HomeMy WebLinkAboutReso 2016-2536 RESOLUTION NO. 2016-253 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING RESOLUTION NO. 2014-2339 TO REDUCE THE TOTAL AMOUNT OF TRANSFER DEVELOPMENT RIGHTS (TDRs) APPROVED FOR THE MARRIOTT PROJECT LOCATED AT 17700 COLLINS AVENUE; DIRECTING THE ZONING ADMINISTRATOR OR DESIGNEE TO MODIFY THE CITY TDRs BANK ACCOUNT IN ACCORDANCE WITH THIS RESOLUTION; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Resolution No. 2014-2339, adopted on November 20, 2014, the City Commission approved the assignment of TDRs from the City Transfer Development Rights Bank("TDRs Bank") in the amount of 13,766 square feet of floor area and eight(8) dwelling units of TDRs in favor of the Marriott Project located at 17700 Collins Avenue, Sunny Isles Beach, Florida; and WHEREAS, pursuant to Section 265-18 (I)(2)(a) the Project presented a Site Plan Modification (the "Modification") to the City and on February 16, 2016 the City Manager administratively approved a Minor Site Plan Modification for the Marriott Project as reflected in attached Exhibit "A", which reduced the total amount of TDRs original approved for the Project; and WHEREAS, the Modification essentially reduced the Project's TDRs from 13,766 square feet of floor area and eight (8) dwelling units to 9,671 square feet of floor area and six (6) dwelling units, for a total reduction of 4,095 square feet of floor area and two (2) dwelling units of TDRs; and WHEREAS, the equivalent cash value of reduction of the TDRs equals $176,085 Dollars from the original cash value amount of$591,938 Dollars; and WHEREAS, the City Commission wishes to amend Resolution No. 2014-2339 to reflect a reduction in the amount of TDRs approved for the Project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Authorizing the Zoning Administrator to Adjust the City TDRs Bank. Pursuant to Section 265-23 of the City Code, the City Commission hereby amends Resolution No. 2014-2339 to reflect a reduction in the total amount of TDRs approved for the Marriott Project in accordance with the approval of a Minor Site Plan Modification and authorizes the Zoning Administrator to Marriott,Reduction of 1'DR Page 1 of 2 reduce the amount of TDRs approved for Marriott Project by 4,095 square feet of floor area and two (2) dwelling units. Section 3. Authority of the City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. Russo, City Manager FROM: Claudia Hasbun, Planning and Zoning Administrator if CC: Hans Ottinot, City Attorney Stan Morris, Deputy City Manager Clayton Parker, Building Official DATE: February 16, 2016 • RE: Residence Inn by Marriott - Minor Modification Request This is a request for a Minor Modification of the approved site plan for the Residence Inn by Marriott, which was approved by the City Commission pursuant to Zoning Resolution • No. 14-Z-148 and Resolution No. 2014-2339, adopted on November 20, 2014 ("The Project"). The Project is located at 17700 Collins Avenue and consists of an 18-story hotel • building with 194 hotel room with 110,009 square feet of Floor Area Ratio (FAR). I. Background As indicated above, the City Commission approved a site plan consisting of an 18-story hotel building with 194 hotel rooms with 110,009 square feet of FAR. The total approved FAR was inclusive of 13,766 square feet of Transfer development Rights (TDRs). As of this date,the Project is going through the building permitting process, during such process the developer has reduced certain areas previously accounted for FAR. II. Request This Minor Modification request is to permit the approved project to incorporate the following site plan revisions: • A FAR reduction for the overall project from 110,009 square feet of FAR to 105,914 square feet of FAR; and • The reduction of TDRs from 13,766 square feet to 9,671 square feet; and • A reduction of the total TDRs price from $591,938 to $415,853; and Residence Inn by Marriott—MM February 2016 Page 1 of 3 Exhibit "A" • The reduction of one (1) parking space due to the decrease of 4,095 square feet of FAR for a total of 212 parking spaces. III. Standards for Granting a Minor Modification In order to be considered for a minor modification of an approved site plan, the project needs to be in compliance of Section 265-18 I.(2) of the City Code as described below: §265-18 I.(2) Minor modification. The City Manager shall administratively approve "minor" changes and deviations from an approved site plan which are in compliance with the provisions and intent of this chapter and which do not depart from the principal concept of the approved plan. An amendment shall be considered a minor modification if in compliance with each of the following limitations: (a) The modification does not change lot overage, setbacks, height increase or decrease, as well as density or intensity calculations set forth in a previously approve site plan. Notwithstanding the foregoing or any other provision in this section, a decrease in density and intensity of an approved site plan shall be considered a minor modification, which does not require the approval of the City Commission, where such modification results in a decrease of density or intensity of no more than five percent of the approved density or intensity calculations in the site plan; (b)The change is not an alteration that would otherwise require a variance or would not meet the requirements of the Code of the City of