NOTICE IS HEREBY GIVEN that the City of Sunny Isles Beach is seeking sealed Bids for the following
work as specified
SCHOOL CROSSING GUARD SERVICES
Invitation to Bid No. 16-04-05
This Invitation to Bid (ITB) is available from DemandStar by calling (800) 711-1712 or by accessing their
website at www.demandstar.com. The ITB may also be examined at the City of Sunny Isles Beach, Office
of the City Clerk. Bidders who obtain the ITB from sources other than DemandStar or the City of Sunny
Isles Beach are cautioned that their Bid response package may be incomplete. Addenda will be posted and
disseminated by DemandStar at least five calendar days prior to the Bid due date to all Bidders who are
listed on the official list. The City may not accept incomplete Bids.
Sealed Bids will be received by the City Clerk no later than 2:30 PM, on Wednesday, 05/25/2016 at
the Sunny Isles Beach Government Center located at 18070 Collins Avenue, 4th floor, Sunny Isles Beach,
Florida, 33160. Bids received after this time will not be considered. The City is under no obligation to
return Bids. Timely submitted Bids will be opened publidy and read aloud at this time. The envelope

SECTION 2
SPECIAL TERMS AND CONDITIONS
2.1 PURPOSE OF BID:
The City of Sunny Isles Beach is seeking bids from qualified bidders to provide School Crossing
Guard Services on an as-needed basis for the City's Police Department in accordance with the
terms, conditions, and specifications contained in this ITB.
2.2 PRE-BID CONFERENCE:
A Pre-Bid Conference will not be scheduled for this ITS.
2.3 CONTRACT TERM AND RENEWALS
The initial contract term shall be two (2) years. The City, at its sole option, may renew the
agreement for three (3) optional one-year renewal periods.
2.4 RATE AND RATE ADJUSTMENTS
During the initial contract term the hourly rate shall remain firm.
After the initial term, the City may consider price adjustments only if an increase occurs throughout
the local industry, in which case the City will use changes in the latest yearly percentage increase
of the All Urban Consumers Price Index (CPI-U)as published in the Bureau of Labor Statistics, U.S.
Department of Labor, and shall not exceed five percent (5%) or the CPI-U, whichever is lower.
The Vendor shall provide a rate adjustment request no later than ninety(90)days prior to the end
of the then current term. If no adjustment request is received from the Vendor, the Parties agree
that the optional term may be exercised without a rate adjustment. Late rate adjustment requests
will not be considered.
Should there be a change in the State of Florida or Federal Minimum Wage Rates, the Vendor shall
provide a rate change request to the City. Rate adjustments in this event shall be limited to only
the direct cost of the increase and must be passed-thru directly to the Vendor's employees. No
administrative or overhead costs of any kind may be added to such increase.
All rate adjustments shall be requested by the Vendor with sufficient supporting documentation to
be considered by the City.
2.5 METHOD OF AWARD
Award shall be made in accordance with Section 1.31 of this ITB.

2.6 PERFORMANCE BOND
The City of Sunny Isles Beach shall require the successful Bidder to furnish a Performance Bond in
the amount of 100% of the total Bid Price, with the City of Sunny Isles Beach as the Obligee, as
security for the faithful performance of the Contract and for the payment of all persons performing
labor or furnishing materials in connection herewith within ten (10)calendar days after notification
of the award by the City. The Performance Bond shall continue in effect through the contract
term(s). The bonds shall be with a surety company authorized to do business in the State of Florida
and having been in business with a record of successful continuous operation for at least five (5)
years.
2.7 BID BOND
The City of Sunny Isles Beach shall require that every Bidder furnish a bid bond in the amount of
5% of the total Bid price.
2.8 INSURANCE
2.8.1 Comprehensive General Liability Insurance
Comprehensive General Liability with minimum limits of Two Million Dollars
($2,000,000.00) per occurrence combined single limit for Bodily Injury Liability and
Property Damage Liability. Coverage must be offered in a form no more restrictive than
the latest edition of the Comprehensive General Liability policy, without restrictive
endorsements, as filed by the Insurance Services Office, and shall specifically include the
following with minimum limits not less than those required for Bodily Injury Liability and
Property Damage Liability:
• Premises and Operation;
• Independent Contractors;
• Products and/or Completed Operations Hazard;
• Broad Form Property Damage;
• Broad Form Contractual Coverage applicable to this spedfic Contract, induding
any hold harmless and/or indemnification agreement.

