ORDINANCE NO. 2015- 1457 AN ORDINANCE OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 62 OF THE CODE OF ORDINANCES TO CLARIFY THAT PURCHASES LESS THAN $50,000.00 MAY BE MADE, OR ENTERED INTO, BY THE CITY MANAGER WITHOUT SUBMITTAL TO THE CITY COMMISSION, BUT SHALL OTHERWISE REQUIRE COMPLIANCE WITH THE COMPETITIVE BIDDING REQUIREMENTS SET FORTH IN CHAPTER 62; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEALER OF CONFLICTING PROVISIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of Chapter 62 of the Code of Ordinances of the City of Sunny Isles Beach (the "Procurement Code") is to provide for the fair and equitable treatment of all persons involved in purchasing by the City, to maximize the purchasing value of public funds in procurement, and to provide safeguards for maintaining a procurement system of quality and integrity; and WHEREAS, Chapter 62 applies to all contracts for the procurement of supplies, services and construction entered into by the City; and WHEREAS, Chapter 62 currently requires that the City Commission shall approve all purchases of or contracts for materials, supplies, equipment, public improvements or services where the total amount to be expended is more than $25,000.00; and WHEREAS, the City Commission desires to amend Chapter 62 of the City Code to clarify that purchases less than $50,000.00 may be made by, or enter into, by the City Manager without submittal to the City Commission, but shall otherwise require compliance with the competitive bidding requirements set forth in Chapter 62. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof Section 2. Amendment. Chapter 62 of the City Code is amended to read as follows: § 62-6. Purchasing limitations; effect on competitive bidding requirement. Words added underlined,words stricken deleted(ed) Page I of 4 B. Purchases more than $2,500.00 but less than $25,000.00 $50,000.00. Purchases of, or contracts for, materials, supplies, equipment, improvements or services for which funds are provided in the budget, where the total amount to be expended is in excess of $2,500.00, but which do not exceed X000.00 $50,000.00 may be made, or entered into, by the City Manager without submittal to the City Commission, but shall require compliance with the informal competitive bidding requirements set forth in § 62-6 and 62-7 of this chapter. Single purchases or contracts in excess of $25,000.00 $50,000.00 shall not be broken down to amounts less than $25,000.00 $50,000.00 to avoid the requirements of this section. C. Purchases in excess of$2 000.00 $50,000.00. The City Commission shall approve all purchases of or contracts for materials, supplies, equipment, public improvements of services where the total amount to be expended is more than $25,000.00 $50,000.00. Notwithstanding this provision, purchases in excess of$25,000.00 $50,000.00 for utilities shall be administratively approved in the adopted fiscal year budget and are not subject to the requirements of Chapter 62 of the Code unless required by the City Commission. For purposes of this exemption, the term "utilities" shall include electrical, water, natural gas (excluding fuel/diesel purchases), sewage and solid waste collection, and telecommunication services including but not limited to cable television, telephone lines, internet connectivity, data and voice circuits, voice over internet protocol ("VOIP"), cellular/wireless phones, wide area network ("WAN") connectivity, pagers, and wireless adapters for cellular data ("air cards"). D. Purchases in excess of $25,000.00 $50,000.00. For purchases in excess of U-54)00410 $50,000.00 the City Commission shall follow the formal provisions contained in §62-7 below. § 62-7. Competitive bidding procedure. A. Purchases under$ 000-00 $50,000.00. (1) Whenever competitive bidding is required by this chapter, the City Manager shall direct that bid proposals which provide specifications for the purchase or contract be prepared. (2) The City Manager shall solicit bids from at least three persons or entities engaged in the business of furnishing such materials, supplies, equipment and public improvements or rendering such services. (3) The City Manager may publish a public invitation to bid items under $ 000.00 $50,000.00. B. Purchases over $257000,00 $50,000.00. Bids for purchases over $25,000.00 $50,000.00 shall be awarded to the lowest responsible and responsive bidder whose bid best serves the interests of and represents the best value to the City, in conformity with the criteria set forth in §62-8 of the City Code. Price is only a factor in determining the lowest responsible responsive bidder. For purposes of this section, the term "lowest responsible and responsive bidder" is not the bidder with the lowest dollars and cents bid. The City Manager or the City Commission may select a bidder whose bid is not the lowest dollars Words added underlined,words stricken deleted(ed) Page 2 of 4 and cents bid if the award is based on the criteria set forth in §62-8 of the City Code. These additional requirements shall pertain: (1) Conditions for use. All contracts with the City in amounts over $25,000.00 $50,000.00 shall be awarded by competitive sealed bidding except as otherwise provided in §62-13, or as otherwise approved by the City Commission. § 62-13. Exemptions from competitive bidding. The following shall be exempt from the competitive bidding procedures outlined in this chapter. B. Contracts for professional services, except for those contracts of more than $25,000.00 the purchasing category thresholds for professional services governed by F.S. § 287.055 (the Consultants Competitive Negotiations Act). Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed. Section 6. Effective Date. REASONS The purpose of Chapter 62 of the Code of Ordinances of the City of Sunny Isles Beach (the "Procurement Code") is to provide for the fair and equitable treatment of all persons involved in purchasing by the City, to maximize the purchasing value of public funds in procurement, and to provide safeguards for maintaining a procurement system of quality and integrity. Chapter 62 applies to all contracts for the procurement of supplies, services and construction entered into by the City. Chapter 62 currently requires that the City Commission shall approve all purchases of or contracts for materials, supplies, equipment, public improvements or services where the total amount to be expended is more than $25,000.00. The City desires to amend Chapter 62 of the City Code to state that purchases less than $50,000.00 may be made by, or enter into, by the City Manager without submittal to the City Commission,but shall otherwise require compliance with the competitive bidding requirements set forth in Chapter 62. This increased spending limitation is in conformity with neighboring municipalities that authorize expenditures up to $50,000.00 without City Commission approval. •