Sunny Isles Beach; (c)There is no change in the location, size and general site compatibility of building, lighting and signs; (d)There is no increase in the number of average daily trips; (e)The change does not alter the location of any points of ingress, egress, access and vehicular and pedestrian patterns to the site; (f) The changes do not substantially decrease the value of or substantially change the character or location of any improvement or amenity; (g) Change to landscape material, location, planting techniques, species, or size as deemed necessary by the City Manager or his/her designee due to availability or site conditions; and (h) The change does not result in a material modification or the cancellation of any condition placed upon the site plan as originally approved. A letter from the Applicant is attached. V. Staff Analysis Staff finds that the revisions to the previously approved site plan are in compliance with the Minor Modification requirements of Section 265-18 I. (2) of the City Code. Staff also finds that none of the aforementioned minor.changes affect the overall building site, open space, setbacks, density, lot coverage, or unit count.Attached is a set of plans received February 10, 2016 for your review. In addition, Staff will present a revised TDRs resolution to the City Commission confirming the amended amount of TDRs for the Project. Diagram prepared by Kobi Karp Architecture dated 2-10-2016 as a minor modification to the Site Plan which results in a reduction of F.A.R for the Project from 110,009 square feet to 105,914 square feet which falls within the five percent(5%)threshold for a reduction in F.A.R. In light of the fact that 17700 Collins Avenue Owner, LLC ("Applicant") purchased available TDR's from the City of Sunny Isles Beach (the "City") at a cost of $43 psf as set forth in Resolution No. 2014-2339 ("TDR's Resolution") dated November 20, 2014, the monetary contribution to be made by Applicant to the City in connection with the Project shall be reduced by 4,095 square feet of $176,085 which is the • product of the above described F.A.R. reduction and the per square foot price of TDR's as set forth in the appraisal attached to the TDR's Resolution. In addition to the foregoing and in connection with the F.A.R. reduction described above, please further ' note that the future restaurant space was reduced from 2,170 sf of front of the house space and 726 sf of back of the house space which totaled 2,896 sf to a total of 2,592 sf of front of the house space. This reduction in overall square footage of the restaurant results in a reduction of the required parking for such space from 19 spaces to 18 space. Thank you for your assistance with this request. ' • _. --- -— --- — -- - - . --- RESOLUTION NO. 2014- 2,339 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE TRANSFER OF DEVELOPMENT RIGHTS ("TDRs") IN THE AMOUNT OF THIRTEEN THOUSAND SEVEN HUNDRED SIXTY SIX (13,766) SQUARE FEET OF FLOOR AREA ("FAR") AND ZERO (0) DWELLING UNITS TO 17700 COLLINS AVENUE OWNER, LLC. FOR THE PROPERTY LOCATED AT 17700 COLLINS AVENUE FROM THE CITY'S TDR BANK ACCOUNT; DIRECTING THE ZONING ADMINISTRATOR OR DESIGNEE TO TRANSFER THE TDRs FROM THE CITY'S BANK ACCOUNT IN ACCORDANCE WITH ZONING RESOLUTION NO. I4-2-118 ; AUTHORIZING FOR THE ADJUSTMENT AND MODIFICATION OF THE CITY'S TDR BANK; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, by Zoning Resolution No.141 Z N$adopted on November 20th, 2014 the City Commission approved the zoning application submitted by 17700 Collins Avenue Owner. LLC (Applicant") for the transfer of TDRs in the amount of 13,766 square feet of floor area and 0 dwelling units; and WHEREAS, pursuant to Section 265-23E of the Code of the City of Sunny Isles Beach; the City Commission shall consider the acceptance of the appraised land value in the amount of Four Million One Hundred Fifty Thousand Dollars (S4,150,000) for the receiving. site for the purpose of calculating the square foot value of the approved TDRs; and WHEREAS, the City's TDR Bank balance will be adjusted to reflect the sale of TDRs to the Applicant in the amount of Thirteen Thousand Seven Hundred Sixty Six (13.766) square feet of floor area and Eight (8) dwelling units; and WHEREAS, the Applicant is required to pay a per square foot price of Forty Three Dollars (S43.00) as set forth in the appraisal attached as Exhibit "A"; and WHEREAS, the City Commission agrees to accept Five Hundred Ninety One Thousand Nine Hundred Thirty Eight Dollars (S591;938.00) from the Applicant for the payment of TDRs in the amount of Thirteen Thousand Seven Hundred Sixty Six (13.766) square feet of floor area and Zero (0) dwelling units; and WHEREAS; the receiving site for the TDRs is located at 17700 Collins Avenue, Sunny Isles Beach and is legally described in Zoning Application No. PZ2014-14; and 17700 Collins Avenue Owner, I.I.0 -City TDR Bank Page I of 3 WHEREAS, the City Commission wishes to approve the transfer of the TDRs contemplated herein in accordance with its TDRs ordinance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Authorizing the Transfer of Development Rights. Pursuant to Section 265-23 of the City Code and in accordance with Zoning Resolution No.14-214e, the City Commission hereby authorizes the transfer of the development rights in the amount of Thirteen Thousand Seven Hundred Sixty Six (13,766) square feet of floor area and Zero (0) dwelling units to 17700 Collins Avenue Owner; LLC. from the City's TDR bank account. Section 3. Directive to Zoning Administrator. The Zoning Administrator or designee is hereby directed to transfer the development rights from the City's TDR Bank to 17700 Collins Avenue Owner, LLC. in accordance with Zoning Resolution No.