2.8.2 Business Automobile Liability

Before starting the Services, the Bidder will file and make sure that all certificates of
insurance required by this document and by the Contract are in the City's possession.
These certificates shall contain a provision that the coverage afforded under the policies
will not be canceled or materially changed until at least thirty(30)days prior written notice
has been given to the City by certified mail. The City shall be named as an additional
insured on the above-referenced policies.
2.8.3 Worker's Compensation Insurance
Worker's Compensation Insurance for statutory obligations imposed by Worker's
Compensation or Occupational Disease Laws, induding, where applicable, the United States
Longshoremen's and Harbor Worker's Act,the Federal Employers'Liability Act and the Homes
Act. Employer's Liability Insurance shall be provided with a minimum of One Hundred
Thousand and 00/100 dollars ($100,000.00) per acddent. Bidder agrees to be responsible
for the employment, conduct and control of its employees and for any injury sustained by
such employees in the course of their employment
2.8.4 Cancellation and Re-Insurance
If any insurance should be cancelled or changed by the insurance company or should any
insurance expire during the period of this contract, the Consultant shall be responsible for
securing other acceptable insurance to provide the coverage spedfied in this section to
maintain coverage during the life of this Contract. All deductibles must be declared by the
Bidder and must be approved by the City. At the option of the City, either the Bidder shall
eliminate or reduce such deductible or the Bidder shall procure a Bond, in a form
satisfactory to the City, covering the same.
NOTE: THE CITY OF SUNNY ISLES BEACH, CONTRACT NUMBER AND TITLE MUST APPEAR ON
EACH CERTIFICATE OF INSURANCE.
2.9 RESPONSIBILITY OF VENDOR, BACKGROUND CHECK& FINGERPRINTING
The Vendor shall be responsible for hiring the necessary personnel to conduct the daily operation
of the services and will comply with all federal, state, and local laws related to minimum wage,
soda) security, nondiscrimination, Americans with Disabilities act ("ADA"), unemployment
compensation, and workers'compensation.
The Vendor and all personnel employed by them shall be required, at their sole cost and
expense, to pass a criminal background check prior to award of the contract, and every renewal
term. The Criminal background check shall consist of a Florida Department of Law Enforcement
("FDLE") Florida Crime Information Center National Crime Information Center ("ECIC/NCIC")
criminal records check. Any employee not meeting this requirement will not be permitted to work
under this Agreement. The successful Bidder shall be required to co-ordinate the criminal
background checks by contacting the City's Human Resources Office at 305-792-1708.

NOTE: Vendor employees shall not be cleared by the City to provide services under this
Agreement nor allowed on City property until the entire background check and
fingerprint scanning have been completed, and such proof is provided to the City.
2.10 INVOICES
Invoices shall be provided in accordance with Section 1.13 of the General Terms and Conditions.
The City's payment terms are net 30 (within 30 days of invoice receipt date without discounts).

2.11 COMPLIANCE WITH FEDERAL STANDARDS
All items to be purchased and utilized in the performance of this contract shall be in accordance
with all governmental standards, to include, but not be limited to, those issued by the Occupational
Safety and Health Administration (OSHA), the National Institute of Occupational Safety Hazards
(NIOSH), and the National Fire Protection Association (NFPA).
2.12 PENALTIES
The successful Bidder should take pride in the quality of work provided,therefore The City of Sunny
Isles Beach plans to implement a strike system that will result in a penalty fine when an issue is
brought to the Vendor's attention and the issue continues to occur. The first time an issue occurs
the Vendor will be notified in writing and the issue must be corrected within 48 hours of receipt of
notice. The second offense also will be documented in writing and a meeting will take place
between the Vendor's representative and the City representative to discuss the current and past
infractions. At the time of the meeting the Vendor will be required to present a written corrective
action plan to address the City's concern and how they plan to correct the issue within 48 hours of
the meeting. The third violation for the same issue shall result in a penalty of $200.00 each time
the same problem reoccurs. This information shall remain in the Vendor file and will be taken into
account when it comes time to renew a contract.

