(THE "APPLICANT") TO INCREASE THE EXISTING PARKING SPACES IN THE TDR TRUMP TOWERS I, II AND III, PARKING GARAGE FROM 1,050 TO 1,390 PARKING SPACES; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. I. RECITALS WHEREAS,TDR Towers Master Association,Inc. (the"Applicant")submitted a site plan modification application (Application No. PZ2014-17) to the City of Sunny Isles Beach, Florida requesting the following: 1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development Regulations,the Applicant is requesting approval of a site plan modification to increase the parking count from 1,050 to 1,390 parking spaces. 2. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development Regulations,the Applicant is requesting a building separation variance to permit a building separation of 0 feet where 100 feet is required pursuant to Section 265-35 D.(5)of the Land Development Regulations. 3. WHEREAS, on February 19, 2015, the City Commission conducted a public hearing on this site plan modification application; and WHEREAS, the public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the positive recommendation contained in the City's Community Development Department Review Report; and WHEREAS, notice was provided to all interested parties regarding the site plan modification application; and WHEREAS, the City Commission reviewed the site plan modification application, the written and oral recommendations of the Zoning Administrator of the Community Development Department, including the recommended conditions, and finds substantial competent evidence to support a showing by the Applicant that the request for site plan modification is in compliance with the Land Development Regulations and the Comprehensive Master Plan of the City and maintains the basic intent and purpose of the zoning, subdivision or other land use regulations, which is to protect the general welfare of the public, particularly as it affects the stability and appearance of the community; and, further finds that said request should be granted, subject to the conditions described herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: 15-Z- 15811, 15901 and 16001 Collins Ave. 2 II. INCORPORATION OF RECITALS All recitals above are incorporated into the body of this Resolution as if same were fully set forth herein. III. FINDINGS AND CONCLUSIONS: Based on an analysis of the application and the standards for approval for a site plan modification under the Land Development Regulations, the City Commission makes the following findings and conclusions: A. The Applicant's request for site plan modification is consistent with the Comprehensive Plan of the City of Sunny Isles Beach. IV. APPROVAL A. The Applicant's requested approval of a site plan modification to increase the parking count from 1,050 to 1,390 parking spaces is hereby approved. B. The Applicant's requested building separation variance to permit a building separation of 0 feet where 100 feet is required is hereby approved. C. The Applicant's requested building width variance to permit an 800 feet where 250 feet is allowed is hereby approved. D. The Applicant's requested parking space size variance to permit parking spaces of 8 feet and 6 inches in width where 9 feet in width is required is hereby approved. V. CONDITIONS A. Conditions to be completed before demolition, below grade or building permits are issued. (1) That the plans in the approval be substantially in accordance with that submitted for public hearing and are entitled"Trump Towers I, II&III Parking Extension"prepared by axioma3 architects consisting of 22 sheets dated stamped received January 30, 2015. (2) Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the Community Development Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations. Should revisions in the plans result in a change that would not be considered"minor"in accordance with Section 265-18 of the City Code, the Applicant shall be required to obtain another approval of the City Commission. 15-Z- 15811, 15901 and 16001 Collins Ave. 3 (3) All conditions set forth in Resolution No. 05-Z-94 adopted on July 14th, 2005 shall remain in effect. (4) That the Applicant submit an amendment to the recorded Declaration of Restrictions in recordable form acceptable to the Community Development Department and acceptable to the City Attorney prior to submittal for an application for building permit, which proffers: (i) 24-hour valet parking services for owners and guests. (5) That the Applicant complies with all conditions and permit requirements,including but not limited to Miami-Dade County, including environmental conditions and permitting, Shoreline Development Review Committee, the Fire and Water and Sewer Departments, Florida Department of Environmental Protection (DEP) and Florida Department of Transportation(FDOT). (6) The Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. B. Conditions to be completed before any Certificate of Occupancy is issued. (7) Under the City Code, the City Manager and/or his/her designee in review of any application, may refer any such application presented to it to such engineering, planning, legal,technical,or environmental consultant or professional(s)employed by the City as the Manager shall deem reasonably necessary to enable him/her to review such application as required by law. Charges made by such consultants or professionals shall be in accord with the charges customarily made for such services in Miami-Dade County, and pursuant to an existing contractual agreement by and between the City and such consultant. Charges made by the City shall be in accord with the hourly rates charged by such consultants or hourly rates of