CALL TO ORDER BY CHAIRPERSON: Action: Chairperson Dione Del Monico called the meeting to order at 6:03 p.m. The following Committee Members and City Officials were present: Committee Members: City Officials: Dione E. SELF INTRODUCTIONS: Action: Chairperson Del Monico thanked everyone for attending this third meeting of the Historic Preservation Board and City Clerk Hines called the roll. Chairperson Del Monico welcomed the new members, Trina Duluc and Bonita Shoki; and members introduced themselves. [Note: There was no quorum at the last meeting of December 20, 2004]. Chairperson Del Monico asked Acting City Attorney Wright to present to the Board at the next meeting: • the State attendance requirements for maintaining membership on the Board; • quorum requirements; • voting requirements; • how many times a year must the Board meet; and • the Sunshine Law. 3. APPROVAL OF MINUTES FOR THE JULY 26, 2004 HISTORIC PRESERVATION BOARD MEETING: Action: Casey Gabor made a correction under#3, names of members moving and seconding the motion, and City Clerk Hines said she would correct it. Phillip Chernoff said that he had a change on page 4 the last paragraph before #8 because he did not remember reading an Summary Minutes 2005-0606 HPB Mtg Page 11 of 5 excerpt from a newspaper, and City Clerk Hines said she would check it and make the corrections. Joe Masters moved and Casey Gabor seconded a motion to approve the July 26, 2004 Committee meeting summary minutes, as amended. The motion was approved by a 6-0-1 voice vote (Michelle D'Arbelles absent). Chairperson Del Monico asked the Board what is the best time to meet and it was determined to meet on Mondays, Tuesdays, or Wednesdays at 6:00 p.m. Chairperson Del Monico nominated Joe Masters as Vice-Chairman. Trina Duluc moved and Bonita Shoki seconded a motion to approve Joe Masters as Vice-Chairman. The motion was approved by a 6-0-1 voice vote (Michelle D'Arbelles absent): 4. DISCUSSION REGARDING THE BOARD'S MISSION STATEMENT:, Action: Chairperson Del Monico asked Richard Schulman, the Board's Liaison, to read the Mission Statement for the benefit of the new members. Mr. Schulman reported that the approved Mission Statement reads as follows: "The Mission of the Sunny Isles Beach Historic Preservation Board,"is: To Designate, Preserve, Protect and Maintain Historic Buildings, Areas or Sites as a Source of History and Heritage in the City of Sunny Isle's Florida." i 5. PRESENTATION OF FOUR (4) REDEDICATED HISTORIC SITES INISUNNY ISLES BEACH FOR BOARD APPROVAL. Action: Chairperson Del Monico asked if everyone had a copy of the'memo that Deputy City Attorney Hans Ottinot had written, dated July 12, 2004, and asked City Clerk to get copies to members that did not have a copy. Chairperson Del Monico noted that this Board sits in a quasi-judicial capacity and discussed the designation standards and processes as delineated in Ordinance No. 2004-197 and in Deputy City Attorney Ottinot's outline in the memo. She read Section 5 from Ordinance No. 2004-197, Standards for Designation of Archeological and Historic Landmarks. "Properties may be designated as archaeological sites only if they have significance in the archaeological heritage of the area, state, or nation;and meet one or more of the following criteria: (a) Are associated in a significant way with the life of a person important in the past; or (b) Are the site of a historic event with significant effect upon the community, city state, or nation; or (c) Exemplify the historical, cultural, political, economic, or social trends of the community; or (d) Have yielded, or are likely to yield, information important in prehistory or history; or (e) Contain any subsurface remains of historical or archaeological importance or any unusual ground formations of archaeological significance; or (f) Are designated in the City of Sunny Isles Beach Comprehensive Plan/or Florida Master Site File." Chairperson Del Monico asked what the Florida Master Site File was, and Mr. Schulman said that it referred to the Miami-Dade County files. Summary Minutes 2005-0606 HPB Mtg Page 2 of 5 Chairperson Del Monico explained the process: • It starts with a proposal from the property owner, the Board, or the City Commission; • Designation Report; • Public Hearing notice requirement; • Personal notice, which means that every property that is up for consideration has to be notified personally, and she asked if we complied with that because she did not get noticed on her property. Acting City Attorney Wright said it is not required to personally notify, and Chairperson Del Monico said it was stated in Deputy City Attorney's memo. Acting City Attorney Wright said it is not in the Ordinance and that he may have been looking at some other provisions such as State Code but that it is always a good idea to personally notify the homeowner. Mayor Edelcup said that these sites were already designated by the County. Chairperson Del Monico requested that "personal notice" be left in. • Public Hearing to approve or reject by resolution; and • Place it on the agenda for the City Commission for their consideration. Richard Schulman reported and presented renderings of the sites, and said that they are ready for re-dedication by this Board, and if approved, he would make the presentation to the City Commission on July 14, 2005. The following Resolutions were considered by the Board: 5A. A Resolution of the Historic Preservation Board of the City of Sunny Isles Beach, Florida, Recommending to the City Commission the Re-Designation of the Atlantic Isles Entrance Bridge and the Atlantic Isles Lake Bridge as Individual Historic Sites; Providing for an Effective Date. Action: Phillip Chernoff moved and Hassida Gabor seconded a motion to approve the resolution, and place it on the July 14, 2005 City Commission meeting agenda. HPB Resolution No. 2005-01 was adopted by a voice vote of 6-04 in favor (Michelle D'Arbelles absent). 