HomeMy WebLinkAboutOrdinance 2026-650ORDINANCE NO. 2026 - AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265, ARTICLE IX, SECTION 265-53, ENTITLED "REQUIRED SIGNS; NO PERMIT REQUIRED," OF THE CODE OF ORDINANCES OF THE CITY OF SUNNY ISLES BEACH, REQUIRING THE POSTING OF CERTAIN SIGNS AT COMMUNITY AND COMMERCIAL SWIMMING POOLS; PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, Chapter 166, Florida Statutes, confers upon local governments the authority to adopt regulations designed to promote the public health, safety, and general welfare of its citizenry; and WHEREAS, The State of Florida routinely ranks among the highest nationally for pool drownings; and WHEREAS, having a visible address in conspicuous areas of public pools can reduce emergency services response times; and WHEREAS, the City Commission of the City of Sunny Isles Beach (the "City") desires to provide additional means of preventing deaths related to pool drowning; and WHEREAS, the City Commission finds that the amendments set forth herein will aid in the. reduction of pool -related deaths in public pools and promote the public health, safety, and welfare of the City. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS': Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment of Chapter 265, Article IX, Section 265-53. Chapter 265, Article IX, Section 265-53 of the Code of Ordinances of the City of Sunny Isles Beach, Florida, is hereby amended as follows: ARTICLE IX —Sign Regulations § 265-53. — Required signs; no permit required. 1 Additions to existing text are shown by underline, changes to existing text on second reading are shown by double underline, deletions on first reading are shown as s'Fi'E�� and deletions on second reading are shown as d Page 1 of 4 127 The following signs shall be placed where appropriate by a property owner and do not require a permit: A. Safety signs. B. Address numbers. Address numbers must be conspicuously posted so that they are clearly legible and easily visible from streets, roadways, alleys and waterways. (1) Residential building with four dwelling units or less: Address numerals at least four inches high but not greater than ten inches. (2) Residential building with more than four dwelling units: Address numerals at least 10 inches high. (3) Nonresidential buildings: Address numerals at least 10 inches high. (4) Construction sites: Address numbers must be at least 10 inches high and shall be displayed on the front yard and back yard areas of a construction site. (5) Vacant lots: Address numerals must be at least 10 inches high and shall be displayed on the front yard. (6) Waterways: Address numerals must be at least 4 inches high. C. Community and Commercial Swimming Pools: Swimming pools owned and/or operated by community, homeowners, or condominium associations, or any commercial entities, shall at all times have signs posted, visible from all areas of the swimming pool deck during both daylight and non -daylight hours, containing the address, including building number and street name, of the swimming pool, or of the building whereupon or wherein the swimming pool is located, in numbers and letters at least four inches in height. GD. Handicapped parking and handicapped access signs in accordance with state handicapped parking and Federal Disabilities Act access requirements. -DE. Traffic control signs. i €F. Parking for general public use (not assigned or tenant only): Parking lots or garages shall be identified by a parking sign displaying the letter "P" located within five feet of a property line at primary vehicular entrance drives. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be Page 2 of 4 128 renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. This Ordinance shall be effective immediately after adoption on second reading. PASSED AND ADOPTED on first reading the 11'day of March, 2026. REASONS: The Code Compliance Division is requesting an amendment to Sec. 265-53, which pertains to required signs that do not need a permit. The proposed amendment would make it a requirement for all community and commercial swimming pools to have an address sign posted in a prominent area. This lettering on the sign should be at least four (4) inches in height and be visible from all areas of the pool deck in the daytime and nighttime. The state of Florida led the nation in 2025 with a new record of 110 child drownings for children under 5 years of age. Though most of these drownings occurred in single-family residences, many also occurred in public swimming pools. In addition to child drownings, there are adult drownings that have occurred in shared pools, as well as other emergencies around pool decks. While many people know their addresses, a lot of children and visitors do not. When an emergency occurs, it is important to know the address of where the incident is taking place. The City of Sunny Isles Beach has many shared pools in buildings and many visitors that are not aware of the address where they are staying. The proposed amendment is a cost-effective way to help reduce the response time in case of any emergencies taking place around shared pool areas and hopefully increase better outcomes.
