A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, GRANTING AN
UNDERGROUND EASEMENT TO FLORIDA POWER AND
LIGHT FOR GATEWAY PARK, ATTACHED HERETO AS
EXHIBIT "A"; PROVIDING THE CITY MANAGER AND THE
CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,the development of the Gateway Park project includes underground electrical
lines constructed on the property as needed to provide permanent power to the site; and
WHEREAS, this Undergound Easement with accompanying legal description and sketch
provides for the right of Florida Power and Light to own, operate and maintain their infrastructure
on City-owned property; and
WHEREAS, the City Commission wishes to grant the Underground Easement to Florida
Power and Light, attached hereto Exhibit"A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS:
Section 1. Approval to Grant an Undergound Easement. The Underground Easement is hereby
granted to Florida Power and Light for Gateway Park, attached hereto as Exhibit"A".
Section 2. Authorization of City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

The undersigned, in consideration of the payment of $1.00 and other good
and valuable consideration, the adequacy and receipt of which is hereby
acknowledged, grant and give to Florida Power& Light Company, its affiliates,
licensees, agents, successors, and assigns ("FPL"), a non-exclusive
easement forever for the construction, operation and maintenance of
underground electric utility facilities (including cables, conduits, appurtenant
equipment, and appurtenant above-ground equipment) to be installed from
time to time;with the right to reconstruct, improve, add to, enlarge, change the
voltage as well as the size of, and remove such facilities or any of them within
an easement described as follows: Reserved for Cjrcud Court

Together with the right to permit FPL to attach or place wires to or within any facilities hereunder and lay cable and conduit
within the Easement Area and to operate the same for FPL's communications purposes in connection with electric service; the
right of ingress and egress to the Easement Area at all times; the right to clear the land and keep it cleared of all trees,
undergrowth and other obstructions within the Easement Area; the right to trim and cut and keep trimmed and cut all dead,
weak, leaning or dangerous trees or limbs outside of the Easement Area, which might interfere with or fall upon the lines or
systems of communications or power transmission or distribution; and further grants, to the fullest extent the undersigned has
the power to grant, if at all, the rights hereinabove granted on the Easement Area, over, along, under and across the roads,
streets or highways adjoining or through said Easement Area.

A ten (10) foot wide Florida Power & Light Company Easement across a portion of Lots 2, 3, 4, 5, 6A and 6,
SECOND REVISED PLAT OF BELLA VISTA SUBDMSION, according to the plat thereof, as recorded in Plat Book 50 at
Page 76 of the Public Records of Miami—Dade County, Florida and being more particularly described as follows:
Commence at the Southeast corner of said Lot 2; thence S 8742'25" W along the South line of said Lot 2, also
being the North right of way line of Sunny Isles Boulevard for 19.54 feet to the Point of Beginning of the

RE: Resolution Approving Granting an Easement to
Florida Power and Light
RECOMMENDATION:
Staff is recommending the City Commission approve the attached
resolution.
REASONS:
The development of the Gateway Park project includes underground
electrical lines constructed on the property as needed to provide permanent
power to the site. The attached easement agreement with accompanying legal
description and sketch provides for the right of Florida Power and Light to
own, operate and maintain their infrastructure on City owned property.

None at this time
