PZ2026-04) SUBMITTED BY DRYECO GARMENT CARE LLC, TO PERMIT A VARIANCE FROM THE REQUIREMENTS OF §265-56(B)(3) OF THE CITY'S LAND DEVELOPMENT REGULATIONS, ALLOWING AN INCREASE TO THE WALL SIGN AREA FROM 28.5 SQUARE FEET TO APPROXIMATELY 96.4 SQUARE FEET, AT THE PROPERTY LOCATED AT 18660 COLLINS AVENUE, SUITE 100, SUNNY ISLES BEACH, FLORIDA; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Dryeco Garment Care LLC (the "Applicant") submitted a zoning variance application, numbered PZ2026-04 (the "Application"), to the City of Sunny Isles Beach, Florida ("City") for the following property: Legal Description: Lots 13 and 14, Block 2, of GOLDEN SHORES OCEAN BOULEVARD ESTATES, SECTION "D", according to the Plat thereof, as recorded in Plat Book 53, at Page 48, of the Public Records of Dade County, Florida. Address: 18660 Collins Avenue, Suite 100, Sunny Isles Beach, Florida Folio: 31-2202-006-0150 WHEREAS, the Applicant is requesting approval of a sign variance to increase the permitted wall sign area to approximately 96.4 square feet, from the 28.5 square feet permitted in Section §265-56(B)(3) of the City of Sunny Isles Beach Land Development Regulations; and WHEREAS, the public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the information contained in the City's Planning and Zoning Department Staff Report; and WHEREAS, notice was provided to all interested parties regarding the Application; and WHEREAS, on April 16, 2026, the City Commission conducted a public hearing on the Application; and WHEREAS, the City Commission reviewed the Application, the written and oral information provided by the Planning and Zoning Department and finds that the Application PZ2026-04- (Dryeco)- RESOLUTION approving variance Page 1 of 4 meets the criteria for variance under the Land Development Regulations and the Comprehensive Master Plan of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Findings and Conclusions. Based upon an analysis of the application and the standards for approval for a variance under the Land Development Regulations and the Comprehensive Master Plan of the City, the City Commission finds that the application for a variance to increase the permitted wall sign area to approximately 96.4 square feet, from the 28.5 square feet permitted in Section §265-56(B)(3) of the City of Sunny Isles Beach Land Development Regulations, is consistent with the City's Comprehensive Plan and generally consistent with the City's Land Development Regulations. Section 3. Approval. The Applicant's request for a variance to increase the permitted wall sign area to approximately 96.4 square feet, from the 28.5 square feet permitted in Section §265-56(B)(3) of the Cityof Sunny Isles Beach Land Development Regulations, is hereby APPROVED, subject to the following conditions: 1. That the plans in the approval be substantially in accordance with that submitted for public hearing, which are entitled "Dryeco/front& back-litchannel letter" by Miami Signs, stamped received March 31, 2026, consisting of two (2) sheets. Plans are subject to revisions based upon comments provided by zoning staff of the City of Sunny Isles Beach. 2. Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the Planning and Zoning Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations. Should revisions in the plans result in a change that would not be considered "minor" in accordancewith Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 3. That the Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. 4. That the approved site plan shall remain valid for a period of 24-months from the date of the site plan modification approval. If no building permit is issued within the 24-month time period, the site plan shall be considered null and void and of no force and effect. 5. That the Applicant complies with all City Ordinances, County, State and Federal Laws and Regulations applicable to development and permit approvals. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 5. Severability. Ifanysection, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provisions and such holding shall not affect the validity of the remaining potions of this Resolution. Section 6. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 7. Effective Date. This Resolution shall become effective upon adoption. ZONING REVIEW The following is a review of the relevant Land Development Regulations for installation of the proposed wall sign facing Collins Ave. The plans reviewed are entitled "Dryeco/front & back -lit channel letter" by Miami Signs, stamped received March 31, 2026, consisting of two (2) sheets. The proposed wall sign facing Collins Avenue requires a variance from the sign ordinance to increase the permitted wall sign area. Pursuant to Code Sec. 265-56.B.(3), the maximum permitted wall sign area for establishments with up to 200 feet of frontage on a single elevation is one (1) square foot per lineal foot of tenant frontage, not to exceed Page 2 of 7 44 April 16, 2026 PZ2026-04 thirty-five (35) square feet. For establishments with more than 200 feet of frontage, the maximum permitted wall sign area is one (1) square foot per lineal foot of tenant frontage, not to exceed seventy-five (75) square feet. As the subject tenant frontage is 28.5 linear feet, the maximum permitted wall sign area is 28.5 square feet. The business has an existing wall sign that is 12.19 square feet in size. The proposed 96.4 square foot sign exceeds the permitted area and requires a variance. The following are the standards of review for sign ordinance variances, from code Sec. 265-63.1: (1) The variance is not contrary to the public interest, (2) Special conditions and circumstances do not result from actions of the applicant, (3) A literal enforcement of the provisions of this chapter may result in unnecessary hardship. V. FINAL ANALYSIS The business has an existing 12.19 square foot wall sign on the ground floor fagade, which the business owner would like to remove and install a new 96.4 square foot wall sign on the upper parapet wall. The intent of the requested increase in sign area is to improve visibility and business identification. The business is located along Collins Avenue and visibility of the storefront has been reduced due to the installation of a bus stop shelter directly in front of the business, which limits visibility to passing motorists and pedestrians. The limited visibility of the existing sign is a special condition that was not created by the Applicant. Additionally, the requested variance is not contrary to the public interest. However, literal enforcement of the sign regulations would not result in unnecessary hardship, as the business could install a wall sign that is compliant in size and continue to operate in a reasonable manner under the requirements. Dryeco Garment Care is requesting a variance solely for the existing front storefront sign located at 18660 Collins Avenue, Suite 100. We are not requesting any site plan modification and we are withdrawing the request for an additional wall sign on the south side of the building. The purpose of this request is to allow for a modest increase in the size of the existing front -facing sign so that the full business identification, including the words "Eco Dry Cleaner," can be clearly legible to passing traffic along Collins Avenue. The proposed sign dimensions are approximately 178 inches in width by 78 inches in height, totaling approximately 96.4 square feet of sign area. Historically, the storefront had greater visibility from the roadway. However, following the installation of a bus stop shelter directly in front of the property, visibility of the storefront has been significantly reduced. As a result, it has become difficult for drivers to identify both the business and the service offered at this location. We frequently receive feedback from customers who were unaware that a dry cleaner operates at this location until they discovered us online or noticed the business while visiting neighboring tenants. The requested signage reflects our registered trademark, which includes both the Dryeco name and the "Eco Dry Cleaner" designation as part of a single integrated mark. At the currently permitted sign size, the lettering for "Eco Dry Cleaner" would be too small to be effectively read by passing motorists, which would reduce the clarity of the service being offered and diminish the effectiveness of the sign. The requested increase in sign area is intended only to ensure that the full mark remains legible and that the nature of the business is clearly communicated to the public. This request is not intended to create excessive signage, but rather to restore reasonable visibility for the business and allow the storefront to function as originally intended prior to the installation of the bus shelter.