SECTION 3
SCOPE OF SERVICES
3.1 SCOPE OF SERVICES
Provide school crossing guard personnel and services on an as-needed basis at spedfied locations.
Services shall include complete supervision services for all Vendor provided school crossing guards
including training and certification in accordance with the terms of this ITB.
3.2 QUALIFICATIONS
The Vendor shall mandate that all employees providing services under this Agreement to report
any criminal charges brought against them immediately. The Vendor, upon receipt of such
information, will immediately notify the City.
For services provided under this Agreement,the Vendor shall employ persons who are neat,dean,
well groomed, courteous, and at least twenty-one(21)years of age. The Vendor must obtain prior
written approval from the designated City representative, at City's sole discretion, for all Vendor
employees who will be providing services under this Agreement.
If requested by the City, Vendor agrees to remove any employee and substitute an acceptable
person at that crossing post. Vendor is responsible for ensuring employees have completed all
required training before being assigned to work as a crossing guard. Vendor shall provide the City
with a list of names, and telephone numbers, and training dates of all guards, back-up guards, and
field supervisors. Changes to the list are to be provided to the City as they occur.
3.3 TRAINING
It shall be the responsibility of the Vendor to ensure that all persons employed as crossing guards
receive and successfully complete proper training as required by law. The Vendor may perform
the training with its own staff if they are certified crossing guard trainers, or sub-contract for
certified training to meet this requirement. Formal training of all crossing guards assigned to
provide services under this Agreement shall be conducted as per the standards and guidelines
established by the State of Florida Department of Transportation. In accordance with Section
316.75 Florida Statutes,such training shall be conducted by certified school crossing guard trainers,
and consist of, at a minimum:
(1) Classroom training; and
(2) Field training
The Vendor shall provide at least one (1) training/re-training session per year, which shall be
attended by all Vendor employees assigned to work under this Agreement. Any additional training,
such as training of new employees throughout the school year, will be the sole responsibility of the
Vendor. Proof of such training shall be provided for each school crossing guard and supervisor.

3.4 SCHEDULE AND LOCATION OF SERVICE
It is anticipated that eleven(11)school crossing guards and on(1)school crossing guard supervisor
will be required for each school day. However, this is an estimate and the designated City
representative will keep the Vendor informed as to the exact number of school crossing guards
that will be required at any one time.
The Vendor shall be required to provide coverage at the seven (7) crossings, located within the
City limits. The City reserves the rights to increase or decrease the number of crossing locations
to be staffed. The Vendor shall be flexible and provide guards for the hours needed on the
instructions of appropriate City personnel.

3.5 DAILY FIELD SUPERVISION
The Vendor shall provide one(1)experienced field supervisor overseeing the operations at all times
while school crossing guards are on duty. All supervisory personnel shall be certified school
crossing guards. It shall be the responsibility of the field supervisor(s) to ensure that all crossings
are properly staffed at all times.
3.6 GUARD BACKUP
The Vendor shall provide each working guard with the name and telephone number of a back-up
guard in case the working guard cannot be at their post. The Vendor shall ensure that the back-
up guard is fully trained and familiar with the specific crossing location, and provides the services
at the required times.
3.7 TIMESHEETS
The Vendor must maintain a daily time sheet with the signature of the employee on each work
shift and the location of their guard post. A copy of this log shall be submitted weekly to the City.

3.8 TWENTY-FOUR (24) HOUR ANSWERING SERVICE
The Vendor shall provide their employees a 24-hour answering service. During non-working hours
when the field supervisor is not on duty a working guard shall have access to this service in the
event that he/she cannot be at the assigned post.
3.9 PHOTO IDENTIFICATION
The Vendor is responsible for supplying all employees with photo identification, showing the
Vendor's company name and the employee's name. While on duty the crossing guards shall wear
their photo identification and it shall be clearly displayed.
3.10 IDENTIFYING EMPLOYEES AND EMPLOYEE VEHICLES
All Vendor employees on City property must wear dearly identifiable shirts with the company name
with or without logo and all vehicles must be dearly identified with the company logo and a unique
vehicle number when parking on City property.
