HomeMy WebLinkAboutReso 2026-4084RESOLUTION NO. 2026 - A RESOLUTION OF THE COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, DIRECTING THE CITY MANAGER TO INITIATE INQUIRIES AND EXPLORE OPPORTUNITIES WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION REGARDING THE POTENTIAL JOINT USE, LEASE, OR ACQUISITION OF STATE- OWNED STORMWATER RETENTION PROPERTY WITHIN AND ADJACENT TO THE WEST END OF STATE ROAD 826 FOR THE POSSIBLE DEVELOPMENT OF ADDITIONAL PARKING; PROVIDING FOR IMPLEMENTATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach continues to experience constrained public parking within its jurisdictional boundaries; and WHEREAS, the Florida Department of Transportation ("FDOT") owns and maintains stormwater retention and drainage parcels within and adjacent to the west -end of State Road 826 ("SR826") right-of-way; and WHEREAS, Sections 337.25 and 337.251, Florida Statutes, authorize FDOT to lease, license, or convey property and airspace within its right-of-way where such use is compatible with transportation purposes; and WHEREAS, additional parking developed in the area may be feasible if the stormwater treatment and storage capacity of the facility is fully preserved or compensated; and WHEREAS, the City Commission wishes direct the City Manager, at a preliminary and non- binding stage, to discuss with FDOT the feasibility of this endeavor prior to the City committing funds on design or engineering; and WHEREAS, the City Commission finds that it is in the best interests of its residents, visitors, and stakeholders to approve this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA: Section 1. Recitals. The foregoing recitals are true and correct and are adopted as if fully set forth herein. Section 2. Directive and Authority of the City Manager. The City Manager, or designee, is directed to contact FDOT District Six and inquire as to: a) The ownership status and any surplus designation of the subject parcel(s); b) FDOT's willingness to consider a joint use agreement, airspace lease, or conveyance; c) Engineering and permitting constraints, including stormwater treatment and storage capacity, access, vertical clearance, and proximity to the travel way; and @BCL@C018B7DF Page 1 of 2 384 d) Any coordination required with the South Florida Water Management District and Miami -Dade County. The City Manager shall report findings to the City Commission within 120 days of adoption of this Resolution. The City Manager is further authorized to do all things necessary to effectuate the terms of this Resolution. Section 4. Non -Binding. This Resolution creates no obligation to fund, design, permit, or construct any facility, confers no rights on any third party, and does not constitute approval of any project. Section 5. Effective Date. This Resolution shall become effective immediately upon adoption. REASONS: The proposed Resolution directs the City Manager to initiate discussions with the Florida Department of Transportation (FDOT) regarding the potential joint use, lease, or acquisition of State-owned stormwater retention property within and adjacent to the west end of State Road 826 for the possible development of additional public parking. The Resolution authorizes the City Manager to evaluate property availability, potential agreements with FDOT, engineering and permitting constraints, and any necessary coordination with other governmental agencies. The City Manager will report the findings to the City Commission within 120 days.
