A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING A
REQUEST SUBMITTED BY SUNNY ISLES BEACH
FOUNDATION TO APPROVE THE TEMPORARY USE OF A
WALL TO CREATE AN "ART WALL" LOCATED AT THE
WEST SIDE OF THE 18090-18230 COLLINS AVENUE RK
SHOPPING CENTER; PROVIDING THE CITY MANAGER AND
CITY ATTORNEY WITH THE AUTHORITY TO DO ALL
THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Sunny Isles Beach Foundation ("SIB Foundation") is presenting its first
proposed art project to create an"Art Wall"with local students talents right in front of the Norman
S. Edelcup K-8 School; and
WHEREAS, the SIB Foundation is requesting to temporarily use the west wall of the RK
Shopping Center located at 18090-18230 Collins Avenue; and
WHEREAS, the City Commission wishes to approve the proposed temporary use of the
wall to create an "Art Wall".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are
incorporated herein by reference as if they are fully set forth herein.
Section 2. Approval. Pursuant to Section 265-14 of the Code of Sunny Isles Beach, the City
Commission hereby approves the temporary use application submitted by the Applicant, subject to
the conditions set forth herein.
Section 3. Conditions of Approval. The Applicant is required to comply with the following
conditions:
1. That the temporary use of the wall is approved for one year from the date of the issuance
of a building permit for the installation of the proposed graphics, attached as "Exhibit
A";
2. That the Applicant shall restore the wall to its original characteristics after the expiration
of the temporary use approval;
3. That it shall be the sole responsibility of the Applicant and/or property owner to restore
the wall to its original characteristics;

4. The Art Wall shall to be properly maintained and secured at all times.
Section 4. Authority of the City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution shall become effective upon adoption.

The Sunny Isles Beach Foundation is very excited to request approval of its first
proposed project in the City. At the Foundation's first fundraiser, we represented that our first
project would be to locate and create the City's first"art wall."The Foundation Board wanted to
start with something fun and designed to create enthusiasm for art among our kids. With the
gracious donation by Mr. Raanan Katz of the use of up to approximately 700 linear feet of the
exterior perimeter stucco wall located on Atlantic Avenue behind the 183`1 Street Shopping
Center literally across the street from the Norman S. Edelcup K-8 School,the.Foundation would
propose to develop, program and implement a juried art competition among local elementary,
middle and high school students in the Fall. With the City Commission's approval,the winners
of the competition will then see their art work transposed onto this wall by a professional
muralist who will also be selected by other professionals.
In this interim period while the competition is being developed by an experienced project
manager from NYC and until official notice and distribution of the rules is made when school
comes back into session(i.e., beginning in July and through the completion of the competition
and painting of the wall), the Foundation thought we would generate curiosity about what is
happening in this location by the temporary installation depicted in the attached rendering. As
you can see the Foundation's name is not mentioned. Rather, the"incite, inspire and innovate"
tagline along with the Foundation logo is all that the public will see. We want people to say,
"What is this?"The intention is that during this period of time, we introduce the public to the
Foundation, its goals and this specific project through the publication of a newspaper article and
other communications. Hopefully our Commission members also will want to generate
enthusiasm about the prospect of this completion.

We are asking for a favorable review and recommendation by staff and approval by the
City Commission of this Application for temporary use on this Property. Because of the unique
nature of this project,we would request approval for a period of 120-130 days for the attached
rendering and thereafter for the implementation of the mural wall with art selected by the

Temporary Use Approval-Art Wall

RECOMMENDATION:
Staff does not have any objection to the temporary use request of the
wall provided that the conditions set forth are satisfied.
REASONS:
The Applicant is requesting approval for a temporary use of a wall
located along Atlantic Blvd and 1831d Street, specifically, the west wall
of the RK Shopping Center. The wall will be covered with the
proposed graphics for approximately four months and later modify with
the winners of an art competition among local students.
A professional artist will transpose the selected pieces to create the
"Art Wall" on the depicted wall. The art wall will display the work for
approximately 6-8 months. The wall will be restated to its original
characteristics approximately a year after the initial graphics are in
place.
