HomeMy WebLinkAboutOrdinance 2015-441 ORDINANCE NO. 2015- 4 y AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 183 OF THE CITY CODE RELATING TO "LICENSES AND PERMITS" TO CONFIRM PERMITTING REQUIREMENTS FOR CERTAIN WORK AND ACTIVITIES WITHIN THE CITY; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of Chapter 183 of the City Code of the City of Sunny Isles Beach is to provide certain minimum requirements in all matters relating to the issuance, revocation, and suspension of permits; and WHEREAS, permits are required to show compliance with regulations under the Florida Building Code, the City Code, as well as to promote the health, safety and general welfare of City residents and visitors alike; and WHEREAS, the City wishes to adopt this amendatory Ordinance to confirm that permits are required to construct, enlarge, alter or repair any building, structure or part thereof; and WHEREAS, the City also wishes to confirm that permits are required to 1) use, clear, fill, excavate, move, pave, grade or otherwise alter land, water or beach sand, 2) close a lane of traffic, or 3) perform work in a public right of way or easement area. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 183 of the City Code is amended to read as follows: 4 183-1.—Permits required. A. Building permit required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish or change a building, structure, or part thereof, or conduct work in the public rights of way or public easement, or use, clear, fill, excavate, move, pave, grade or otherwise alter land, water or beach sand, shall first be required to obtain the applicable building permit from the City prior to commencing any such work. B. Permit for Lane Closure. Any applicant who intends to close a lane of traffic shall be required to obtain a permit from the City prior to doing so. Whenever work in connection with a permit is occurring, a permit card or copy shall be conspicuously displayed in the front of the premises at all times from the date the permit is issued until final inspection. A set of approved plans and a final as-built survey shall be made available at all times on the premises where work in connection with the permit is occurring. 183-2. - Duration of permit. A. Any permit issued pursuant to this section shall be valid for a period of One Hundred Eighty (180) days from the date of issuance by the City, unless a different expiration date is otherwise provided by the City Code or Florida Building Code for a specific permit or development order, or as otherwise indicated by the City Commission at a public hearing. Every permit issued pursuant to this section shall become invalid unless the work or activity authorized by such permit is commenced within One Hundred Eighty (180) days after its issuance or if the work authorized by such permit is suspended or abandoned for a period of One Hundred Eighty (180) days after the time the work is commenced. Work shall be considered to be in active progress when the permit has received an approved inspection within One Hundred Eighty (180) days from the date of issuance of the permit. If the permit is revoked, becomes null and void, or expires due to suspension or abandonment of the work, a new permit and related fees shall be required. B. Whenever the City Manager, Building Official or their designee finds any work regulated by the Florida Building Code and/or the City Code is being performed in a manner that is contrary to the provisions of such regulations, without a permit, beyond the scope of the issued permit, or is otherwise dangerous or unsafe, the City Building Official, City Manager, or their designee are authorized to issue a stop work order against the violator. Upon issuance of the stop work order, the violator shall immediately cease the work. Any person who continues any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to penalties as prescribed by applicable law. § 18343.—Criteria for revocation of permits. The City Manager of designee may revoke any permit issued by the City for any of the following reasons: A. Failure of the holder or operator to comply with the requirements of any ordinance or code provisions relating to the permit being issued hereunder; B. Failure of the holder or operator to comply with conditions or terms of the permit; or C. Discovery by City officials that a permit was issued in error or on the basis of incorrect information supplied to the City. Any person or entity aggrieved by a finding, determination, notice, order or action taken under the provisions of this article may appeal such action to the City Manager by filing a written request to the City Clerk within fifteen (15) days of the action. § 183-35. —Suspension of permit. Any permit subject to revocation is suspended pending its revocation or an appeal relative thereto. Section 3. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 5. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on second reading. PASSED and ADOPTED on first reading the 11 day of LQrn 2014.