employed professionals and shall be paid within 30 days on submission of City voucher. (8) At the time of submission of any application or thereafter, it is required that an escrow account be established, from which withdrawals shall be made to reimburse the City for the cost of professional review services, if any. The Applicant shall then provide funds to the City for deposit into such account in an amount to be determined by the City Manager, based on his/her evaluation of the nature and complexity of the application. The Applicant shall be provided with copies of any City voucher for such services as they are submitted to the City. When the balance in such escrow is reduced to one-third (1/3) of its initial amount, the applicant shall deposit additional funds into such account to bring its balance up to the amount of the initial deposit. If such account is not replenished within thirty-days (30) after the applicant is notified, in writing, of the requirements for such additional deposit,the City may suspend its review of the application. An application shall be deemed incomplete if any amount shall be outstanding. A building permit or Certificate of Use and Certificate of Occupancy shall not be issued unless all professional review fees charged in connection with the applicant's project have been reimbursed to the City. Once all pertinent charges have been paid, the City shall refund to the Applicant any funds remaining on deposit. 15-Z- 15811, 15901 and 16001 Collins Ave. 4 C. Other Conditions (9) That the Applicant obtains a Certificate of Occupancy and a Certificate of Use from the City upon compliance with all terms and conditions. The Certificate of Occupancy and Certificate of Use shall be subject to cancellation upon violation of any of the conditions. (10) That the approved site plan shall remain valid for a period of 24-months from the date of approval. If no building permit is issued within the 24-month time period, the site plan shall be considered null and void and of no force and effect. (11) That the Applicant complies with all City Ordinances, County, State and Federal Laws and Regulations applicable to development and permit approvals. NO BUILDING PERMIT SHALL BE ISSUED UNLESS THE APPLICANT HAS SUBMITTED ALL DOCUMENTS REFERRED TO UNDER THIS RESOLUTION AND SHALL HAVE PAID ALL IMPACT FEES, BONUSES AND PROFESSIONAL FEES (AS PER SECTION 267-4 OF THE CODE OF THE CITY OF SUNNY ISLES BEACH) AND ALL OTHER FEES DUE AND OWING PURSUANT TO THE APPLICABLE LAND DEVELOPMENT REGULATIONS, AND SHALL HAVE SUBMITTED PAYMENT TO THE CITY FOR ALL TRANSFER OF DEVELOPMENT RIGHTS (IF APPLICABLE). FAILURE BY THE CITY TO TIMELY ENFORCE ANY OF THE ABOVE CONDITIONS DOES NOT CONSTITUTE A WAIVER OF THE SAME AND IF THE APPLICANT, ITS SUCCESSORS, OR, ASSIGNS, DOES NOT PERFORM SUCH CONDITIONS WITHIN FIVE (5) DAYS AFTER WRITTEN NOTICE, THE CITY RETAINS THE RIGHT TO STOP CONSTRUCTION, IF NECESSARY, UNTIL THAT CONDITION IS MET. BY ACTING UNDER THIS APPROVAL, APPLICANT HEREBY CONSENTS TO ALL THESE TERMS AND CONDITIONS. VI. AUTHORIZATION OF CITY MANAGER The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. VII. SEVERABILITY If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate,distinct,and independent provision and such holding shall not affect the validity of the remaining portions of this Resolution. VIII. REPEALER All Resolutions are parts of Resolutions in conflict herewith shall be hereby and are repealed. 15-Z- 15811, 15901 and 16001 Collins Ave. 5 IX. No. PZ2014-17 RECOMMENDATION: Based on staff review, the application is generally consistent with the City's Comprehensive Plan and the City's Land Development Regulations except for the variances requested. REASONS: The Applicant is requesting approval of a site plan modification to increase the existing parking spaces in the TDR Trump Towers I, II, III parking garage from 1,050 to 1,390 parking spaces. The original zoning approval consisting of three multifamily condominium towers with a total of 813 condominium units was issued pursuant to Resolution No. 05-Z-94, adopted on July 14th, 2005. The Land Development Regulations (LDRs) at the time, specifically Section 265-46 A. (2)(b) of the City Code permitted the reduction of the required parking of a development project for a monetary contribution to the Off-Street Parking Fund. This parking buy-down program provided a credit of 244 parking spaces for the TDR Trump Tower project. Land Use: Mixed Use - High Density Resort (MUHDR) This category is intended to provide for resort style developments (hotels, hotel-apartments and resorts), high quality residential apartments (as-of-right 50 DUs/acre and 2.5 F.A.R.) and associated internal accessory uses (restaurants and other convenience services). Residential densities with bonuses may not exceed eighty (80) units per acre for apartments. The density may be increased by the utilization of TDRs. History: These parcels received a site plan approval pursuant Resolution No. 05-Z-94, adopted on July 14th, 2005, for a multifamily residential condominium (TDR Trump Towers), consisting of three towers and a parking garage. STANDARS OF REVIEW FOR VARIANCES Pursuant to Section 265-15 Variances. A variance shall be granted only where competent and substantial evidence presented in the particular case shows that all of the following are met: (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district; (2) The special conditions and circumstances do not result from the actions of the petitioner; (3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant; (4) The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs; (5) Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district; (6) The variance, if granted, is the minimum variance that makes possible the reasonable use of the land, building or structure; (7) The grant of the variance is in harmony with the general intent and purpose of these LDRs, is not injurious to the neighborhood or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. Applicant Statement: In furtherance of this project, the Association is requesting the City consider its request for the variances as detailed below. In the course of the City's review of the below variances, the Association respectfully requests that the City use the City's 2005 standards as the base for 5 PZ2014-17 TDR Trump Towers Parking Garage—Site Plan Modification their review as the TDR Towers Project was originally constructed in accordance with said 2005 standards. 