A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF
POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME
CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION
932.7055,F.S.,TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE
DEPARTMENT OF JUSTICE (DOJ)TO PURCHASE NON-BUDGETED
SPECIAL SERVICE POLICE VEHICLES AND ASSOCIATED
EQUIPMENT AND MARKINGS LISTED ON THE ATTACHED
CERTIFICATION,IN AN AMOUNT NOT TO EXCEED ONE HUNDRED
FORTY THOUSAND ONE HUNDRED SEVENTY-SIX DOLLARS AND
SIXTEEN CENTS ($140,176.16); PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law
enforcement agency that acquires at least$15,000.00 pursuant to the Florida Contraband Forfeiture
Act within a fiscal year must expend or donate no less than 15%of such proceeds for the support or
operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe
neighborhood, school resource officer programs or for other law enforcement purposes; and
WHEREAS,in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a
municipality,liens and forfeiture funds may be expended if accompanied by written certification that
the request complies with the provisions of the aforementioned subsections; and
WHEREAS,the Chief of Police has submitted a request for the purchase of non-budgeted
Special Service Police Vehicles and Associated Equipment and Markings listed on the attached
Certification, in an amount up to One Hundred Forty Thousand One Hundred Seventy-Six Dollars
and Sixteen Cents($140,176.16) in forfeiture(DOJ) funds in compliance with the aforementioned
legal requirements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification,
the Chief of Police is hereby authorized to spend up to One Hundred Forty Thousand One Hundred
Seventy-Six Dollars and Sixteen Cents ($140,176.16) from the established Department of Justice
(DOJ)federal forfeitures account for the purchase of Special Service Police Vehicles and Associated
Equipment and Markings.

Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

associated equipment to be used as a "Police Crime
Scene Van". $ 35,748.84
❖ Purchase of one (1) 2015 Chevy Impala and
associated equipment to be used as Police $ 32,410.12
Administrative Vehicles.
❖ Purchase of one (1) 2015 Chevy Tahoe 4x4 and
associated equipment to be used as a "Police K-9 $ 46,939.68
Vehicle.

I,Fred A.Maas,Chief of Police, certify that pursuant to the Florida State Statute 932.0755 sec
(4)(a)and(4)(b),the above listed items meet the guidelines of purchase for law enforcement
purposes which include defraying the cost of protracted or complex investigation, or providing
for crime prevention,community policing projects.

Approval to Expend Partial Forfeiture (DOJ) Funds for
RE: the purchase of non-budgeted special service police
vehicles and associated equipment and markings, in an
amount not to exceed $140,176.16
RECOMMENDATION:
It is recommended that the City Commission approve the expenditure
of partial Federal (DOJ) Forfeiture Funds, previously awarded to the
Police Department as the results of investigative participation in
forfeiture and seizure cases. These funds are permissible by law to be
spent for the purchases of police equipment and other law
enforcement activities. It is requested that we be permitted to utilize up
to $140,176.16 of said funds on deposit for such purpose.
REASONS:
The Sunny Isles Beach Police Department actively participates in DEA
/ FBI and HIDTA (High Intensity Drug Trafficking Area) Initiative
Groups that conduct numerous ongoing proactive investigations and
now has a need for the attached listed vehicles and associated
equipment.

high intensity narcotics investigations is the sharing of confiscated
proceeds for the enhancement of law enforcement.