5B. A Resolution of the Historic Preservation Board of the City of Sunny Isles Beach, Florida, Recommending to the City Commission the Re-Designation of the Water Court Villa and Pergola, Located at 334 Atlantic Avenue, Sunny Isles Beach, Florida,as an Individual Historic Site; Providing for an Effective Date. Action: Phillip Chernoff moved and Bonita Shoki seconded a motion to approve the resolution, and place it on the July 14, 2005 City Commission meeting agenda. HPB Resolution No. 2005-02 was adopted by a voice vote of 6-0-1 in favor (Michelle D'Arbelles absent). 5C. A Resolution of the Historic Preservation Board of the City of Sunny Isles Beach, Florida, Recommending to the City Commission the Re-Designation of the Sunny Isles Beach Pier, Located at 16701 Collins Avenue, as an Individual Historic',Sites; Providing for an Effective Date. Action: Phillip Chernoff moved and Bonita Shoki seconded a motion to approve the resolution, and place it on the July 14, 2005 City Commission meeting agenda. HPB Resolution No. 2005-03 was adopted by a voice vote of 6-0-1 in favor (Michelle D'Arbelles absent). Summary Minutes 2005-0606 HPB Mtg Page 3 of 5 6. DISCUSSION ON PLAQUES TO BE PLACED AT HISTORIC SITES. Action: Chairperson Del Monico said that she would like to recommend that they form a committee of two to three members, to investigate appropriate sites and wording of plaques for the designated sites and to present their findings at the next scheduled Board meeting. Joe Masters and Tuna Duluc volunteered to be on the committee. Chairperson Del Monico said that the committee's purview would be to present a design; material; research wording; a format for public places vs. private places; significance and appropriateness of plaques; take photos for placements. Hassida Gabor asked about lighting for the plaques. Richard Schulman will take the pictures. • Commissioner Goodman asked what the restrictions would be once a site has been designated, can it be renovated, and Chairperson Del Monico said it is set forth in Ordinance No. 2004-197. She said when someone goes to the City to get a permit, if it is a historically designated spot it is red-tagged in the system, therefore, they are presented with an additional set of paperwork for compliance which requires them to come in front!of this Board and get a Certificate of Appropriateness, and that anything can be repaired and certain modifications can be made, the law does allow for renovation, restoration, certain modifications that honor the historic significance. Acting City Attorney Wright reminded the members that a notice of their meetings/tour would have to be given to the City Clerk for placement'in the newspaper. 7. NEW BUSINESS: Action: • Historic Standards Booklet. Chairperson Del Monico noted that. at the July 26, 2004 meeting, it was requested that members get a copy of the Secretary of the Interior Historic Standards Booklet which answers all those types of questions on renovations, modifications, etc. City Clerk Hines said she would get them. • Future Site Criteria: Chairperson Del Monico said that the discussion tonight will give everyone something to think about for the next meeting to come forward with their ideas for future sites. Hassida Gabor suggested the Rascal House Sign, and Chairperson Del Monico noted that they had determined that the Sign, along with the carriage and the horse, are more in the purview of a museum and City historian properties than they are Historic Preservation Board properties. Ms. Gabor noted in the last minutes that this was brought up. Chairperson Del Monico said that she thinks the;Board needs an Legal Opinion that tells us if items that are signs, memorabilia from Ithe front of hotels like pelicans, camels, horses and carriages, if that is under the purview of this Board. Richard Schulman said that this is getting us away from our Mission Statement, and Chairperson Del Monico agreed. She said that this comes up at every meeting, are we going to collect memorabilia and designate it as historic, or are we going to focus on structures that are in the City and have historic significance, and she believed that we had come to the conclusion that the memorabilia was more under the Historic Trust. She said if we stick with our Mission Statement that that the Board would only consider structures of historic significance. She said that the Board had determined that they would support the Historic Trust in any way that they could to secure these items and find a place for them, but it is not in the Board's Mission Statement or purview to consider them as historic sites to be designated by this Board. Phillip Chernoff suggested the Lagoon Restaurant because it was built by Al Capone. Joe Masters noted that we do have a lot of artifacts and are hoping that one day there will be a room in City Hall for them. Chairperson Del Monico said that Richard Schulman is a Summary Minutes 2005-0606 HPB Mtg Page 4 of 5 wealth of information as well as Ellen Wynne who has lived here over 50-years and has personal memories of Sunny Isles Beach from its inception and she had created a 45- minute DVD that is here in City Hall, and Richard Schulman said that is correct and that they also have hand-written letters from Ms. Wynne. Chairperson Del Monico also mentioned that there were four major Architects working in this area, Giller, Polevitzky, Schoeppl, and Grossman, and asked for information such as why they are significant. She said that she understands that the University of Miami School of Architecture thinks that Ellen Wynne's home is significant enough that they are replicating it, and if that is the case, maybe we should be preserving it. • Time Capsule: Chairperson Del Monico congratulated Richard Schulman and David Udoff on the wonderful job they did on the City's Time Capsule. 8. DATE AND TIME OF NEXT MEETING. Action: After discussion it was decided not to have another meeting until late August or early September. 9. ADJOURNMENT.