('-2-f g. Section 4. Authorizing the Adjustment and Modification of TDRs. The Zoning Administrator is hereby authorize to adjust by decreasing the City's TDR bank account by Thirteen Thousand Seven Hundred Sixty Six (13;766) square feet of floor area and Eight (8) dwelling_ units. Section 5. Payment Agreement for the Transfer of Development Rights. The Applicant shall provide the City with a non-refundable deposit in the amount Fifty Nine Thousand One Hundred Ninety Five Dollars (S59,195) which is 10% of the approved purchased price of Five Hundred Ninety One Thousand Nine Hundred Thirty Eight Dollars (S591,938) within three (3) working days of the approval of this Resolution. The remainder of the payment is due prior to issuance of the building permit for the site plan approved in accordance with Zoning Resolution No. 114-2-(4q Section 6. Authority of the City Manager and City Attorney. The City Manager and City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 7. Effective Date. The purpose of the report is to estimate a cost per unit for the purchase of Transfer Development Rights (TDR's), as it pertains to the underlying subject property. This is an Appraisal Report which is intended to comply with reporting requirements set forth under Standards Rule 2-2(a)of the Uniform Standards of Professional Appraisal Practice (2014-2015). Under the previous USPAP for 2012- 2013 the report would have been described as a Summary Report The value opinion reported is qualified by certain definitions, limiting conditions and certifications which are set forth on pages 32 through 34 of this report. The extraordinary assumption as it relates to market value is stated herein. The report is not premised upon a hypothetical condition. This appraisal report is in compliance with the minimum standards of the Uniform Standards of Professional Appraisal Practice (USPAP 2014-2015). Because the intended use of the appraisal is for internal purposes the report may not be in conformance with Title XI of FIRREA and Department of the Treasury Interagency Appraisal and Evaluation Guidelines. The subject property of this appraisal is the underlying., commercially zoned, land area that is improved with a retail store that was completed in 1957 and contains 14,637 square feet of building area. The subject parcel contains 32,085 square feet or .737 acres of land area (Survey). • Robert I, Finvarb President and Chief Executive officer Page Two As per the LDR, at the time of approval of the TDR's,the City Commission shall consider the acceptance of the appraised land value for the receiving site as follows: the cost for a square foot of development right shall be determined by the market value of the receiving site as determined by a current real estate appraisal (updated no more than three months from the date the application is heard at a public hearing) prepared for the City by an appraiser, selected by the City Manager, but paid for by the owner of the receiving site. The appraisal amount shall then be divided by the permitted floor area ratio, including bonuses on the receiver site. Zoning and Legal Officials with the City of Sunny Isles Beach established parameters with regard to the selection of comparable sales. These parameters preclude the Appraiser from going outside the City limits to search for comparable land sales. Because of the parameters and restrictions enforced by City officials toward the appraisal process the conclusion should not, and has not been, considered market value as typically defined. The conclusion is the most probable price paid by a developer for TDR's in Greater Sunny Isles Beach and not a market supported value. The appraiser has previously provided consultation and value estimates for properties similar to the subject property throughout the South Florida region. As such, the appraiser is in compliance with the competency provision contained within USPAP. A copy of the appraiser's qualifications is included in the addenda. 1 have not provided professional services related to the subject property, as an appraisers or in any other professional capacity, within the prior three years; preceding this date of appraisal. However, the reduction from the City's TDRs bank will reflect a total of 13,766 square feet and eight (8) dwelling units. The effect of the TDR's purchase and approval on the project would be an increase in F.A.R. only since this project does not include a residential component. The appraisal report reflects the square foot value of a TDRs as Forty Three Dollars ($43.00) per square foot. Thus, the total TDR purchase is $591,938. The Applicant shall provide the City with a non-refundable deposit in the amount of ten percent (10%) of the approved purchased price of $591,938 for the Transfer Development Rights (TDRs) purchased from the City Bank. The total amount of the deposit is $59,195. Subsequently, pursuint to City Code Section 265-18 (I)(2)(a) the Project submitted a request for a Minor Site Plan Modification to the City and it was administratively approved, attached hereto as Exhibit"A".
