RECITALS WHEREAS, the Applicant Public Super Markets: Inc. (the "Applicant") is applying for a modification of the approved site plan under Resolution No. 14-Z-141 adopted on July 17. 2014. and has submitted a site plan modification application (Application No. PZ201 5-12) to the City of Sunny Isles Beach. Florida requesting the following: 1. Sunny Isles Beach, FL 33160 FOLIO: 31-2202-003-0201:31-2202-003-0203:31-2202-003-0204 WHEREAS, on July 16, 2015, the City Commission conducted a public hearing on this site plan modification application: and WHEREAS, the public hearing of the City Commission was advertised and held as required by lacy. all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the positive recommendation contained in the City's Community Development Department Review Report: and WHEREAS, notice was provided to all interested parties regarding the site plan modification application: and WHEREAS. the City Commission reviewed the site plan modification application, the written and oral recommendations of the Zoning Administrator of the Community Development Department; including the recommended conditions; and finds substantial competent evidence to support a showing by the Applicant that the request for site plan modification is in compliance with the Land Development Regulations and the Comprehensive Master Plan of the City and maintains the basic intent and purpose of the zoning. subdivision or other land use regulations, which is to protect the general welfare of the public, particularly as it affects the stability and appearance of the community: and. further finds that said request should be granted; subject to the conditions described herein. I5 -Z-_ Publix Super Markets. Inc. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMNIISS1ON OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: H. INCORPORATION OF RECITALS All recitals above are incorporated into the bode of this Resolution as if same were fully set forth herein. HL FINDINGS AND CONCLUSIONS: Based on an analysis of the application and the standards for approval for a site plan modification under the Land Development Regulations, the Cite Commission makes the following findings and conclusions: A. The Applicant's request for site plan modification is consistent with the Comprehensive Plan and Land Development Regulations of the City of Sunny Isles Beach. W. APPROVAL A. The Applicant's request for a new traffic circulation pattern for ingress and egress of trucks on Collins Avenue is hereby approved subject to all of the conditions set forth in Section V below. B. The Applicant's request for an ingress for customer vehicles from Collins Avenue with an elimination of customer vehicles egress onto Collins Avenue is hereby approved subject to all of the conditions set forth in Section V below. C. The Applicant's request for a solid roof covering is hereby approved subject to all of the conditions set forth in Section V below. D. The Applicant's request for a modification to the requirement to underground utilities alone 183`d Street to Collins Avenue to exclude the area adjacent to the gas station property is hereby approved subject to all of the conditions set forth in Section V below. V. CONDITIONS Conditions to be completed before demolition, below grade or building permits are issued. That the plans in the approval be substantially in accordance with that submitted for public hearing, which are entitled "Site Plan Modification for Sunny Isles Publix", prepared by Consultine and Engineering and Science. Inc. and Fisher and Associates. LLC. consisting of 12 sheets dated June 30. 2015 and the Landscape Plan consisting of 4 sheets and prepared by Witkin Hults Design Group dated June 30._2015. IS -Z-_ Publix Super Markets. Inc. 2. All conditions set forth in City Resolution No. 14-Z-141 approved and adopted on July 17; 2014 shall remain in effect except conditions modified in this approval. 3. Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the Community Development Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the Citv's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor' in accordance with Section 265-18 of the City Code. the Applicant shall be required to obtain another approval of the City Commission. 4. That in the event of multiple ownership, a homeowner's association shall be established in accordance with applicable regulations to assure that all common areas and facilities for the residents. as well as all easements dedicated to the City. shall be maintained in continuous and satisfactory manner and without expense to the general taxpayers of the City of Sunny Isles Beach. 5. If approved. the Applicant shall submit a separate building permit prior to any installation of murals or graphics on temporary construction fencing to be approved administratively by the City Manager or his designee. 