A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE FIRST
AMENDMENT TO THE AGREEMENT WITH PERKINS+WILL
FOR ARCHITECTURAL DESIGN SERVICES FOR THE
GOVERNMENT CENTER ANNEX AT 18080 COLLINS AVENUE,
TO INCLUDE INTERIOR DESIGN AND CONSULTANT DESIGN
FEES FOR A 250-SEAT COMMUNITY THEATER, IN AN
AMOUNT NOT TO EXCEED TWO HUNDRED TWENTY NINE
THOUSAND THREE HUNDRED DOLLARS ($229,300.00)
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE
MAYOR TO EXECUTE SAID FIRST AMENDMENT TO
AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO
- ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City issued Request for Qualifications No. 15-04-01 for Architectural
Design Services for a New Facility at 18080 Collins Avenue, of which eight (8) responses were
received; and
WHEREAS, on September 17, 2015 via Resolution No. 2015-2459 the City Commission
ratified an agreement with Perkins+Will to provide Architectural Design Services for a New
Facility at 18080 Collins Avenue in an amount not to exceed Two Million Two Hundred
Twenty-Two Thousand Dollars ($2,222,000.00); and
WHEREAS, the City now wishes to amend Article 3 of the original Agreement to
include interior design and consultant design fees for a 250-seat Community Theater integrated
within the design of the Government Annex Building; and
WHEREAS, the Parties wish to amend Article 2 of the original Agreement to include-
additional compensation for the additional services in an amount not to exceed Two Hundred
Twenty-Nine Thousand Three Hundred Dollars ($229,300.00), bringing the total contract
amount not to exceed Two Million Four Hundred Fifty-One Thousand Three Hundred Dollars
($2,451,300.00); and
WHEREAS, the City Commission now wishes to approve the First Amendment to the
Agreement between the City and Perkins+Will to include interior design and consultant design
fees for a 250-seat Community Theater integrated within the design of the Government Annex
Building, in an amount not to exceed Two Hundred Twenty-Nine Thousand Three Hundred
Dollars ($229,300.00), attached hereto as Exhibit "A".

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of First Amendment to the Agreement. The City Commission hereby
approves the First Amendment to the Agreement with Perkins+Will to include interior design
and consultant design fees for a 250-seat Community Theater integrated within the design of the
Government Annex Building, in an amount not to exceed Two Hundred Twenty-Nine Thousand
Three Hundred Dollars ($229,300.00), attached hereto as Exhibit "A".
Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said First
Amendment to the Agreement.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 4. Effective Date. This Resolution shall become effective upon adoption.

This First Amendment to the Agreement between the CITY OF SUNNY ISLES EACH
("City")and PERKINS & WILL ARCHITECTS,INC.,("Contractor")executed this IV day of
lrit � , 2015, is made a part of the original Agreement dated August 21, 2015
("Agreement") between the City and Contractor, whose Federal Identification # is
.The City and Contractor hereby agree as follows:
1. ADDITIONAL SCOPE OF SERVICES. The City hereby wishes to amend Article 3 of
the original Agreement ("Services") to include interior design and consultant design fees for a 250
seat Community Theater integrated within the design of the Government Annex Building
("Additional Services"), as more particularly described in Attachment,"A",which is attached hereto
and incorporated herein by reference.
2. ADDITIONAL COMPENSATION. The Parties wish to amend Article 2 of the original
Agreement("Compensation") to include additional compensation for the Additional Services in an
amount not to exceed Two Hundred Twenty-Nine Thousand Three Hundred Dollars($229,300.00),
bringing the total contract amount not to exceed Two Million Four Hundred Fifty-One Thousand
Three Hundred Dollars($2,451,300.00).

3. OTHER PROVISIONS REMAIN IN EFFECT: Except as specifically modified herein,
all terms and conditions of the original Agreement between the parties,dated August 21,2015,shall
remain in full force and effect.
4. CONFLICTING PROVISIONS: The terms, statements, requirements, and provisions
contained in this First Amendment shall prevail and be given superior effect and priority over any
conflicting or inconsistent term,statement,requirement or provision contained in any other document
or attachment,including but not limited to Attachment"A".

Proposal for the New Community Theater at Government Annex
Dear Chris,
Perkins+Will is extremely pleased to present this additional services proposal for Architectural, Interior Design,
Engineering Design and Consultant Services related to the new Community Theater at Government Annex. This
document, upon approval and signature,will serve as an agreement in understanding and will be added to our existing
agreement for the design of the Sunny Isles Beach Government Annex Project.
PROJECT SCOPE
The project scope includes a new minimum 250 seat Community Theater at the Annex project.As discussed,the initial
building program included a Senior Center with a small, flat-floor Community Room.After discussion with the City, our
Commission presentation on October 15th and subsequent requests from the Mayor and Commissioners to enlarge the
Theater to a minimum of 250 seats, Perkins+Will provided a new Community Theater design in accordance with the
City directive. Our project understanding includes the following:
• A minimum 250-seat Community Theater integrated within the design of the Government Annex building
with a sloping floor for best line of sight seat placement, stage and back-of-the-house amenities, control
booth, pre and post-function areas,etc.
• The new Community Theater will be designed to accommodate the program of uses provided in email by
Susan Simpson on October 29, 2015.
• Based on the increase in seating requirements and understanding that many of these events will be for
Seniors,we have included escalators to move patrons from ground to the Theater floor. The expanded 3
elevator cabs serving the Tower would not be sufficient to efficiently move this number of patrons pre and
post function and we did not want to rely on stairs for this vertical connection. The physical dimensions and
requirements of the escalators will require a reduced retail program element at the ground although there
will still be room for a reduced coffee/refreshment area to serve the Community Theater users.
• We have included in this proposal an Acoustical, Audio-Visual and a Lighting consultant fee for the design of
the Theater; this consultant was not included in the original scope and fee because this program was not
originally contemplated by the City.
• We have included in this proposal an additional service scope and fee for Interior Design related to the
Theater and pre-function areas;this was not included in the original scope and fee because this program
element was not originally contemplated by the City.

project. Mileage in personal vehicles will be logged at current IRS guidelines. Reimbursable expenses shall be billed
monthly plus a multiplier of 1.1.

Sunny Isles Beach.

First Amendment to Architectural Design Services for
RE: New Facility at 18080 Collins Avenue to add
Architectural, Interior Design, Engineering Design and
Consultant services for Community Theater
RECOMMENDATION:
This resolution is presented for your consideration.
REASONS:
This First Amendment to the Agreement with Perkins + Will is for an
additional component that will include a community theater with a seat
capacity of 250. The amendment is for an amount not to exceed
$229,300.00. This price includes interior and consultant design fees
for the proposed theater and for the pre and post function areas. The
assembly area will now have to include acoustics, lighting and audio
visual, as well as fire and safety related design aspects that were not
initially included. However, other design modifications such as, the
increase of one elevator cab and two escalators, and the
implementation and detailing of these have been absorbed by the
already approved architectural design fees under Resolution 2015-
2459.
ADDITIONAL INFORMATION:
The community theater was discussed and, at the Commission's
direction, the architect will include it in the new design. It has been
found to be a key component of the future programming at the
expanded Government Center.
