A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, RECOMMENDING
TO THE CITY COMMISSION OF SUNNY ISLES BEACH' FOR
APPROVAL THE ORDINANCE AMENDING CHAPTER 265
"ZONING" SECTION 265-35D(4)(C) TO PROVIDE AN OPTION
FOR DESIGN FLEXIBILITY FOR LOTS WITH FRONTAGE 200
FEET OR MORE IN WIDTH; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission, serving as the Local Planning Agency ("LPA"),
conducted a public hearing relating to the Land Development Regulations on December 10, 2002
and adopted the Land Development Regulations by Ordinance No. 2002-165; and
WHEREAS. the City Commission, as the LPA, has reviewed the amendment to Section
265-35D(4)(C) of the Land Development Regulations providing an option for design flexibility
for lots with frontage 200 feet or more in width; and
WHEREAS, the LPA has detemnined that it is in the best interest of the City and its
residents to recommend approval of the Ordinance amending Section 265-35D(4)(C) of the Land
Development Regulations.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA AS FOLLOWS:
Section 1. Recommendation: That the Local Planning Agency hereby recommends to the City
Commission of the City of Sunny Isles Beach, the Ordinance amending Section 265-35D(4)(C) of
the Land Development Regulations providing an option for design flexibility for lots with
frontage 200 feet or more in width, for approval by the City Commission pursuant to Chapter 163,
Florida Statutes.
Section 2. Effective Date: This Resolution shall take effect immediately upon adoption.

A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, RECOMMENDING
TO THE CITY COMMISSION OF SUNNY ISLES BEACH FOR
APPROVAL THE ORDINANCE AMENDING SECTION 265-5 OF
THE CITY CODE ENTITLED "DEFINITIONS" TO INCLUDE
PUBLIC PARKS MANAGED BY MIAMI-DADE COUNTY AND
THE STATE OF FLORIDA IN THE DEFINITION OF PUBLIC
PARKS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission, serving as the Local Planning Agency ('LPA"),
conducted a public hearing relating to the Land Development Regulations on December 10, 2002
and adopted the Land Development Regulations by Ordinance No. 2002-165; and
WHEREAS. the City Commission, as the LPA. has reviewed the amendment to Section
265-5 of the Land Development Regulations entitled "Definitions" to include public parks
managed by Miami-Dade County and the State of Florida in the definition of public parks; and

Development Regulations.

Commission pursuant to Chapter 163, Florida Statutes.
Section 2. Effective Date: This Resolution shall take effect immediately upon adoption.
