ORDINANCE NO.2026 - �
<br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES
<br />BEACH, FLORIDA, AMENDING CHAPTER 265, ARTICLE II, SECTION 265-5,
<br />ENTITLED "DEFINITIONS," AND ARTICLE V, SECTION 265-17, ENTITLED
<br />"SUBDIVISION PLAT APPROVAL," OF THE CODE OF ORDINANCES OF THE CITY
<br />OF SUNNY ISLES BEACH, IN ACCORDANCE WITH THE REQUIREMENTS OF
<br />SECTION 177.071, FLORIDA STATUTES, AS AMENDED BY SENATE BILL 784
<br />(2025) AND TO ALIGN WITH CERTAIN PROCEDURES IN CHAPTER 28 OF THE
<br />MIAMI-DADE COUNTY CODE OF ORDINANCES; PROVIDING FOR REPEALER,
<br />SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE.
<br />WHEREAS, in 2025, Senate Bill 784 (SB 784) was enacted, amending Section 177.071,
<br />Florida Statutes, which requires municipalities and counties to administratively approve plats
<br />and replats, with no further action or approval by the governing body of such municipalities and
<br />counties; and
<br />WHEREAS, Section 177.071, Florida Statutes, as amended by SB 784, further requires the
<br />governing body of a municipality or county to designate by ordinance or resolution, an
<br />administrative authority to receive, review, and process plat and replat applications, including
<br />designating an administrative official responsible for approving, approving with conditions, or
<br />denying the requested plat or replat; and
<br />WHEREAS, Section 177.071, Florida Statutes, as amended by SB 784, also mandates
<br />certain procedures and timelines for the review, processing, and approval or denial of plat or
<br />replat applications; and
<br />WHEREAS, Chapter 28 of the Miami -Dade County Code of Ordinances, entitled
<br />"Subdivisions," outlines criteria and procedures for waivers of platting requirements, with which
<br />the City's Land Development Regulations should be consistent; and
<br />WHEREAS, the City Commission desires to amend its Land Development Regulations to
<br />'ensure compliance and consistency with the platting and replatting requirements of Section
<br />177.071, Florida Statutes, and to align with Chapter 28 Miami -Dade County's Code of
<br />Ordinances; and
<br />WHEREAS, the City Commission finds that the amendments set forth herein promote
<br />orderly development, provide clearer procedural standards, and further the public health,
<br />safety, and welfare of the City;
<br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY
