( "AURORA SALES CENTER ") FOR A TEMPORARY SALES OFFICE LOCATED AT 17550 COLLINS AVENUE SUBJECT TO CERTAIN CONDITIONS; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on July 16`h, 2015. pursuant to Zoning Resolution No. I5 -Z -154, the City approved a site plan for a mixed -use 17 story residential condominium (`Project'); and WHEREAS, on or about September 17th 2015. 17550 Collins Ave. LLC. (`Applicant'), submitted an application to the City requesting a temporary on -site sales office; and WHEREAS, the City Commission wishes to approve the request to use the existing structure for a temporary on -site sales office. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Sales Office. Pursuant to Section 265 -14 of the Code of Sunny Isles Beach. the City Commission hereby approves the application submitted by the Applicant subject to the conditions set forth herein. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Conditions. The Applicant is required to comply with the following conditions: (1) The Project shall be developed substantially in accordance with the plans submitted for temporary sales center approval. Plans created by Revuelta Architects. Inc dated received September 17, 2015 for the abovementioned Project. Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the City Manager or his /her designee. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations. Result in a change that would not be considered minor; the Applicant shall be required to obtain approval of the City Commission. (2) A bond shall be posted by the Applicant for the amount 520,000.00 that would be necessary if the City was placed in the position of having to remove said temporary sales office or trailer. The use of the structure is exclusively for the sales of the condominium units of the approved site plan for the site and any other action or use shall require approval of the City Commission. (4) That the Applicant comply with all conditions and permit requirements of the Department of Permitting; Environment and Regulatory Affairs (PERA), the Miami -Dade County Fire Department (MDFD), Water and Sewer Department. Department of Environmental Protection (DEP), Florida Department of Transportation (FDOT). (5) That property is properly maintained and clean and free of any debris. (6) That the Applicant shall submit a staging plan before commencing any construction activity, the staging plan shall provide a schedule of activities such as, parking arrangements, lane closures, sidewalk closures. and any other required activity that may provoke an impact at the surrounding areas to the site. The staging plan should be approved administratively by the City Manager or designee. Section 4. Effective Date. This Resolution will become effective upon adoption. REASONS: The Project located at 17550 Collins Avenue, also known as the Denny's site, is requesting the use of the existing structure to be used as the temporary sales center for their approved project now called "Aurora Condominium ".
