structures. It is also consistent with the goals, policies and objectives of the City's Comprehensive Plan. The proposed Sales Center is anticipated to operate seven days a week from approximately 8:00 a.m. to 7:30 p.m., may occasionally host events extending beyond those operating hours, and will be the principal office from which sales representatives will sell and market the condominiums comprising the Multifamily Project. Those real estate sales -related activities are anticipated to commence upon completion of construction of the Sales Center, and conclude within one year of the issuance of the temporary certificate of occupancy of the Multifamily Project. The Property has adequate parking to accommodate the Sales Center's parking demand. The Applicant is requesting a variance for the proposed Sales Center under section 265-35.13.(4)(c)[2][a] of the City Code, which requires the side setbacks at the Property to be a minimum of 20 feet. The Sales Center is proposed with a building setback of 14' (11' building overhang setback). The requested variance meets the criteria set forth in Section 265-15.G. of the City Code as follows: (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district; Special conditions and circumstances here are based in large part on the history of development at the Property and the types of buildings that remain at the Property. Namely, the Property is developed with low-rise multifamily structures on its northern portion (to -be -demolished), and an existing sales center on its southern portion. Because the existing sales center on the southern portion of the Property remains active and is slated to -remain, the proposed Sales Center's siting options are limited to the northern portion of the Property, and therefore development design options are significantly restricted. Importantly, the proposed Sales Center is inherently temporary in nature and the proposed Sales Center building is of modest height and intensity in relation to the as -built environment further to the north and south of Property within this same zoning district (which development typology largely consists of modern multifamily towers). The variance is necessary to effectuate the proposed modest temporary use/building in an efficient and appropriate manner. (2) The special conditions and circumstances do not result from the actions of the petitioner; 364 Page 3 of 4 The Applicant has not caused the special circumstances that cause the need for the variances. Rather, the need for the variance results largely from a partial incoherence between multifamily building zoning standards (which are designed for large towers) and the proposed modest sales center (which are typically modest temporary single story buildings), as well as the development history of the Property as described above. (3) Literal interpretation of the provisions of these ,LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant; The literal interpretation of the Code will create undue hardship on the Applicant insofar as Applicant would not be able to achieve the design sought, which is a modest prototypical sales center building common to the City. Indeed, the proposed Sales Center building is actually smaller in size than other similar previously approved sales center buildings in the City. Accordingly, Applicant is not requesting anything beyond what is customary. (4) The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs; The purpose of the Variance is not based in economic hardship, but rather principally on design -related constraints as described above, and the proposed Sales Center is otherwise consistent with the LDRs. (5) Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district; No special preference or treatment is being granted to the Applicant., Rather, the proposed temporary structure is a modest prototypical sales center building that is actually smaller in size than other previously approved sales center buildings in the City. Accordingly, Applicant is not requesting anything beyond what is customary and reasonable in the same zoning district. Kimley-Horn and Associates, Inc. has prepared a trip generation statement for the proposed Miami Beach Club Sales Center located at 18325 Collins Avenue in Sunny Isles Beach, Florida. Currently, the site proposed for development is unoccupied. The proposed development will include a Sales Center consisting of approximately 4,480 square feet. Access to the site will be maintained via one (1) full -access driveway at the intersection of Collins Avenue and 1831 Street. A project location map and site plan are provided in Attachment A. The trip generation calculations are summarized below. TRIP GENERATION ANALYSIS A trip generation analysis was conducted using the Institute of Transportation Engineers' (ITE) Trip Generation Manual, 121h Edition. Trip generation calculations were prepared for the weekday, weekday A.M., and weekday P.M. peak hours of adjacent street traffic. To be conservative, the trip generation for the proposed sales center was determined using ITE Land Use Code (LUC) 712 (Small Office Building), as there is no land use code for sales center within the ITE's Trip General Manual, 12"' Edition. A multimodal (public transit, bicycle, and pedestrian) factor based on US Census Means of Transportation to Work data was reviewed for the census tract in the vicinity of the development. The US Census data indicated that there is a 15.3 percent (15.3%) multimodal factor within the vicinity of the development. It is expected that a portion of employees and visitors will choose to walk, bike, or use public transit to and from the proposed development. As indicated in Table 1, the proposed sales center is expected to result in 54 daily vehicle trips, 6 net new vehicle trips during the A.M. peak hour, and 8 net new vehicle trips during the P.M. peak hour. REASONS: The Applicant, Dezer Blue Grass, LLC, has submitted applications for a conditional use, a setback variance, and site plan approval for the proposed project "Miami Beach Club Temporary Sales Center" located at 18325 Collins Avenue. The following requests are included in the application package: 1. Pursuant to Sections §265-13 and §265-14 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting approval of conditional use for an off -site temporary sales center. 2.
