A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE CITY OF
SUNNY ISLES BEACH EAR-BASED TEXTURAL AMENDMENTS TO
THE CITY OF SUNNY ISLES BEACH'S COMPREHENSIVE MASTER
PLAN, AND THE REQUIRED TRANSMITTAL TO THE FLORIDA
DEPARTMENT OF ECONOMIC OPPORTUNITY IN ACCORDANCE
WITH SECTION 163.3191, FLORIDA STATUTES; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS. the City of Sunny Isles Beach, Florida was incorporated on June 17, 1997;
and
WHEREAS, pursuant to the provisions of the Local Government Comprehensive Planning
and Land Development Regulation Act, on October 5. 2000. the City of Sunny Isles Beach
adopted its Comprehensive Plan; and
WHEREAS, on September 22, 2005, the City Commission, acting in its capacity as the
City's Local Planning Agency determined that it was in the best interest of the City and its
residents to recommend approval of the Resolution adopting the EAR for transmittal to the State
Department of Community Affairs; and.
WHEREAS, Section 163.3191, Florida Statutes, directs local governments to periodically
assess the success or failure of the adopted plan to adequately address changing conditions and
state policies and rules; and
WHEREAS, the City has completed its Evaluation and Notification Letter pursuant to the
requirements of Section 163.3191(2), Florida Statutes, and transmitted the Evaluation and
Appraisal Notification Letter to the Department of Economic Opportunity on December 1, 2014,
who acknowledged receipt of the Letter and the City's intent to prepare Comprehensive Plan
amendments based on the Letter; and
WHEREAS, the City has completed its Evaluation and Notification Letter pursuant to the
requirements of Section 163.3191(2), Florida Statutes, and transmitted the Evaluation and
Appraisal Notification Letter to the Department of Economic Opportunity on December 1, 2014;
and
WHEREAS, the City held and advertised town hall meetings with residents, business
owners to provide for public participation in the process in accordance with Chapter 163, Florida
Statutes, and the City prepared an Evaluation and Appraisal Report of its Comprehensive Plan in
order to update baseline data and analysis, and identify additional amendments that may be needed
to address community-specific needs and challenges; and
WHEREAS, the City Commission serves as the Local Planning Agency ("LPA"), and
whereas the LPA is required to review the EAR-Based Amendments; and

WHEREAS, the LPA has determined that it is in the best interest of the City and its
residents to recommend approval of the EAR-Based Textural Amendments to the Comprehensive
Master Plan for transmittal to the Florida Department of Economic Opportunity.
NOW THEREFORE, BE IT RESOLVED BY THE LOCAL PLANNING AGENCY
OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval_ of Comprehensive Plan EAR-Based Textural Amendments. The Local
Planning Agency hereby approves the City of Sunny Isles Beach proposed Comprehensive Plan
Evaluation and Appraisal Report (EAR) Based Textural Amendments, attached as Exhibit "A", as
amended at the public hearing held on January 21, 2016.
Section 2. Transmittal of Proposed Comprehensive Plan EAR. The Local Planning Agency
hereby recommends transmittal of the City of Sunny Isles Beach EAR to the Florida Department of
Economic Opportunity in accordance with Florida Statute 163.3191.
Section 3. Effective Date. This Resolution shall take effect i • ea ately upon adoption.
