AN ORDINANCE OF THE CITY COMMISSION OF THE CITYOF
SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 183-1
OF THE CODE OF ORDINANCES OF SUNNY ISLES BEACH,
ENTITLED "LICENSES AND PERMITS" TO PROVIDE FOR A
PERMIT FOR BEACH ACCESS CLOSURE; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the purpose of Chapter 183 of the City Code of Sunny Isles Beach is to
provide certain minimum requirements in all matters relating to the issuance, revocation, and
suspension of permits; and
WHEREAS, permits are required to show compliance with regulations under the Florida
Building Code, the City Code, as well as to promote the health, safety and general welfare of City
residents and visitors alike; and
WHEREAS, the City wishes confirm that a permit is required prior to a closure of a
Beach Access to perform work near or on the access property.
WHEREAS, the City Commission wishes to amend Section 183-1 to include the
requirement of a permit to close a beach access.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance
upon adoption hereof.
Section 2. Amendment. Section 183.1 of the City Code is amended to read as follows:
§ 183-1 Permits required.
A. Building permit required. Any owner or authorized agent who intends to
construct, enlarge, alter, repair, move, demolish or change a building, structure,
or part thereof, or conduct work in the public rights-of-way or public easement,
or use, clear, fill, excavate, move, pave, grade or otherwise alter land, water or
beach sand, shall first be required to obtain the applicable building permit from
the City prior to commencing any such work.

B. Permit for lane closure. Any applicant who intends to close a lane of traffic shall
be required to obtain a permit from the City prior to doing so.
C. Permit for Beach Access closure. Any applicant who intends to close a Beach
Access shall be required to obtain a permit from the City prior to doing so.
D. Display of permit. Whenever work in connection with a permit is occurring, a
permit card or copy shall be conspicuously displayed in the front of the
premises at all times from the date the permit is issued until final inspection. A
set of approved plans and a final as-built survey shall be made available at all
times on the premises where work in connection with the permit is occurring.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and, if
any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to
"section" or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

RECOMMENDATION:
This Ordinance is presented for your consideration.
REASONS:
The City has received a number of requests to close a particular ,
beach access over the years. To ensure compliance with the Florida
Building Code, City Code and public safety requirement, staff is
recommending that a permit be required before the closure of any
Beach Access.
This Ordinance is requested by the Office of the City Manager.
