BA’s civil litigation history during the past five (5) years consists of the following matter: SH Owner, LLC v. Bermello Ajamil & Partners, Inc., et al., Case No. 2026- 008037-CA-01. This lawsuit alleges that the project design included a stairwell that reduced rentable space and that an elevation interpretation issue resulted in the building being classified as a high-rise structure, leading to additional project costs. The matter is currently under evaluation. BA disputes the allegations, believes the claims are without merit, and expects the matter to be resolved favorably. No findings of liability have been made against BA. The project reimagines the historic McNab House as a vibrant commercial destination while creating a premier botanical garden that showcases South Florida’s unique landscape. Key elements include the adaptive reuse of the McNab House as a restaurant, supported by a commercial kitchen annex; a botanical garden featuring native and tropical plantings, water features, and shaded gathering spaces; an open-air event lawn; and a dedicated event venue for weddings, community functions, and private celebrations. The revitalized 3.2-acre park includes playgrounds, picnic shelters, a restroom pavilion, an interactive water feature, a 12-slip marina, a waterfront promenade, and a new stair tower linking the park to the city’s beachfront district. A signature 50-foot-diameter mosaic installation, created by a local artist, serves as the centerpiece of the interactive water feature and highlights the site’s historical significance. McNair Park is centrally located in the neighborhood of Collier City, which is presently underserved with neighborhood park space. During the preparation of the Collier City Neighborhood Development Plan (DECOMAP), BA designed a range of community-driven improvements designed to enhance recreational opportunities and neighborhood vitality. The McNair Park improvements addressed the addition of a new community center building, a playground with shade covers, a 400-meter running track with eight lanes, and an outdoor gym area. Also included in the design were all new football facilities with a field, viewing stands, a press box, restrooms, improvements to parking areas, and other key components. in cooperation with the city’s Parks and Recreation Department, the team of landscape architects developed a comprehensive park program which meets the needs of the community. The park includes a recreation center, a competition and recreational aquatics center, an amphitheater, a sensory playground and nature area, ball fields, lake activities, a skate park, a pump track, and supporting parking, as well as tennis, basketball, and volleyball courts. Designed as an inclusive and accessible community asset for all ages, the park fosters recreation, social interaction, and community engagement. The estimated project construction budget is $16.5 million. The park will be utilized jointly by the residents of the City of North Miami and students from neighboring Miami-Dade County schools. The project also includes an extensive public involvement program to gather input from the neighborhood and inform the community of the park’s construction progress. The existing 3.5 acre site was covered with Category i invasive Australian Pine Trees that were removed for environmental reasons, making way for a variety of opportunities. With community input during the master planning process, the team reimagined park uses and amenities. The new park plan is divided into four quadrants accessible via bisecting palm shaded walkways. Each quadrant has its own identity and use, from sand volleyball to boccie courts, as well as covered playgrounds with safety surfacing to a large park concession and restroom building. The entry facility is the focal point of the park and designed as two buildings separated by a breezeway, which frames a focused view of the Atlantic Ocean. One building provides the park with a restroom facility while the other is a built out shell for lease to a snack bar type vendor concession. From the ongoing neighborhood involvement and working closely with city staff, the BA team developed an extensive program for the new park including a new community swimming facility, reconfigured professional level basketball courts, picnic areas, exercise stations, and an expanded shaded playground area that accommodates a greater range of age groups. As both the project landscape architect and project architect, BA developed various alternatives for the aquatic swim building, a focal point to the park’s redevelopment. The new pool serves the community’s recreational needs, including a beach entry feature and three lap lanes which can be modified for swim health classes. Designed to both improve community access and allow for better visibility into the park, a new parking lot was designed along the park’s south side. B.F. ARCHITECTURE Relevant Project Experience BA developed and evaluated multiple site planning alternatives for the City of Miami Springs’ Senior Center, creating a facility that expands services for older adults while maximizing functionality on a constrained site. Designed with safety and accessibility as primary considerations, the project carefully accommodates pedestrian circulation among the adjacent ballfield, playground, and new restroom facilities. The new Senior Center enables the city’s Elderly Services Department to provide a comprehensive range of programs and resources, including congregate and home-delivered meals, nutrition counseling, health and wellness activities, recreation, transportation, adult education, screening and assessment services, advocacy, and referral assistance. The project included a 6,000-square-foot, four-lane hybrid pool in addition to a pool deck, pool and multipurpose buildings, concessions, parking, landscaping, irrigation, cabanas, furnishings, and other site enhancements. BA provided master planning, preliminary design, community outreach, public surveys and presentations, City Council support, bidding-phase assistance, and owner’s representative services during construction. The team also coordinated with the Art in Public Places program to integrate public art into the facility. Designed to complement the adjacent adobe-style Community Center, the aquatic complex features administrative offices, locker rooms, secure guest access, event space, and community-oriented amenities that support both daily recreation and