1. Building Separation §265-35 D. (5). The Association understands that to preserve ocean views for properties west of Collins Avenue, primary use buildings exceeding 20 feet in height above grade on the same site shall be separated by a minimum of 100 feet as measured parallel to Collins Avenue. a. The Association is requesting a variance to allow 0'-0"Building Separation between the new pedestal deck and existing residential Towers for the two new parking decks to be constructed instead of the existing 120'-0"separation currently in place. It is suggested that this requested variance will not have a negative impact on the surrounding community as the building separation between the Towers above the new parking decks will remain the same. 2. Building Width §265-35 D. (6). The Association understands that to further preserve ocean views for properties west of Collins Avenue, for parcels 200 feet or more in width, the maximum building width, as measured parallel to Collins Avenue, of any single structure or portion thereof exceeding 20 feet in height above grade shall be 250 feet. a. The Association is requesting a variance to allow the new pedestal height of 46'-0"to the top of the new lanai deck and 62'-8"to the top of the new pavilion structure instead of the existing 19'-11"height currently in place. It is suggested that this requested variance will not have a negative impact on the surrounding community as the pedestal height will only be increased between the residential towers. 3. Parking Spaces Dimension§265-46 A. (7)(a). The Association understands that each parking space provided pursuant to the provisions of the Code of Ordinances of Sunny Isles Beach shall be not less than 9 feet by 18 feet in length for residential developments. a. In 2005 the Code of Ordinances of Sunny Isles Beach provided that all parking spaces shall be not less than 8.5 feet by 18 feet in length it was later amended to increase the width of all parking spaces to 9 feet. The Association is requesting a variance to allow the new parking spaces to be constructed 8.5 feet wide by 18 feet in length which would be equal to the original building design as approved by the City in 2005. In further support of the Association's request for the City's approval, of the above requested variances, please be advised that it is the Association's highest priority to provide additional parking spaces within its garage without compromising the aesthetic features of the TDR Towers Project. As you may be aware the TDR Towers Project as originally constructed fails to provide enough parking spaces for the Residents, Guests and Invitees who reside and visit the property. Unfortunately, the Association inherited an insufficient number of parking spaces from the Developer and was not a party to or involved with the original project design and site approvals. During the construction of the TDR Towers Project the Developer entered into a buy down with the City and in exchange for a contribution to Off-Street Parking the Developer was approved for the reduction of 20% (244) of the required parking spaces. The loss of the previously mentioned parking spaces has had a direct impact on the Association's ability to accommodate and meet the parking needs of the TDR Towers Project. Currently, the parking demand and need on the property is so great that the Association has had to expend funds to rent additional parking spaces thereby requiring valet staff to cross Collins Avenue for the retrieval of vehicles. The hardship, lack of parking spaces, which the Association is currently experiencing, is not an economic hardship but rather a logistic and 6 PZ2014-17 TDR Trump Towers Parking Garage—Site Plan Modification planning hardship as the current parking garage is a poor use of existing space and the Association is unable to accommodate its Resident's vehicles. One way in which the Association intends to logistically address the insufficient number of parking spaces is to install mechanical parking lifts, as a component of the Project, which will provide additional parking spaces without the need for a large amount of additional square footage. The literal interpretation of the City's zoning and building laws and the City's failure to approve the Association's requested variances will be a continuing undue hardship upon the Association and its Residents. The variances being requested by the Association are the minimum variances which will make the Association's goal of additional parking spaces possible. The variances if granted will allow the Association to increase the number of parking spaces available to its Residents and will improve the community by providing aesthetically pleasing landscaping along the Association's portion of Collins Avenue and the beach. The Association believes that this Project and the requested variances will enhance property values for its Residents and the surrounding community and will not negatively impact public safety or the general welfare. The Association is hopeful that the City will find the foregoing variance requests and this Project to be in the best interests of the Residents of the TDR Towers Project and the surrounding community. FINAL ANALYSIS Based on the above review, the application is generally consistent with the City's Comprehensive Plan and the City's Land Development Regulations. The application is generally consistent with the Land Development Regulations except for the variances. VIII. CONDITIONS If the City approves this application, the application will be subject to the following conditions set forth in Section VII. