City Commission Workshop Meeting
Wednesday, October 9, 2002, 7:30 p.m.
CITY OF SUNNY ISLES BEACH, FLORIDA

AGENDA
1. CALL TO ORDER/ROLL CALL OF MEMBERS
The meeting was called to order by Mayor Samson at 7:30 p.m., with the following
officials present:
Mayor David Samson
Vice Mayor Danny Iglesias
Commissioner Norman S. Edelcup
Commissioner Gerry Goodman
Commissioner Lila Kauffman
City Manager Christopher J. Russo
City Clerk Richard Brown-Morilla
Deputy City Attorney Hans Ottinot
INTRODUCTIONS:
Mayor Samson called upon Vice Mayor Iglesias to lead everyone in the pledge of
allegiance to the flag. He then read an introductory statement on decorum.
He also announced that the polling place for the residents of Winston Towers had been
changed to the 400 Building for the November election.
Mayor Samson then introduced Shelley Eichner, City Planning Consultant, and Vice
President of Calvin Giordano and Assoc.

2. Synopsis of LDR's Workshops: i
Ms. Eichner quickly reviewed some of the prior discussion from the previous workshops
held on the proposed LDR's; and reviewed the synopsis that was done by Jorge Vera,
Zoning Director. Mr. Vera also referred to the memo from Ms. Eichner dated October 8;
2002, on modifications to the draft LDR's.
A. Chapter 1 — Purpose and Applicability:
Vested Rights: Diana Grub-Frieser explained that there would not be a
requirement to apply for vested rights if they meet certain specified criteria.

B. Chapter 2 —Definitions and Rules of Construction:
See October 2, 2002 synopsis memo.
C. Chapter 3 — Decision Making and Administrative Bodies:
See October 2, 2002 synopsis memo.
D. Chapter 4 — Comprehensive Plan:
See October 2, 2002 synopsis memo.
E. Chapter 5—Development Reviews Procedures:
There will no longer be administrative variances, except for single family homes.
Need to add the color code into the LDR's.
Mayor Samson said that all changes to previously approved development
approvals must come before the City Commission, may no longer receive staff
approval.
Transfer of Development Rights (TDR's): all of section 515 has been changed,
see manual of draft LDR's.
Valuation of TDR's see new appraisal process same as if the City were buying
Land.
F. Chapter 6 — Archeological and Historical Landmarks:
Removed from LDR's at this time. i
C. Chapter 7—Zoning Categories:
Conservation District uses are now conditional uses, not permitted.

Recreational Open Space See October 2, 2002 synopsis memo.
Single family residence (R-1) See October 2, 2002 synopsis memo. Minimum
square feet of 7500 sq. ft
Moderate Density Townhouse Residential (R-TH) See October 2, 2002 synopsis
memo.
Medium Density Multifamily Residential (RMF-1) no modifications were done
to this section
Medium High Multifamily Residential (RMF-2) See October 2, 2002 synopsis
memo. Mayor Samson said the wanted the Code worded to require that all
parking garages be required to be camouflaged so as to not look like parking
garages.

Mix Use—Resort District (MU-R)
See October 2, 2002 synopsis memo. Vice Mayor Iglesias said there was a
mistake in deleting on page 700-27, and need grammar correction on same page
add words: "not to" exceed...
In southern part of City the east side of Collins Avenue is more narrow than
elsewhere in the City. See page 700-28 need to correct, delete #2 for all
buildings.
Beach access may be waived by the City Commission.
See item 11 regarding parking garages within the VE flood zone: south of 163rd
Street.
Neighborhood Business District (B-1):
From 174th to 185th Streets to Atlantic Boulevard
Community Business District (B-2): See October 2, 2002 synopsis memo.
Mayor Samson asked for 3511 set back with 10 feet to the City and for every foot
setback the developer could build an additional 3 feet of height. Deputy City
Attorney Hans Ottinot said that the City could not regulate ai taking of the land,
except through the use of eminent domain proceedings.
H. Chapter 8— Office Street Parking:

I. Chapter 9 — Sign Regulations:
See October 2, 2002 synopsis memo.
J. Chapter 10 — Landscaping Requirements:
No modifications, except that only the City Commission can approve differences.
K. Chapter 11 — Development Standards:
No modifications, except that only the City Commission can approve differences.
L. Chapter 12 —Non-Conforming Uses and Structures:
Alcohol sections will be added in, as will dock construction.

3. Schedule for Next Workshop:
It was agreed to schedule the next Workshop meeting for Thursday,',October 24, 2002
at 7:30 p.m.
The first reading public hearing, as a joint meeting of the LPA and the City
Commission, was tentatively scheduled for Thursday, November 7, 2002 at 7:00 p.m.
The second reading public hearing, as a joint meeting of the LPA and the City
Commission, was tentatively scheduled for Wednesday, November 20, 2002 at 7:00
p.m.
The meeting ended at 9:30 p.m.
