AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION
156-2 OF THE CODE OF ORDINANCES OF SUNNY ISLES
BEACH, ENTITLED "FEES AND MISCELLANEOUS" TO
PROVIDE FOR PERMIT FEES FOR LANE AND BEACH
ACCESS CLOSURES; PROVIDING FOR SEVERABILITY;
PROVIDING FOR INCLUSION IN THE CODE; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Section 156-2 of the City Code of Ordinances provides the City Manager or
his designee with the authority to annually review the Building Department Fee Schedule and make
recommendations to the City Commission; and
WHEREAS, from time to time; the City is asked to close a lane of traffic or a Beach Access
to facilitate construction.
WHEREAS, the City Commission wishes to amend the permit fee schedule set forth in
Section 156-2 of the City Code to require an Applicant who intends to close a beach access or a lane
of traffic to obtain a permit from the City and pay a required fee.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon
adoption hereof
Section 2. Amendment. Section 156-2 of the City Code is amended to read as follows:
§ 156-2. Annual review.
The City Manager and/or his designee are hereby directed to annually review the Building
Department Fee Schedule to determine if an adjustment to the fee schedule should be recommended
to the City commission.

K. Pre-payment fees for repair permits in condominium units
L. Specialized Permitting Service
L-001 In addition to the calculated permit fees, applicant seeking"Specialized
Permitting Service" for interior remodeling work will pay an added I.%
of the total job value(as determined by the Building Official and/or their
designee.)
Services will include:
• Pre-construction meeting with the Building Official and/or their designee
(optional)
• Permit county service by appointment
• Expedited plan review
• Orientation in setting up onl8ne permitting account
L-002 Minimum Fee 51000.00
L-003 Lane closure permit fee S1,000.00
L-004 Beach Access closure fee 51,000.00
Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any
section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby
ordained, that the provisions of this Ordinance shall become and be made a part of the code of the
City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section"
or other appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same
are hereby repealed.
Section 6. Effective Date. This Ordinance shall be effective ten (10) days after adoption on
second reading.

Amending Section 156-2 of the City Code of Ordinance
RE: of Sunny Isles Beach to Provide for Permit Fees for
Lane and Beach Access Closure
RECOMMENDATION:
This Ordinance is presented for your consideration.
REASONS:
The City has received a number of requests to close a particular
beach access over the years. To ensure compliance with the Florida
Building Code, City Code and public safety requirements, staff is
recommending that a permit be required before the closure of any
Beach Access.
This Ordinance is requested by the Office of the City Manager.
