AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING
SECTION 265-5 OF THE CITY CODE ENTITLED
"DEFINITIONS" TO CLARIFY THE MEANING OF
HEIGHT ; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF CONFLICTING PROVISIONS;
PROVIDING FOR INCLUSION IN THE CODE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 265-5 of the City Code provides for definitions that are used to
interpret the Land Development Regulations; and
WHEREAS, the City Commission wishes to clarify the term height to ensure that
mechanical equipment on a roof is within the maximum height limits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part of this
Ordinance upon additions hereof.
Section 2. Amendment. Section 265-5 of the City Code entitled "Definitions" is amended to
read as follows:
§ 265-5. - Definitions.
HEIGHT—The vertical distance from the crown of the adjacent road to the highest point
of the structure being measured, inclusive of all structures and equipment, or to the roof

. . . - : .: . In addition: chimneys shall be permitted to extend three
feet above the highest point of the roof where it passes through the roof or three feet above
the roof if the roof is flat; parapet walls and railings constructed on buildings with flat roofs
shall be permitted to extend not higher than forty-two inches three feet above the roof;
steeples shall be permitted to extend above the roof, not higher than forty-two inches.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,

clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code.It is the intention of the City Commission, and it is hereby
ordained, that provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may
be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same
are hereby repealed.
Section 6. Effective Date. The Ordinance shall be effective after adoption on second reading.

RE: Ordinance Amending Section 265-5 of the City Code to Clarify the Definition of
Height
RECOMMENDATION
The attached ordinance is presented for your consideration.
REASONS
The purpose of this Ordinance is to clarify the definition of the term height to ensure that the
maximum height limit is not exceeded by mechanical equipment's. Moreover, the height of a
parapet wall is clarified to ensure compliance with the Florida Building Code.

This Ordinance was requested by the Zoning Administrator via the Office of the City Manager.