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations. Should revisions in the plans result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. (3) All conditions set forth in Resolution No. 05-Z-94 adopted on July 14th, 2005 shall remain in effect. (4) That the Applicant submit an amendment to the recoded Declaration of Restrictions in recordable form acceptable to the Community Development Department and acceptable to the City Attorney prior to submittal for an application for building permit, which proffers: (i) 24-hour valet parking services for owners and guests. The Association understands that to further preserve ocean views for properties west of Collins Avenue, for parcels 200 feet or more in width, the maximum building width, as measured parallel to Collins Avenue, of any single structure or portion thereof exceeding 20 feet in height above grade shall be 250 feet. a. The Association is requesting a variance to allow the new pedestal height of 46'-0" to the top of the new lanai deck and 62'-8" to the top of the new pavilion structure instead of the existing 19'-11" height currently in place. It is suggested that this requested variance will not have a negative impact on the surrounding community as the pedestal height will only be increased between the residential towers. 3. Parking Spaces Dimension §265-46 A. (7)(a). The Association understands that each parking space provided pursuant to the provisions of the Code of Ordinances of Sunny Isles Beach shall be not less than 9 feet by 18 feet in length for residential developments. a. In 2005 the Code of Ordinances of Sunny Isles Beach provided that all parking spaces shall be not less than 8.5 feet by 18 feet in length it was later amended to increase the width of all parking spaces to 9 feet. The Association is requesting a variance to allow the new parking spaces to be constructed 8.5 feet wide by 18 feet in length which would be equal to the original building design as approved by the City in 2005. In further support of the Association's request for the City's approval, of the above requested variances, please be advised that it is the Association's highest priority to provide additional parking spaces within its garage without compromising the aesthetic features of the TDR Towers Project. As you may be aware the TDR Towers Project as originally constructed fails to provide enough parking spaces for the Residents, Guests and Invitees who reside and visit the property. Unfortunately, the Association inherited an insufficient number of parking spaces from the Developer and was not a party to or involved with the original project design and site approvals. During the construction of the TDR Towers Project the Developer entered into a buy down with the City and in exchange for a contribution to Off-Street Parking the Developer was approved for the reduction of 20% (244) of the required parking spaces. The loss of the previously mentioned parking spaces has had a direct impact on the Association's ability to accommodate and meet the parking needs of the TDR Towers Project. Currently, the parking demand and need on the property is so great that the Association has had to expend funds to rent additional parking spaces thereby requiring valet staff to cross Collins Avenue for the retrieval of vehicles. The hardship, lack of parking spaces, which the Association is currently experiencing, is not an economic hardship but rather a logistic and planning hardship as the current parking garage is a poor use of existing space and the Association is unable to accommodate its Resident's vehicles. One way in which the Association intends to logistically address the insufficient number of parking spaces is to install mechanical parking lifts, as a component of the Project, which will provide additional parking spaces without the need for a large amount of additional square footage. i Claudia Hasbun January 14, 2015 Page 4 The literal interpretation of the City's zoning and building laws and the City's failure to approve the Association's requested variances will be a continuing undue hardship upon the Association and its Residents. The variances being requested by the Association are the minimum variances which will make the Association's goal of additional parking spaces possible. The variances if granted will allow the Association to increase the number of parking spaces available to its Residents and will improve the community by providing aesthetically pleasing landscaping along the Association's portion of Collins Avenue and the beach. The Association believes that this Project and the requested variances will enhance property values for its Residents and the surrounding community and will not negatively impact public safety or the general welfare. The Association is hopeful that the City will find the foregoing variance requests and this Project to be in the best interests of the Residents of the TDR Towers Project and the surrounding community.
