HomeMy WebLinkAboutReso 2016-2518 RESOLUTION NO. 2016- ZSI A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AWARDING BID NO. 15- 12-02 TO, AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND ENTER INTO AN AGREEMENT WITH ROHL NETWORKS, LP FOR THE CONSTRUCTION OF THE COLLINS AVENUE UTILITY UNDERGROUNDING, IN A TOTAL AMOUNT NOT TO EXCEED SIX MILLION EIGHT HUNDRED THIRTY THOUSAND DOLLARS ($6,830,000.00), PROVIDED SAID AGREEMENT IS APPROVED AS TO FORM AND LEGAL SUFFICIENCY BY THE CITY ATTORNEY; AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach is in need of professional construction services for the Collins Avenue utility undergounding; and WHEREAS, the City issued and advertised Bid No. 15-12-02 for Construction of the Collins Avenue Utility Undergrounding and received three (3) bids, and it was determined that Rohl Networks, LP was the most responsible, responsive bidder; and WHEREAS, Rohl Networks, LP is qualified, willing and able to provide the desired services on the terms and conditions set forth herein; and WHEREAS, the City Commission wishes to award Bid No. 15-12-02 to, and authorize the City Manager to negotiate and enter into an Agreement with Rohl Networks, LP, for the Construction of the Collins Avenue Utility Undergrounding, in an amount of Four Million Eight Hundred Thirty Thousand Dollars ($4,830,000.00), and an owner contingency in the amount of Five Hundred Thousand Dollars ($500,000.00), and an additional contingency in the amount of One Million Five Hundred Thousand Dollars ($1,500,000.00) for additional scope of work for Atlantic Boulevard, in a total amount not to exceed Six Million Eight Hundred Thirty Thousand Dollars ($6,830,000.00), provided said Agreement is approved as to form and legal sufficiency by the City Attorney. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The recitals set forth in this resolution are incorporated herein by reference as if fully set forth herein. Section 2. Award of Bid and Authorization of City Manager. The City Commission hereby awards Bid No. 15-12-02 to, and authorizes the City Manager to negotiate and enter into an Agreement with Rohl Networks, LP, for the Construction of the Collins Avenue Utility Undergrounding, in a total amount not to exceed Six Million Eight Hundred Thirty Thousand R2016-Bid 15-12-02 and Agmt Rohl Collins Ave Utility Undergrounding Page 1 of 2 Dollars ($6,830,000.00) provided said Agreement is approved as to form and legal sufficiency by the City Attorney. Section 3. Authorization of City Manager and City Attorney. The City Manager and the City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Russo, .City Manager DATE: January 21, 2016 RE: Resolution Awarding Bid No. 15-12-02 and Authorizing the City Manager to Negotiate and Enter into an Agreement with Rohl Networks, LP for the Construction of the Collins Avenue Utility Undergrounding RECOMMENDATION: The attached Resolution is presented for your consideration. REASONS: The City issued Bid No. 15-12-02 for the Construction of the Collins Avenue Utility Undergrounding. The City received three (3) responses (Bid Opening Report attached), and it was determined by me that Rohl Networks, LP was the most responsible, responsive bidder. The attached Resolution awards the Bid and authorizes the City Manager to negotiate and enter into an Agreement with Rohl Networks, LP for Construction of the Collins Avenue Utility Undergrounding. Representatives of HPF Associates, Inc., our owner representative, and Keith and Schnars, Engineer of Record, have conducted a scope review of the low bidder qualifications. Based on the scope review, a revised bid has been received from Rohl Networks in the amount of $4,830,000.00 plus a contingency for unforeseen conditions of $500,000.00, and $1,500,000.00 for the cost of Atlantic Boulevard undergrounding, for a total amount not to exceed of $6,830,000.00. Discussions relating to the potential unforeseen obstructions and unidentified underground utilities result in the recommendation that a $500,000.00 owner contingency be added to the contract amount allowing for prompt resolution of such matters to assure a timely project completion. Further, due to the fact that the off-Collins, namely Atlantic Boulevard, design portion of the project has not been completed, an additional contingency of$1,500,000.00 also be included in the contract for that additional scope. Rohl Networks has confirmed and Agenda Item I-01— Date 1- 7.1-1L committed to the utilization of the bid unit prices for the incorporation of this additional scope for a total amount not to exceed $6,830,000.00 with the two contingencies. In reviewing the respective bidders scope and unit pricing certain anomalies were discovered and the two lowest bidders were afforded the opportunity to refine their bid to achieve for the City the most responsive and accurate final proposal. The review focused on issues regarding schedule, understanding project parameters, site logistics and the Maintenance of Traffic. Rohl Networks has demonstrated exceptional understanding of the project and full awareness of the critical challenges relating to the execution of the work in consideration of Sunny Isles Beach residences and businesses along Collins Avenue. ADDITIONAL INFORMATION: We anticipate a Notice to Proceed allowing for the commencement of construction administration related activities could occur no later than February 1, 2016 with actual on-site activities beginning by the first of March, pending prompt City approval.
