HomeMy WebLinkAboutReso 2015-2428 RESOLUTION NO. 2015- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A WAIVER OF PLAT APPLICATION FOR THE PROPERTY LOCATED AT 151-287 SUNNY ISLES BOULEVARD COMMONLY KNOWN AS "GATEWAY PARK PROVIDING THE CITY MANAGER AND THE CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach has applied for a Waiver of Plat application in order to sub-divide multiple parcels of land into two parcels, as more fully described in Exhibit"A" herein, and WHEREAS, the City Commission has determined that the Waiver of Plat is necessary for the operation of the Gateway Park property as described in Exhibit "A" and meets all the requirements of Chapter 28 of the Code of Ordinances of Miami Dade County. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they fully set forth herein. Section 2. Approval of Waiver of Plat. The City Commission hereby approves the Waiver of Plat application for Gateway Park. The approval of the Waiver of Plat is not a waiver of any zoning regulations and this approval is conditioned upon proper execution of all documents required by the City Attorney's office, and any other reviewing agency. Section 3. Authority of City Manager and City Attorney. The City Manager and the City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Russo,City Manager FROM: Claudia Hasbun, Planning and Zoning Administrator DATE: 6/18/2015 RE: Waiver of Plat for Gateway Park RECOMMENDATION: Staff is recommending City Commission approval of the Resolution. REASONS: The City of Sunny Isles Beach is the property owner of certain land located at 151-287 Sunny Isles Boulevard a/k/a Gateway Park. Staff is requesting a Waiver of Plat approval for the purpose of subdividing the actual tracts into two Parcels; one parcel allocating the park premises and the other parcel for the parking garage building. This subdivision is required for property tax purposes to ensure that the tax exemption is maintained for the public park area.
