HomeMy WebLinkAboutReso 2026-4029RESOLUTION NO. 2026 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PROVIDING A MERIT SALARY ADJUSTMENT FOR CITY CLERK MAURICIO BETANCUR; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 18, 2024, pursuant to Resolution No. 2024-3612, the City Commission appointed Mauricio Betancur as City Clerk and approved an Employment Agreement with him to serve as City Clerk; and WHEREAS, the Employment Agreement between the City of Sunny Isles Beach and City Clerk Mauricio Betancur (hereinafter "Agreement") provides that the City Clerk "shall receive periodic merit increases as determined by the City Commission in its reasonable discretion; provided, however, the Employee shall receive an automatic yearly cost of living adjustment in the amount of three percent (3%) of his annual salary on the anniversary date of approval of this Agreement"; and WHEREAS, the Agreement further provides that "[t]he City Commission may evaluate the performance of the Employee to determine any adjustment in annual salary and/or benefits at least once annually, during the City's Annual Budget process," and that "[a]ny adjustments in said annual salary and/or benefits should be based upon the results of the performance evaluation, within the sole discretion of the City Commission;" and WHEREAS, pursuant to the Agreement, the City Clerk's initial annual base salary was $148,899.11, and since being appointed City Clerk, and in accordance with the Agreement, the City Clerk has received annual cost of living adjustments in the amount of three percent (3%) of his annual salary, resulting in a current salary of $157,967.00; and WHEREAS, since being appointed on January 18, 2024, the City Clerk has not been provided with or received any performance evaluation or merit increase from the City Commission; and WHEREAS, based upon his performance since being appointed as City Clerk, the City Commission has determined that City Clerk Mauricio Betancur merits an increase of his annual base salary to $200,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Merit Increase. City Clerk Mauricio Betancur's annual base salary is hereby increased to $200,000.00, effective April 26, 2026. Section 2. Authorization of City Manager. REASONS: In May 2023, the .City's electorate approved a charter amendment that fundamentally restructured the Office of the City Clerk. The position, which had previously reported to the City Manager, was elevated to report directly to the City Commission, placing it alongside the City Manager and City Attorney as one of three Charter Officer positions. Despite this significant change in the scope, accountability, and standing of the office, no salary adjustment was made at the time of the transition to reflect its elevated status and responsibility. On January 18, 2024, pursuant to Resolution No. 2024-3612, the City Commission formally appointed Mauricio Betancur as City Clerk and approved an Employment Agreement with an initial annual base salary of $148,899.11, a figure that carried forward from the prior structure without adjustment for the Charter elevation. The Agreement provides for annual cost -of -living adjustments of three percent (3%), which have been applied accordingly, bringing the current base salary to $157,967.00. The Agreement also provides for an annual review to determine merit adjustments; however, since the appointment in January 2024, no such review has been conducted and no merit increase has been awarded. This resolution presents the first merit adjustment for the Commission's consideration. Market Comparison The Miami -Dade County Municipal Clerks' Association conducts an annual salary survey of all municipal clerks in the county. The FY 2025-2026 survey identifies the following top -earning City Clerks county- wide: Item Number: 9.G 510 Municipality Salary City of Miami Beach $265,686 City of Miami Gardens $222,591 City of Doral $215,442 City of Coral Gables $195,000 Town of Bay Harbour Islands $189,488 Village of Bal Harbour $183,835 City of Aventura $177,733 Town of Surfside $163,750 North Bay Village $161,000 For the reasons mentioned above, the proposed adjustment to an annual base salary of $200,000.00, effective April 26, 2026, reflects the elevated Charter -level responsibilities of the office, is supported by county -wide market data, and fulfills the merit review contemplated by the Employment Agreement. The proposed salary would place the City Clerk's compensation at approximately fourth in the county, a position consistent with the professional responsibilities, institutional knowledge, Charter -level role of the City Clerk, and aligns the annual salary with the scope and demands of the position. ADDITIONAL INFORMATION: Mauricio Betancur has served the City of Sunny Isles Beach since October 2004 and has worked in the Office of the City Clerk since May 2005. He was promoted to Assistant City Clerk in 2009 and has served as City Clerk since 2017. During his 22-year tenure, he has provided continuity through multiple administrations, overseen municipal elections, maintained the City's official records and legislative processes, and supported the City Commission in the administration of public meetings, public notices, agenda processes, records management, and other duties assigned to the Office ofthe City Clerk.
