A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE: CITY
MANAGER OR DESIGNEE TO STRICTLY ENFORCE TRAFFIC
OBSTRUCTION LAWS RELATING TO COMMERCIAL
VEHICLES ON COLLINS AVENUE AND SUNNY ISLES
BOULEVARD DURING PEAK TRAFFIC HOURS BASED ON
GUIDANCE PROVIDED BY FLORIDA DEPARTMENT OF
TRANSPORTATION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Sections 316.1945 and 316.2045, Florida Statutes, are traffic laws which
prohibit commercial vehicles from blocking the flow of traffic on Collins Avenue and Sunny Isles
Boulevard; and
WHEREAS, the City of Sunny Isles Beach has the authority under its police powers to
enforce state traffic laws; and
WHEREAS, the City Commission wishes to authorize the City Manager or designee to
strictly enforce the State of Florida traffic obstruction laws relating to Collins Avenue and Sunny
Isles Boulevard during peak traffic hours.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH AS FOLLOWS:
Section 1. Directions to the City Manaeer. The City Commission hereby authorizes the City
Manager or designee to strictly enforce the State of Florida traffic laws relating to Collins Avenue
and Sunny Isles Boulevard during peak traffic hours based on guidance provided by Florida
Department of Transportation.
Section 2. Effective Date. This Resolution shall take effect immedi. - y upon adoption.

RE: Authorizing Strict Enforcement of State Traffic
Obstruction Statutes
RECOMMENDATION:
This Resolution is presented for your consideration.
REASONS:
Over the past year, I have received numerous complaints about commercial
vehicles obstructing the flow of traffic on Collins Avenue and Sunny Isles
Boulevard. Based on these complaints, I have asked the City Manager and the
City Attorney to find solutions to the obstruction caused by commercial
vehicles on the City's primary streets. The flow of traffic is generally
obstructed from l63rd Street to 178 Street during the peak hours.
Based on communications with Florida Department of Transportation
("FDOT"), the City has been provided with the authority to strictly.enforce
the state traffic obstruction statutes relating to Collins Avenue and Sunny
Isles Boulevard. Simply put, the City has the authority to issue tickets to
commercial vehicles, which block the flow of traffic on Collins Avenue and
Sunny Isles Boulevard. As such, I am asking the City Commission to approve
this Resolution to authorize the City Manager or designee to strictly enforce
the State of Florida traffic obstruction statutes relating to Collins Avenue and
Sunny Isles Boulevard based on guidance provided by FDOT.
