HomeMy WebLinkAboutReso 2016-2531 RESOLUTION NO. 2016- 2531 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH SECTION 932.7055, F.S., TO EXPEND FIVE THOUSAND SEVEN HUNDRED SEVENTY-NINE DOLLARS AND TWENTY-EIGHT CENTS ($5,779.28) FROM THE LAW ENFORCEMENT TRUST FUND (LETF) FOR THE PURCHASE OF AN iPAD TABLET AND iPAD CASES FOR THE INVESTIGATIVE SERVICES DIVISION UNIT, AND TO COVER TRAVEL EXPENSES TO SEND THE POLICE HONOR GUARD TO THE NATIONAL POLICE MEMORIAL IN WASHINGTON, D.C.; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law enforcement agency that acquires at least $15,000 pursuant to the Florida Contraband Forfeiture Act within a fiscal year must expend or donate no less than 15% of such proceeds for the support or operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe neighborhood, school resource officer programs or for other law enforcement purposes; WHEREAS, in accordance with Florida Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsection; and WHEREAS, the Chief of Police has submitted a request for the expenditure of Five Thousand Seven Hundred Seventy-Nine Dollars and Twenty-Eight Cents ($5,779.28) for the purchase of an iPad tablet and seven (7) iPad cases for use in the Investigative Services Division unit, in an amount of One Thousand Two Hundred Dollars (1,200.00), and for the cost associated with sending our Police Honor Guard to the Washington,D.C. Police Memorial 2016, in an amount of Four Thousand Five Hundred Seventy-Nine Dollars and Twenty-Eight Cents ($4,579.28), for a total amount not to exceed Five Thousand Seven Hundred Seventy-Nine Dollars and Twenty-Eight Cents ($5,779.28) in forfeiture funds in compliance with the aforementioned Statute. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend Five Thousand Seven Hundred Seventy-Nine Dollars and Twenty-Eight Cents ($5,779.28) from the Law Enforcement Trust Fund for an iPad Tablet, seven (7) iPad cases for the Investigative Services Division, and for the cost associated with the Police Honor Guard trip to The National Police Memorial in Washington, D.C. Grandinetti, Police Captain DATE: 3/17/2016 Approval to Expend Partial Forfeiture (LETF) Funds to cover travel expenses to send the police Honor Guard to RE: the National Police Memorial in Washington, D.C. and for the purchase of one (1) iPad tablet and seven (7) iPad • tablet cases for our investigative services unit, in an amount not to exceed $5,779.28 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Law Enforcement Trust Funds (LETF), previously awarded to the Police Department as the result of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment, community policing efforts and other law enforcement activities. It is requested that we be permitted to utilize up to $5,779.28 of said funds on deposit for such purpose. REASONS: Our Investigative Services Unit was recently awarded a grant for the purchase of six iPad tablets to enhance our investigators ability to have more case information with them while out of the office, following up cases. Unfortunately, with the limited amount of grant funds available, we were one short of providing all detectives with an iPad. With the use of LETF monies, we would purchase one additional iPad and seven iPad cases. 63 Also, each year the National Police Memorial Week is celebrated in Washington, D.C. and around the country. The culmination of the event is the candle light vigil and memorial recognition ceremony for all officers killed in the line of duty. It is an honor for our agency's Honor Guard to be a part of this solemn ceremony. ADDITIONAL INFORMATION: Our agency's Honor Guard throughout the year appears at many ceremonies and events on behalf of our city. It is my privilege to request on their behalf, to send them to this ceremony in Washington, D.C. This is an approved expenditure of forfeiture funds under the spending guidelines and will not cause an expense to the city.
