Call to Order by Chairperson: Action: Vice Chairperson Cassey Gabor called the meeting to order at 7:00 p.m.,and welcomed our newest Board Member Warren Stamm. Each member introduced themselves. Approval of Minutes: June 22, 2010 Historic Preservation Board Meeting. Action: Joe Masters moved and Shari Blank seconded a motion to approve the June 22,2010 Board meeting summary minutes. The motion was approved by a voice vote of 7-0 in favor. 3A.Update/Report on the Reconstruction, Design, and Permitting of the Sunny Isles Beach/Newport Pier. Action: Acting City Manager Jorge Vera reported on the historic Pier noting that we are in the process of mobilization for demolition which will begin next week. The demolition needs to be completed by April 1, 2011 as turtle season begins in April and ends in November. Prior to finishing the demolition on the Pier,we should have the Permit to construct the Pier and we will be able to start that construction on the seaside coming in towards the landside. On the landside we cannot do anything until November due to turtle season. In November we will start putting in the piles and finishing up the slab of the Pier, and then hopefully we will have everything completed by April 2012 with the 5,000 square foot restaurant on top of it. We are trying to get permission from DEP to allow us to do some work during turtle season as long as we are not hitting the sand and not disturbing the turtles. If we get that, we can finish by April 2012, and have this Pier open for the City's 15`h Birthday Celebration. Acting City Manager Vera responded to questions posed by the Board. Currently we are finalizing DEP requirements in order to secure a Permit for construction as we must be in compliance with noise and lighting regulations for the turtles. We should have that by next month, and then we can start construction in April. Everything has been cleared by the Army Agenda 2011-0217 HPB Mtg Page 1 of 4 Corp of Engineers, and we are trying to get as much time as possible during turtle season to allow us to put more piles into the ground and it will give us more time to build the restaurant, and finish it much quicker. As far as construction of the Pier,everything is already approved by the State. The new pilings will be concrete,and regular CBS construction for the restaurant. We have an agreement with the Newport, and there will be some revenues for the Newport but the City has the Lease with the State. 3B. Discussion to Consider Approving an Application for Certificate of Appropriateness to Reconstruct the Sunny Isles Beach/Newport Pier. Action: [City Clerk's Note: The Application for a Certificate of Appropriateness to Construct the Pier was distributed prior to the meeting.] Assistant City Attorney Fernando Amuchastegui asked the City's Consultant Ellen J. Uguccioni to report on approving an Application for Certification of Appropriateness to demolish and reconstruct the Sunny Isles Beach/Newport Pier. Consultant Uguccioni reported that the Pier has been there since 1936, and it has been beaten up by hurricanes and strong wave action as originally the piles and deck were wooden. The Certificate of Appropriateness is required whenever there are changes, demolition, or new construction is proposed for an historic landmark, and it goes to the Historic Preservation Board for approval first. The Application is for demolition and new construction,not rehabilitation for the simple reason for the Pier to withstand time, to be effective and maintained, it will have concrete pilings and slab for a better chance of surviving the elements. It very much resembles the old Pier, and so while not exactly the same, it certainly serves a focal point of Sunny Isles Beach at the Newport as it has in the past. She said we are recommending approval,and she read the recommendation into the record: The new Pier addresses Americans with disabilities accessibility issues, and provides increased public amenities to accommodate local fishing enthusiasts and sightseers from around the world. The Pier will include a restaurant and will be used as a fishing pier,and sightseeing attraction. The new Pier will consist of building materials such as concrete, reinforced steel, and reinforced PVC to ensure its longevity. The completed project will reestablish the Pier as one of the City's main focal points. City Historian Richard C. Schulman noted that the groundbreaking of the Pier took place on Sunday, October 17, 2010. City Clerk Hines read the following Resolution title into the record: A Resolution of the Historic Preservation Board of the City of Sunny Isles Beach, Florida, Approving the Application for Certification of Appropriateness to Demolish and Reconstruct the Sunny Isles Beach Pier, Attached Hereto as Exhibit "A"; Providing for an Effective Date. Shari Blank moved and Warren Stamm seconded a motion to approve the Resolution. HPB Resolution No. 2011-14 was adopted by a voice vote of 7-0 in favor. 