HomeMy WebLinkAboutReso 2026-4021RESOLUTION NO. 2026 -� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN AMENDMENT TO THE LOCALLY FUNDED AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE REHABILITATION, REPAIR, AND/OR REPLACEMENT OF THE ATLANTIC ISLE HISTORIC BRIDGE, ATTACHED HERETO, AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT, AND TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach (the "City") is the owner of the historically designated Atlantic Isle Bridge (the "Bridge"); and WHEREAS, the Bridge was in need of rehabilitation and restoration to remain in a safe and operable condition (the "Project"); and WHEREAS, the Project is part of the Florda Department of Transportation ("FDOT") Work Program, listed as Project No. No. 430029-2; and WHEREAS, on November 16, 2023, via Resolution No. 2023-3585, the City Commission approved a Locally Funded Agreement and a Three -Party Escrow Agreement (the "2023 LFA") for the Project, whereby FDOT would manage the Project and the City would fund twenty-five percent (25%) of the total project cost, with FDOT funding the remaining seventy-five percent (75%); and WHEREAS, pursuant to the 2023 LFA, the City committed and paid $1,023,409.00 toward the project; and WHEREAS, during the design phase, it was determined that repairs to the Historic Atlantic Isles Bridge would not provide a sufficient long-term solution, and the project scope was modified to include full replacement of the bridge while preserving its historic character through the repurposing of coral rock and other aesthetic elements ("New Scope"); and WHEREAS, the New Scope requires additional funding by the City, in an amount not to exceed Six Hundred Forty -One Thousand Seven Hundred Seventy -One Dollars and No Cents ($641,771.00), bringing the City's total contribution to an amount not to exceed One Million Six Hundred Sixty -Five Thousand One Hundred Eighty Dollars and No Cents ($1,665,180.00); and WHEREAS, the City Commission wishes to approve an Amendment to the Locally Funded Agreement with FDOT for the Project, attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: @BCL@7C16F489 Page 1 of 2 502 Section 1. Approval of Amendment. The City Commission hereby approves the Amendment to the locally Funded Agreement with FDOT for the Project, attached hereto, as Exhibit "A". Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Amendment. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. FOUR HUNDRED AND NINE DOLLARS AND ZERO CENTS ($1,023,409.00) for the Project in accordance with the LFA; and WHEREAS, the Project cost has increased and the Parties desire to amend the LFA to account for the additional funds the Participant must contribute as well as.the contact information for each Party_ NOW, THEREFORE, the Parties agree as follows: 1. The foregoing recitals are true and correct and are hereby incorporated into this Amendment by this reference. 2. Exhibit "B" of the LFA, which sets forth each Party's contribution to the Project, is deleted in its entirety and is replaced with the revised ATTACHMENT 1 attached hereto and made a part of the LFA. 3. Section 4.m. is deleted in its entirety and is replaced with the following: m. Except as expressly provided herein, all of the terms, conditions, covenants, agreements, and understandings contained in the LFA shall remain unchanged and in full force and effect, and the same are hereby expressly ratified and confirmed by the Parties. REASONS: The Historic Atlantic Isles Bridge has been slowly deteriorating for years while being monitored by both the City and FDOT. In 2023, the City entered into a Locally Funded Agreement (LFA) with the Florida Department of Transportation (FDOT) for a repair project that would be led by FDOT. The LFA provides that the City is responsible for 25% of the funding of the entire project and FDOT funds the other 75%. The agreement in 2023 was for $1,023,409.00 which the City paid as is required to keep the project moving. Through the design process, it was determined that repairs would not suffice as a solution for this historic bridge. Therefore, the project scope has changed to include a full replacement of the bridge while maintainingthe historic elements by repurposing the coral rock forthe aesthetic features. This new scope requires additional funding by both parties. The city's portion is now estimated at $1,665,180. With $1,023,409 already paid, the balance of $641,771 must be committed to FDOT for this project and an updated LFA must be executed. ADDITIONAL INFORMATION: The project is included in the City's Capital Improvement Program budget. The additional required funding is requested through a budget amendment.