special events. The multiphase program included the redesign of the 18-hole golf course by Richard Mandell Golf Architect in collaboration with Miller Legg; construction of a new 7,600-square-foot clubhouse featuring a pro shop, multifunction space, food preparation area, and administrative offices; and development of a new 4,000-square-foot cart barn with capacity for approximately 76 golf carts and charging stations. Additional work included the renovation and conversion of an existing 6,000-square-foot pro shop and cart barn into a maintenance facility, as well as cosmetic upgrades to the existing fairway restrooms. Beyond the golf course and building improvements, the project incorporated extensive water management and soil contamination remediation efforts supported by a multidisciplinary subconsultant team, resulting in a modernized recreational facility and enhanced site infrastructure. The center is elevated on a pedestal whereby the site is maximized to allow for ground floor surface parking and approximately 2,000 square feet of office space. A grand stair and elevator take users to the second level, where they are met with a grand open terrace with unobstructed views to the intracoastal and the main entrance to the facility. The community center is further enhanced with an added program that allows for an approximately 1,400-square-foot “flex space” to be used by the community for any private events. Both the community center and flex space are connected by a covered patio where both areas can become one if needed. The architectural style is emblematic of Deerfield Beach and blends with the existing Sullivan Park architecture. Each program volume was strategically placed on the second level and is inherently connected by a roofline with a geometric design as well as a modern play on materials and textures of Hardie board and wood veneer paneling. These carefully studied and strategic components provide a strikingly elegant design that perfectly fits the existing Sullivan Park concept. Cost Control BA’s approach to cost control begins during the concept design phase of the project. During this phase we develop an order of magnitude cost of construction estimate based on the size, type, and current construction cost data. We also make an initial evaluation of the site conditions, proposed hardscape, and soft scape areas of the project to gauge the anticipated cost attributed to site improvements. During the schematic design (SD) phase we begin to break down the cost by the proposed structural, mechanical, electrical systems and anticipated level of finishes. We include a preliminary list of plant material and area calculation for hardscaped surfaces. This Schematic Design estimate serves to initiate our value engineering strategy for the project. During this SD phase we confirm that the requested programmatic elements can be incorporated as part of the proposed design for the project. We carry multiple contingencies for escalation, design and economic conditions that may impact future costs in the construction industry. The next major estimate of the cost of construction is performed during the design development (DD) phase of the project. The estimating team is giving a set of DD drawings along with the proposed finishes, lighting and mechanical equipment and systems as well as site improvements and owner reviewed and approved landscaped areas. Based on the findings during this pricing exercise the client and the design team evaluate possible value engineering options. The goal of this pricing exercise is to reduce the need for major changes to the project as we proceed into the construction documentation phase of the project. During this pricing phase we also identify possible add alternates based on the owner’s programmatic priorities. During the construction documentation phase, we reconfirm the cost estimates at 30% and 75% completion of the set of documents. The initial percentages for contingency are reduced based on having higher accuracy of the construction systems and details, mechanical, electrical and plumbing equipment and the selected finishes for all areas of the building, along with site improvements, hard and soft landscaped areas and specialty conditions that may be unique to the project. The final estimate at 75% completion serves as the basis of comparison against the cost of construction received during the bidding phase of the project. We have implemented this approach on numerous projects, large and small. Value engineering is integral to our design approach. Our schedule identifies each of the phases of the project, the deliverable dates with deliverable packages, critical tasks and we highlight critical tasks that could limit our ability to maintain the schedule. As we progress into the project, we continuously monitor the project schedule, and we identify potential delays which allow us to provide adjustments or find ways to realign the project team to maintain the owner’s schedule. One of the biggest challenges is having the necessary information be it from an owner, stakeholders, municipality, or design team members that will ensure adherence to the base project schedule. To properly address these challenges, we provide timely requests to all members of the team that could impact the schedule. When information is just not available regardless of the reason we work with the entire team to find solutions that will maintain or have a minimal impact to the schedule. Our schedule will identify a period for permitting and for construction of the project. These are two phases where the design team does not have full control of the end date to complete these phases. During permitting we are proactive in collecting, reviewing, and responding to permit comments. We work closely with our subconsultants to ensure that they commit to our sense or urgency in addressing permit comments. Upon the selection of the construction team, we immediately begin with a thorough review of the construction schedule. Our first request to the construction team is to identify within a reasonable timeline the anticipated delivery of shop drawings requiring the design team’s review. This will allow us to have our design team members ready to address, review and approve shop drawings which are critical to the construction sequence. We also recognize the importance of addressing requests for information that will further assist the construction to maintain the sequence of constriction.