4. Annual Report of the Sunny Isles Beach Historic Preservation Board. Action: [City Clerk's Note: The Annual Report was distributed prior to the meeting] City Historian Richard Schulman reported that the Fifth Annual Report was completed and forwarded to County Clerk Harvey Ruvin, and to Chairperson Kathleen Kauffman of the Dade County Preservation Board. He noted that Miami-Dade County requires an annual report from each municipality from their respective Historic Preservation Boards. He pointed out on the cover our newest historic site, Temple B'Nai Zion, and on the back cover is the actual plaque that was designed and is now installed on the Tower portion of the Temple. Agenda 2011-0217 HPB Mtg Page 2 of 4 5. An Update on Temple B'Nai Zion being Designated as an Historic Site. Action: City Historian Richard Schulman reported that after many meetings and discussions,on June 10,2010 the Historic Preservation Board designated Temple B'Nai Zion as an historic site, and the City Commission designated it as our fifth historic site on September 2, 2010. On December 3, 2010, Temple B'Nai Zion was dedicated with a plaque that was installed on the Tower, and the congregation sponsored a luncheon that was attended by about 100 people. City Attorney Hans Ottinot reported that after this Board made the decision to designate the Temple as an historic site and the City Commission affirmed that decision, subsequently the Temple owners filed a federal lawsuit against the City on December 22, 2010. It is a ten-count complaint,essentially claiming that the City violated the Federal Discrimination Act and several Constitutional Rights that belonged to the Temple. He is confident that we will be able to defend the City, and get this lawsuit resolved in favor of the City in the near future' The City's formal response is due next week, and members of the Board can have a copy of that response. Cassey Gabor noted that the roof of the Temple is broken, and Trina Duluc asked if we can create a schedule to check out each historic site to make sure it is properly maintained and in good shape. City Attorney Ottinot said that would be the management's responsibility,which is through Code Enforcement. Acting City Manager Vera said he will follow-up and report back at the next meeting on the condition of the historic sites. 6. Report on 6 Egyptian Plaques from the Dunes Motel to Heritage Park. Action: City Historian Richard Schulman reported that he had recovered six Egyptian Plaques that were part of the motif located in the lobby of the Dunes Motel. Recently we refurbished them,and they will be installed as artifacts and memorabilia in the Heritage Park,and he handed out pictures of the plaques. Acting City Manager Vera said they will be located at the entrance to the new garage at Heritage Park along the northwest side of the parking garage. Trina Duluc asked if they can put an epoxy coating on them to keep them from deteriorating,and Acting City Manager Vera said they are made out of concrete, and so it is just a matter of retouching them with paint, however, he will follow up on that. 7. Old Business. Action: • Horses and Carriage in Gwen Margolis Park: Cassey Gabor said she read the plaque for the horses and carriage, and it was very nice but in the future, she would like to recommend dates be put on the plaques. City Historian Schulman reported that it has already been done. She also noted that it had no lights on, and City Historian Schulman said we had planned some spot lights on the horses and carriage at one time, there is some back lighting but this Board had decided that we would go ahead with some lighting on the horses and carriage and that could be checked out. Trina Duluc has noted when she passes by it from time to time,that people are sitting on the carriage while they are watching their children, perhaps we can put in some chains or signs not to sit on it, • and City Historian Schulman said they had signs up for two or three years but they took those signs down, and people still sit there, and they take pictures of the children sitting there. There is probably not much that we can do about it but they are pretty substantial. Joe Masters said they seem to be in good repair and he thinks it would be nice for them to take pictures of the children on it as long as they are gentle with it. Action: • Video Taping Events in City: Cassey Gabor said she has seen nice events in the City, this week it was the Skate Park Opening, and soon it will be the Heritage Park. They are taking photographs but she suggested to video tape events for historic value. Then in the future a movie can be made, edited with important moments, such as the Temple as an historic site. Former City Commissioner Roslyn Brezin said there is a very accurate accounting of all of these things that City Historian Schulman has kept very carefully in the books he has upstairs that he has kept for years and so if you want to go through it and review all the things you are discussing, it is available. Ms: Gabor said she is speaking of a video/movie of Sunny Isles Beach that can be put on the City's Channel 77. • Any New Historic Sites for Future: Mark Glicksman asked if there were any more historic sites being proposed in the City, and it was noted that there is nothing more at this time but that the Board can continue to look. 9. Date and Time of Next Meeting. Action: After discussion it was decided to schedule the next meeting on Wednesday,July 13, 2011 at 7:00 p.m. 10.
