Action: Commissioner Lama moved, and Commissioner Viscarra seconded. The motion to approve the minutes was approved by a voice vote of 5-0. ORDER OF BUSINESS (Additions/Deletions/Amendments) DEFERRED: 12B. Discussion Regarding a Whistleblower Ordinance;12C. Discussion Regarding a Procedures for Commission Absences and Remote Participation; ADDITIONAL INFORMATON: 12D. Discussion Regarding Request FDOT to Install Traffic Light at 196 Street and Collins Avenue. Request to Hear Items. Action: Vice Mayor Joseph moved, and Commissioner Viscarra seconded. The motion to approve Request to Hear Items was approved by a voice vote of 5.0. SPECIAL PRESENTATIONS 5A. Proclamation Presentation for Autism Awareness Month. Action: Report of Cultural and Community Services Director Gayle Vasile and Joe Webb of Aecom. [Clerk's Note: Change of Order - Item 12D was heard before 6A.1 6. ZONING 6A. Request of Pollo Operations Inc. ("Applicant"), for a Site Plan Modification — Exterior Paint Palette Approval - to 17084 Collins Avenue (Hearing #PZ2023-01). Action: Planning and Zoning Director Amy Canales reported. City Clerk Betancur read a disclaimer for the Zoning hearing and administered the oath to witnesses. City Clerk Mauricio Betancur asked if there were any Ex Parte disclosures to which all five (5) Commissioners stated they had not met with the applicant. Public Speakers: Gutierrez, Angel, Architect. After presentation from the applicant representatives and comments from the City Commission, Commissioner Stuyvesant moved to approve the application, and Vice Mayor Joseph seconded. The motion passed by a roll call vote of 5-0, in favor. An Ordinance Of The City Commission Of The City Of Sunny Isles Beach, Florida, Repealing Section 74-8, Titled "Standing Committees; Chairpersons" Of The Code Of Ordinances Of The City Of Sunny Isles Beach And Creating A New Section 74-8, Titled "Advisory Boards And Committees" Thereby Establishing Regulations And Procedures Governing Appointive Advisory Boards And Committees And Providing For Uniform Advisory Board And Committee Membership Requirements And Procedures; Repealing Section 74-9, Titled "City Boards And Agencies"; Providing For Repealer, Severability, Codification, And An Effective Date. 2 Summary Minutes: Regular City Commission Meeting April 20, 2023 City of Sunny Isles Beach, Florida Action: City Clerk Mauricio Betancur read the corrected the title into the record and Deputy City Attorney Alain Boileau reported. Public Speakers: Edelcup, Norman, Joseph, Jodie. Commissioner Viscarra moved, and Commissioner Stuyvesant seconded a motion as Amended to adopt the Ordinance on first reading. Second and final reading will be scheduled for May 18, 2023. The motion was approved by a roll call vote of 4-1 in favor. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending Ordinance No. 2022-595; Approving Budget Amendment No. BA2223-02 to the City's Operating and Capital Improvement Budget for the 2022-2023 Fiscal Year - General Fund, Street Maintenance & Construction Fund, Special Revenue Fund, Capital Projects Fund, and Stormwater Operations Fund; Authorizing the City Manager to Do All Things Necessary to Implement the Terms and Conditions of this Ordinance; Providing for an Effective Date. Action: City Clerk Mauricio Betancur read the title, and Finance Director Tiffany Neely reported. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving a Third Amendment to the Agreement with Jorda Enterprises, Inc. for Inspection and Preventative Maintenance Services for the HVAC Equipment Located in the Government Center, in an Amount Not to Exceed $31,480.00, Attached Hereto as Exhibit "A"; Authorizing the Mayor to Execute Said Amendment; Authorizing the City Manager to Do All Things Necessary to Effectuate this Resolution; Providing for an Effective Date. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Repealing Resolution No. 2021-3253 and Approving the Purchase of a 2023 Freightliner 114SD Conventional Chassis Set Back Axel Vehicle From Tampa Truck Center, in an Amount Not to Exceed $126,554.00, Attached Hereto as Exhibit "A"; Authorizing the City Manager to Do All Things Necessary to Effectuate This Resolution; Providing for an Effective Date. [Clerk's Note Change of Order: Heard before 7A.7 A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Approving Monetary Donation to the Mourning Senior High PTSA, in an Amount Not to Exceed $750.00; Authorizing the City Manager to Do All Things Necessary to Effectuate This Resolution: Providing for an Effective Date. Action: City Clerk Mauricio Betancur read the title, and Commissioner Lama reported. It was disclosed that both Commissioner Lama and Commission Stuyvesant had a potential voting conflict of interest. After discussion, no motion was made to approve the resolution. (Clerk's Note: Change of Order: Heard after 6A.1 Discussion Regarding Request FDOT to Install Traffic Light at 196 Street and Collins Avenue. Action: Vice Mayor Joseph reported. After a brief discussion, it was the consensus of the City Commission to support the installation of a traffic light at 196th Street and Collins Avenue. Vice Mayor Joseph moved, and Commissioner Viscarra seconded a motion to direct staff to formalize the decision of the City Commission into a resolution.
