HomeMy WebLinkAboutOrdinance 2015-445 ORDINANCE NO. 2015 - Y q -rj AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 171 ("HISTORIC LANDMARKS") OF THE CODE OF ORDINANCES TO PROVIDE A DEFINITION OF "OBJECTS"; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of Chapter 171 ("Historic Landmarks") of the Code of Ordinances of the City of Sunny Isles Beach ("City Code") is to create a Historic Preservation Board to advise the City Commission on historic landmark designation and regulation; and WHEREAS. Chapter 171 of the City Code vests the Historic Preservation Board with authority to recommend that certain properties be designated as historic landmarks with the consent of the City Commission; and WHEREAS. Chapter 171 of the City Code provides specific definitions of a "historic landmark" or "historic landmark district" that may be recommended for historic site designation by the Historic Preservation Board; and WHEREAS. Chapter 171 does not specifically define "objects" located within the City that may be recommended for historic designation; and WHEREAS, the Historic Preservation Board has recommended to the City Commission that Chapter 171 of the City Code be amended to include a specific definition of"objects". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing, "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 171 of the City Code is amended to read as follows: § 171-1. — Definitions. The following words and phrases, when used in this chapter shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning: Words added underlined,words;triciczn deleted(ed) HISTORIC LANDMARK — Any site, building, structure, landscape feature, improvement, object. or archeological site. which property has been designated as an historic landmark pursuant to procedures described in this chapter. OBJECT(S) – The term `object" is used to distinguish from buildings and structures those constructions that are primarily artistic in nature or are relatively small in scale and simply constructed. Although it may be. by nature or design, movable. an object is associated with a specific setting or environment. § 171-3. – Powers and duties of Board. The Historic Preservation Board shall have the following enumerated powers and duties: C. Recommend to the City Commission properties for designation as historic landmarks and or historic landmark districts; in order to regulate and administer those properties. as historic landmarks and historic landmark districts. § 171-4. – Procedures for designation. Properties which meet the criteria set forth in § .171-5 hereinbelow may be designated as archaeological historic landmarks or historic landmark districts or historical sites in accordance with the following procedures: A. Proposals. Proposals for designation may be made by the owner, the Board, and City Commission and shall include but not be limited to the legal description: of the site, photographs: of the site, a statement of significance and other information supporting the proposal. B. Designation report. For every proposed historic landmark or historic landmark district, cite, the City Manager or his designee shall prepare a designation report containing the following information: (1) Statement of significance. A statement outlining the significance of the proposed site. historic landmark or historic landmark district; the criteria upon which the designation is based and a physical description of the property. (2) Boundaries. A map or maps indicating proposed boundaries. Archaeological site boundaries shall generally conform to natural physiographic features which were the focal points for prehistoric and historic activities or may be drawn along property lines, streets, or geographic features to facilitate efficient management. The designation report shall also contain a recommendation on whether the Board should designate the property as an archaeological sitc historic landmark or historic landmark district. C. Consideration by Board. The Board shall conduct a public meeting to determine whether the proposed archaeological site historic landmark or historic landmark district meets the criteria outlined herein for the purpose of considering all proposed designations and shall approve, approve with conditions, amend or deny the proposed designation. § 171-5. — Standards for designation of d' historic landmarks and historic landmark districts. Properties may be designated as historic landmarks or historic landmark districts only if they have significance in the archaeological or historical heritage of the area, state, or nation; and meet one or more of the following criteria: A. Are associated in a significant way with the life of a person important in the past; or B. Are the site of an historic event with significant effect upon the community, City, state, or nation; or C. Exemplify the historical, cultural, political, economic, or social trends of the community; or D. Have yielded, or are likely to yield, information important in prehistory or history; or E. Contain any subsurface remains of historical or archaeological importance or any unusual ground formations of archaeological significance,=er . - Master Site File. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any pan. Section 4. Inclusion In The Code. REASONS Chapter 171 of the City Code vests the City's Historic Preservation Board with authority to recommend to the City Commission that certain properties be desienated as historic landmarks with the consent of the City Commission. Chapter 171 of the City Code includes specific definitions for a `historic landmark" or "historic landmark district" that may be recommended for historic site designation. Over the years, the City has collected numerous historic objects from hotels located on motel row. These objects include the horse and carriage located at Margolis Park. The City's Historic Presen'ation Board is seeking to designate the objects collected as historic. In order to begin this formal designation process, it is necessary that Chapter 171 of the City Code be amended to include a specific definition of"objects". The attached proposed Ordinance defines "objects" based on language from the Code of Federal Regulations. Examples of an "object" include boundary marker, monument, milepost, fountain, sculpture, and statuary.
