AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 172
("HUMAN RELATIONS") OF THE CODE OF ORDINANCES TO
PROHIBIT DISCRIMINATION AGAINST PERSONS BASED ON
GENDER IDENTITY OR GENDER EXPRESSION; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the purpose of Chapter 172 ("Human Relations") of the Code of Ordinances
of the City of Sunny Isles Beach is to recognize the changing needs of society and to treat all
persons fairly and equitably; and
WHEREAS, the City Commission recognizes the importance of providing equal
protection to persons which includes gender identity and gender expression; and
WHEREAS, there are very few legal non-discrimination protections afforded to persons
based on gender identity or gender expression under federal or state law; and
WHEREAS, notwithstanding this lack of inclusion in anti-discrimination laws, there are
currently over twenty five (25) Florida counties and cities, including Miami-Dade County and
Miami Beach, that extend legal protections to persons based on gender identity or gender
expression; and
WHEREAS,the City Commission wishes to strengthen its anti-discrimination protections
to prohibit discrimination against persons based on gender identity or gender expression.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part of this
Ordinance upon additions hereof.
Section 2. Amendment. Chapter 172 of the City Code is amended to read as follows:
§ 172-2. —Definitions.
For the purpose of this article:
C. Discrimination shall mean any difference. distinction or preference in treatment. access
or impact against any person based on their gender identity or gender expression.
D. Gender identity shall mean a person's innate. deeply felt psychological identification as
a man. woman or some other tender. which may or may not correspond to the sex
assigned to them at birth (e.e. the sex listed on their birth certificate).

E. Gender expression shall mean all of the external characteristics and behaviors that are
socially defined as either masculine or feminine. such as dress, grooming. mannerisms.
speech patterns and social interactions. Social or cultural norms can vary widely and
some characteristics that may be accepted as masculine, feminine or neutral in one
culture may not be assessed similarly in another.
F. City shall mean the City of Sunny Isles Beach.
§ 172-4. —Extension of anti-discrimination protections to persons based on gender identity
or gender expression.
A. It shall be prohibited to discriminate against any person, based on their Render identity
or gender expression, in providing services. programs. or activities offered by the City.
Additionally. it shall be prohibited to discriminate against any person, based on their
gender identity or Render expression. in hiring for employment and the conditions of
employment with the City.
B. The anti-discrimination policies of the City shall provide protections for persons based
on gender identity or Render expression as provided by law. A person who has declared
a transgender identity shall be entitled to any benefits provided by the City under its
policies provided that the person is eligible for such benefits.
C. Notwithstanding any provision in this Chapter.the City has the right to provide services.
programs, or activities. and administer its employment practices. based on bonafide.
non-discriminatory business decisions.
§ 172- 45. —Charitable Donations.
A. Financial Donations. Cash donations to charitable organizations must be approved by
the affirmative votes of at least four members of the City Commission at a public
meeting.
B. In-Kind services and Use of Facilities. In-kind services and use of the City's
governmental facilities by charitable organizations must be approved by the affirmative
votes of at least four members of the City Commission at a public meeting.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code.It is the intention of the City Commission, and it is hereby
ordained, that provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may
be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same
are hereby repealed.

Section 6. Effective Date. The Ordinance shall be effective after adoption on second reading.

RECOMMENDATION
It is recommended that the City Commission approve the proposed Ordinance amending Chapter
172 of the City Code.
REASONS
The purpose of Chapter 172 ("Human Relations") of the Code of Ordinances of the City of
Sunny Isles Beach is to recognize the changing needs of society and to treat all persons fairly and
equitably. Currently, there are very few legal non-discrimination protections afforded to persons
based on gender identity or gender expression under federal or state law. Notwithstanding this
lack of inclusion in anti-discrimination laws, there are currently over twenty five (25) Florida
counties and cities, including Miami-Dade County and Miami Beach, that extend legal
protections to persons based on gender identity or gender expression, which includes
transgendered individuals.
The City wishes to strengthen its anti-discrimination protections to prohibit discrimination
against persons based on gender identity or gender expression. More precisely, the City wishes
to prohibit discrimination against any person, based on their gender identity or gender
expression, in providing services. programs. or activities offered by the City. Additionally, the
City wishes to prohibit the discrimination against any person, based on their gender identity or
gender expression, in the conditions of employment with the City. Notwithstanding the
foregoing, the City reserves the right to provide services, programs, or activities, and administer
its employment practices, based on bonafide, non-discriminatory business decisions.
