A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, DIRECTING THE ZONING
ADMINISTRATOR TO ADMINISTRATIVELY CLOSE OUT A
PRIVATE TRANSFER OF DEVELOPMENT RIGHTS ("TDRs")
BANK ACCOUNT OF DEZER DEVELOPMENT LLC; AND TO
DEPOSIT UNASSIGNED TDRs TO THE CITY BANK ACCOUNT
IN THE AMOUNT OF THIRTY THREE THOUSAND SEVEN
HUNDRED FIFTY (33,750) TRANSFER OF DEVELOPMENT
RIGHTS ("TDRS") AND SIXTEEN (16) DWELLING UNITS ;
PROVIDING THE CITY MANAGER AND CITY ATTORNEY
WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO
EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission directed the Zoning Administrator to create a Private
Transfer of Development Rights ("TDRs") Bank account for Dezer Development, LLC ("Dezer")
pursuant to Resolution No. 2013-2130 adopted on October 17, 2013 as part of a site plan approval
pursuant to Zoning Resolution No. 13-Z-138 adopted on October 17, 2013; and
WHEREAS,the City Commission wishes to administratively close out the Dezer's Private
TDR Bank account of 33,750 square feet of floor area and sixteen (16) dwelling units; and
WHEREAS, the City Commission wishes to deposit the unassigned TDRs in the amount
of 33,750 square feet of floor area and sixteen(16)dwelling units into the City TDRs bank account.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are
incorporated herein by reference as if they are fully set forth herein.
Section 2. Directing the Zoning Administrator to administratively close out a Private TDR
Bank account. The City Commission hereby directs the Zoning Administrator to administratively
close out a private Transfer of Development Rights ("TDRs") Bank account for Dezer
Development, LLC.
Section 3. Directing the Zoning Administrator to Deposit the TDRs. The City Commission
hereby directs the Zoning Administrator to deposit into the City's TDR Bank the unassigned TDRs
in the amount of 33,750 square feet of floor area and sixteen (16) dwelling units.
Section 4. Authority of the City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution shall become effective upon adoption.

RE: Close out of Private Transfer Development Rights for
Dezer Development, LLC.
RECOMMENDATION:
The attached Resolution is presented for your consideration.
REASONS:
Pursuant to Resolution No. 2013-2130 adopted on October 17, 2013,
the City Commission directed the Zoning Administrator to create a
private sub-bank account in favor of Dezer Development, LLC
("Dezer") in accordance to a site plan approval pursuant to Zoning
Resolution No. 13-Z-138 adopted on October 17, 2013 also known as
the Dezer Office Tower ("Office Project") proposed at 18080 Collins
Avenue. Staff is requesting to close the private sub-account and
deposit the Transfer Development Rights ("TDRs") in the amount of
33,750 square feet of floor area and sixteen(16)dwelling units into the
City's TDRs Bank account as the Office Tower will not be developed
according to the abovementioned site plan approval.
