AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION
256-14 OF THE CODE OF ORDINANCES OF SUNNY ISLES
BEACH ("PARKING RATES"); ESTABLISHING NEW
HOURLY PARKING FEES AT CERTAIN PARKING METER
LOCATIONS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission has a desire to provide locations for residents to park
their commercial/recreational vehicles at various locations throughout the City; and
WHEREAS, the City Commission wishes to amend the parking fees required per hour at
the Ellen Wynne Beach Access and Pier Park parking locations from the current rate of$2.00 per
hour to $3.00 per hour.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance
upon adoption hereof.
Section 2. Amendment. Section 256-14 of the City Code is amended to read as follows:
§ 256-14. Parking Rates.
A. The parking meter rates at the Ellen Wynne Beach Access shall be $3.00 for each
hour and the William Lehman Overpass (Center Island) parking lots shall be $2.00
for each hour, with a minimum purchase of one hour and a maximum of 12'hours.
The rental of the parking lot spaces for special events outside of the normal daily
operation shall be $50.00 per space for up to 12 hours, and a deposit of$500.00 is
required.

B. The parking meter rates for the parking lots at the Pier Park, under the William
Lehman Bridge, at the Bella Vista Park, and at any other municipal parking lot shall
be as follows:

(1) Rate of$3.00 per hour for parking at Pier Park and $2.00 per hour for
parking under the William Lehman Bridge, at Bella Vista Park. and at

any other municipal parking lot, with a maximum purchase 'of 12
hours. Weekdays shall begin at 12:00 midnight on Monday and
terminate at 11:59 p.m. on the Friday that immediately follows.
(2) Flat rate of $10.00 per day on weekends and City-observed holidays,
with a maximum of 12 hours. Weekends shall begin at 11:59 p.m. on
Friday and end at 11:59 p.m. on Sunday for a 48-hour period. j
(3) The rental of the parking lot spaces for special events outside I of the
normal daily operation shall be $50.00 per space for up to 12 hours and

Section 3. Severability. The provisions of this Ordinance are declared to be severable and if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to beiinvalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renuml ered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

RE: Ordinance amending Section 256-14 of the City Code
RECOMMENDATION:
It is recommended that the City Commission approve the proposed
Ordinance amending Section 256-14 of the City Code.
REASONS:
The City of Sunny Isles Beach has two municipal parking lots located
adjacent to the beach, Pier Park Lot and Ellen Wynne Lot. These two
municipal lots require more maintenance and other services than other
lots due to the amount of users. As such, a fee increase is required to
recover certain costs for these lots.
The City currently charges$2.00 for each hour,with a maximum of 12
hours, to park at Ellen Wynne Beach Access and at Pier Park. The
City Commission wishes to amend the parking fees required per hour
at the Ellen Wynne Beach Access and Pier Park parking locations,
from the current rate of$2.00 per hour to$3.00 per hour.
This Ordinance was requested by the City Manager's Office.
