RESOLUTION NO. 2016-25118 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION 932.7055, F.S., TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE (DOJ) FOR THE PURCHASE OF SIX (6) POLICE VEHICLES, TWO (2) POLICE MOTORCYCLES,AND ALL ASSOCIATED EQUIPMENT, MARKINGS AND LIGHTING, AND A PRORATED PORTION OF COSTS TO REPLACE THE POLICE / CITY HALL TELECOMMUNICATIONS SYSTEM, IN A TOTAL AMOUNT NOT TO EXCEED THREE HUNDRED FORTY-SEVEN THOUSAND THREE HUNDRED FIVE DOLLARS AND FORTY-EIGHT CENTS ($347,305.48); PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases ' intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS,the Chief of Police has submitted a request for the purchase of six(6)vehicles and two(2) Harley Davidson Road King Motorcycles, and all associated equipment, markings and lighting, and a prorated portion of costs to replace the Police / City Hall telecommunications system,in a total amount not to exceed Three Hundred Forty-Seven Thousand Three Hundred Five Dollars and Forty-Eight Cents ($347,305.48) in forfeiture (DOJ) funds in compliance with the aforementioned legal requirements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to expend a total amount not to exceed Three Hundred Forty-Seven Thousand Three Hundred Five Dollars and Forty-Eight Cents($347,305.48) from the established Department of Justice (DOJ) federal forfeitures account for the purchase of six (6) Police vehicles, two (2) Harley Davidson Road King Motorcycles, and all associated equipment, markings, and lighting, and a prorated portion of costs to replace the Police/City Hall telecommunications system. Maas, Police Chief DATE: 5/19/2016 Approval to Expend Partial Forfeiture Funds (DOJ)for the purchase of six(6) Police Vehicles, Two (2) Police RE: Motorcycles and all associated equipment, as well as a prorated portion of costs to replace the Police /City Hall telecommunications system, in an amount not to exceed $347,305.48 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment and other law enforcement activities. It is requested that we be permitted to utilize up to $347,305.48 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department actively participates in an FBI / HIDTA (High Intensity Drug Trafficking Area) Initiative Group that conducts numerous ongoing proactive investigations and has a need for the attached listed equipment. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds 311 for the enhancement of law enforcement. All of the attached items are authorized expenditures and are designated for: enhancement of law enforcement equipment, charitable and crime prevention programs, as well as legal costs associated with the asset forfeiture process.
