SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION 932.7055, F.S., TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE (DOJ) FOR THE PURCHASE OF TWO (2) POLICE K-9 VEHICLES AND ALL ASSOCIATED EQUIPMENT, HARDWARE/SOFTWARE FOR POLICE NETWORK, STORAGE AND TROUBLE SHOOTING SOFTWARE, AND THE PURCHASE OF CRITICAL INCIDENT RESPONSE AND BALLISTIC PROTECTION GEAR, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED TEN THOUSAND FIFTY-SEVEN DOLLARS AND NINETY- EIGHT CENTS ($210,057.98); PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request for the purchase of two (2)Police K-9 Vehicles and all associated equipment, hardware/software for Police network, storage & trouble shooting software, and the purchase of critical incident response and ballistic protection gear, in an amount not to exceed Two Hundred Ten Thousand Fifty-Seven Dollars and Ninety- Eight Cents ($210,057.98) in forfeiture (DOJ) funds in compliance with the aforementioned legal requirements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to expend an amount not to exceed Two Hundred Ten Thousand Fifty-Seven Dollars and Ninety-Eight Cents ($210,057.98) from the established Department of Justice (DOJ) federal forfeitures account for the purchase of two (2) Police K-9 Vehicles and all associated equipment, hardware/software for Police network, storage and trouble shooting software, and the purchase of critical incident response and ballistic protection gear. Staff to remotely access the officer's laptop computers while on duty for repair. $ 5,000.00 This Software is CJIS compliant. ❖ Purchase of a Cisco 10gb network switch to replace the failing voice/ data police network switch $ 7,000.00 ❖ Purchase of Critical Incident Response, Ballistic Protection Gear for all Sunny Isles Beach Police Officers ie: Ballistic Helmets, Tactical Vests, Shields, etc. $ 85,000.00 Total: $ 210,057.98 Certification I, Fred A. Grandinetti, Police Captain DATE: 7/21/2016 Approval to Expend Partial Forfeiture Funds (DOJ)for the purchase of two (2) Police K-9 Vehicles and all RE associated equipment. Hardware/Software for police network, storage & trouble shooting software and the purchase of critical incident response and ballistic protection gear, in an amount not to exceed $210,057.98 RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by law to be spent for the purchases of police equipment and other law enforcement activities. It is requested that we be permitted to utilize up to $210,057.98 of said funds on deposit for such purpose. REASONS: As domestic attacks become more increasing, law enforcement throughout the United States is becoming better trained and equipped. With the purchase of the ballistic hardware and addition of two (2) K9 Teams, we will be better prepared to safely respond to critical incidents. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds 63 for the enhancement of law enforcement. All of the attached items are authorized expenditures and are designated for: enhancement of law enforcement equipment, charitable and crime prevention programs, as well as legal costs associated with the asset forfeiture process.
