A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH,FLORIDA,APPROVING A MEMORANDUM
OF UNDERSTANDING RELATING TO AN AMENDED PAY PLAN
FOR SERGEANTS AS SET FORTH IN ARTICLE 10 OF THE
COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY
OF SUNNY ISLES BEACH AND DADE COUNTY POLICE
BENEVOLENT ASSOCIATION("PBA")ATTACHED HERETO AS
EXHIBIT "A"; AUTHORIZING THE CITY MANAGER AND
POLICE CHIEF TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on March 15, 2012 the City of Sunny Isles Beach entered into a Collective
Bargaining Agreement("Agreement')with the Dade County Police Benevolent Association regarding
terms and conditions of employment;
WHEREAS, pursuant to the Agreement, the terms may be amended with mutual written
consent of the parties; and
WHEREAS, the City of Sunny Isles Beach desires to enter into a Memorandum of
Understanding amending the current Pay Plan for Sergeants.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH AS FOLLOWS:
Section 1. Approval of Memorandum of Understanding. The City Commission hereby approves
the Memorandum of Understanding amending the current Pay Plan for Sergeants as set forth in Article
10 of the Collective Bargaining Agreement, attached hereto as Exhibit"A".
Section 2. Authorization of City Manager and Police Chief. The City Manager and Police Chief are
hereby authorized to do all things necessary to effectuate this Resolution.
Section 3. Effective Date. This Resolution shall take effect immediately upon adoption.

MEMORANDUM OF UNDERSTANDING
ARTICLE 10 COMPENSATION
The City of Sunny Isles Beach, Florida ("the City") and the Dade County Police
Benevolent Association ("PBA") hereby enter into this Memorandum of Understanding
amending the current Sergeant and Officer Salary Pay Plan ("Pay Plan") set forth in Article 10 of
the Collective Bargaining Agreement between the City and the PBA ("the parties") regarding
increases to the Pay Plan, and;
WHEREAS, the parties acknowledge that Article 10, COMPENSATION, Section 1. of
the current Collective Bargaining Agreement states "The Pay Plan may be revised from time-to-
time based on the total compensation survey pursuant to Section 5 below. Nothing restricts the
City, at its sole discretion from starting a new employee at a higher step in order to compensate
for superior experience or other such relevant considerations." and;
WHEREAS the parties further acknowledge that Article 31, TERM OF AGREEMENT, ,
Section 3. states "It is understood and agreed that this Agreement constitutes the total agreement — .'
of the parties. The terms of this agreement shall not be amended, except by the mutual written
consent of the parties as they may from time to time agree.; and:
WHEREAS the parties have agreed to Amend the current pay plan to reflect increases set
forth in the "Amended Sergeant and Officer's Pay plan" (attached hereto and incorporated
herein by reference) and have further agreed that all the remaining provisions/articles of the
2012-2015 Collective Bargaining Agreement shall remain unchanged and in full force and effect.
THEREFORE based_on the provisions of the current Collective Bargaining Agreement
sited above, the mutual promises contained herein and other good and valuable consideration the
parties agree to modify Article 10 COMPENSATION as follows:

1. Section 1.All new employees will receive upon hire at least the minimum pay step salary
as delineated in the Amended Proposed Sergeant Pay Plan and Amended Proposed
Officer pay Plan ("Pay Plan") attached to Resolution No. 2008 1219 2°1 C"2'A1 of the
City Commission.
2. This Memorandum of Understanding shall be effective 2- (9 Band shall be
incorporated into the current Collective Bargaining Agreement (2012 - 2015) unless
modified in writing in accordance with Article 31, Section 3.

COMPENSATION

RE: Memorandum of Understanding—PBA Agreement, Article 10 Compensation
RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
The City entered into a Collective Bargaining Agreement with the Dade County Police
Benevolent Association on March 15, 2012. Article 10, Section 1 of the Agreement states that
the Pay Plan may be amended with the written consent of the parties.
Staff is recommending approval of the Memorandum of Understanding relating to the amended
Pay Plan for Sergeants. The City Commission had previously approved the Pay Plan for the
Sergeants. Please note the amended Pay Plan added two additional steps for Sergeants.