6. That the Applicant shall comply with all conditions and permit requirements. including but not limited to Miami -Dade County; including environmental conditions and permitting. the Fire and Water and Sewer Departments, Florida Department of Environmental Protection (DEP) and Florida Department of Transportation (FDOT). 7. The Applicant shall coordinate and work with Miami -Dade County Traffic Engineering Department and the City of Sunny Isles Beach to develop strategy in order to provide modified and acceptable signal timing plans. The Applicant must take the necessary steps to pursue the signal timing changes consistent with the proposed signal timing plans (i.e. optimized) as documented in the traffic study. S. That the Applicant shall address comments provided by City's Landscaping Architect regarding landscaping plans submitted during site plan review process. 9. That the Applicant shall address comments provided by City's Traffic Engineer regarding traffic plans submitted during site plan review process. 10. That the Applicant shall address comments provided by City's Civil Engineer regarding Civil plans submitted during site plan review process. 11. That the Applicant shall be responsible for undergrounding all utility lines along 183th Street to the eastern border of their property. The Applicant further agrees to provide the City with an escrow deposit of Two Hundred Thousand Dollars (5200.000.00) for the cost of undergrounding the utility lines located adjacent to the gas station located on their property. If the costs of undergrounding the utility lines adjacent to the gas station exceed 15-Z-_ Publix Super Markets. Inc. 4 the escrow amount, the Applicant shall pay the City the difference. Should the cost of the undergrounding be less than the deposit, the City may refund the remainder escrow to the Applicant. Conditions to be completed before anv Certificate of Occupanev is issued: 12. That the Applicant shall obtain a Certificate of Occupancy and a Certificate of Use from the City upon compliance with all terms and conditions. The Certificate of Occupancy and Certificate of Occupancy shall be subject to cancellation upon violation of any of the conditions. 13. That the approved site plan shall remain valid for a period of 24 -months from the date of approval of the site plan modification. If no building permit is issued within the 24 -month time period, the modified site plan and the original site plan shall be considered null and void and of no force and effect. 14. That the Applicant shall comply with all City Ordinances, Countv, State and Federal Laws and Regulations applicable to development and permit approvals. VI. AUTHORIZATION OF CITY MANAGER The Citv Manager is herebv authorized to do all things necessary to effectuate this Resolution. VII. SEVERABILITY If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions of this Resolution. VIIL REPEALER All Resolutions are parts of Resolutions in conflict herewith shall be hereby and are repealed. Ix. EFFECTIVE DATE This Resolution shall become effective upon adoption. FINAL ANALYSIS This site plan modification received on June 30, 2015 only includes modifications to Phase I of the previous approved site plan. The site plan modification has been reviewed by Staff and City Consultants. (7) The Applicant shall coordinate and work with Miami -Dade County Traffic Engineering Department and City of Sunny Isles Beach to develop strategy in order to provide modified and acceptable signal timing plans. The Applicant must take the necessary steps to pursue the signal timing changes consistent with the proposed signal timing plans (i.e. optimized) as documented in the traffic study. (8) That the Applicant shall address comments provided by City's Landscaping Architect regarding landscaping plans submitted during site plan review process. (9) That the Applicant shall address comments provided by City's Traffic Engineer regarding traffic plans submitted during site plan review process. See limit on plan. All areas marked'Bahia Grass' shall be solid sodded with Paspalum. -Provide a 2" deep blanket of planting soil as described in planting notes this sheet. Prior to planting, remove stones, sticks, etc. from the sub soil surface. Excavate existing non -conforming soil as required so that the finish grade of sod is flush with adjacent pavement or top of curb as well as adjacent sod in the case of sod patching. -Place sod on moistened soil, with edges tightly butted, in staggered rows at right angles to slopes. -Keep edge of sod bed a minimum of 16" away from groundcover beds and 24" away from edge of shrub beds and 36" away from trees, measured from center of plant. -Sod Shall be watered immediatley after installation to uniformily wet the soil to at least 2" below the bottom of the sod strips. -Excavate and remove excess soil so top of sod is flush with top of curb or adjacent pavement or adjacent existing sod.
