ORDINANCE NO. 2015 - to AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265 "ZONING" SECTION 265-18 OF THE CITY CODE TO REQUIRE SUBMISSION OF A STAGING PLAN FOR DEMOLITION AND CONSTRUCTION OF THE DEVELOPMENT PROJECTIIAS A REQUIREMENT OF THE SITE PLAN APPLICATION PROCESS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS. the City Commission wishes to amend Section 265-18 of the City Code to require the submission of a staging plan for demolition and construction of the development project as a requirement of the site plan application process; and WHEREAS, the City Commission, acting as the City Local Planning Agency, pursuant to Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed amendment to the City land development regulations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 265-18 of the City Code is amended to read as follows: § 265-18. —Administrative site plan review. E. Site plan submission requirements. An application for site plan review shall include 15 sets of folded and collated plans containing the following: (3) Site development plans (Scale to be one inch equals 20 feet unless prior approval is received otherwise) shall include in proper form, detail, dimension and scale, the following: (s) Estimated construction cost of the entire development project (t) Artwork appraised value. 1 (u) Staeing plan for the demolition and construction of the entire development project inclusive of demolition and construction of sales center. The staging planlshall include all requests that may require governmental approvals including but not limited td extended work hours. closure of beach access. and construction parking. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason beheld to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion In The Code. It is the intention of the City Commission. and it is hereby ordained that the provisions of this Ordinance shall become and made a pan oflthe City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered for re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to`"Section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed Section 6. Effective Date. REASONS As part of the site plan review process, the City Commission wishes to require an applicant to submit a 3-D Model of the proposed development project and a staging plan ifor the demolition and construction of the entire development project inclusive of the sales center( More precisely, the applicant is required to provide detailed information in its staging plan regarding additional governmental approvals. I The 3-D Model provision in the amendatory Ordinance was requested by Commission Levin whereas the construction staging provision was requested by Vice Mayor Gatto. I ■
