HomeMy WebLinkAboutReso 1997-0016 RESOLUTION NO. 97-16 RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA APPOINTING RICHARD E. BROWN TO SERVE AS THE CITY CLERK OF THE CITY OF SUNNY ISLES BEACH ON TERMS AND CONDmONS NEGOTIATED BY THE MAYOR. WHEREAS, the City Commi~on of the CITY OF SUNNY ISLES BEACH has advertised for a City Clerk; and WHEREAS, all responses to that advertisement have been received and considered by the City Commission; and WHEREAS, on August 21, 1997, the Commission by motion appointed a clerk search committee consisting of the clerks of the City of Aventura, the Village ofPinecrest and the City of Coral Gables, WHEREAS, upon review of all such applications and resumes received by the City for the clerk position, each clerk search committee member selected his/her top three candidates resulting in the selection offour of the twenty-eight applications, and, published those combined four choices by letter to the City Commission, WHEREAS, at the meeting of October 16, 1997, said four clerk candidates were interviewed by the entire Commission and the selection was debated by same; and WHEREAS, pursuant to the powers and duties vested in the Mayor and the City Commission by the Charter of the City of Sunny Isles Beach, NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, that: Section 1. Richard E. Brown is appointed to serve as City Clerk of the City of Sunny Isles Beach, Florida on the terms and conditions negotiated by the Mayor descnoed in the letter attached as Exhibit "A" to this resolution to be ratified by the Commission by virtue of the passage of this Resolution. Brown 6100 Pine Tree Drive Miami Beach, FL 33140 Dear Mr. Brown: It is my great pleasure to nominate you for the position of City Clerk. We are proposing and you have accepted the following terms of employment: 1. Salary. Annual salary of $40,000.00, subject to the terms set forth below. 2. Thrill.. ' The term of this agreement shall be for a period of one year beginning December 8, 1997. It is understood and agreed that the term of this agreement is designed to allow the City Commission an opportunity to evaluate your performance. Should the City Commission decide to terminate you at any time during the term, you specifically agree that such a decision is totally within the City Commission's discretion and you shall not be entitled to any severance, provided however, you shall be entitled to receive unused, accrued vacation and sick time. 3. Benefits. During the term of the agreement, you shall be entitled to receive City paid: life insurance, health and dental insurance benefits, sick days, vacation days and other holidays accorded all other employees of the City. You shall not be entitled to receive pension benefits, provided however, if you are retained as City Clerk at the expiration of the term of this agreement, you shall receive a pre-tax pension contribution, made retroactive to the first date of your employment, in the amount often percent (10%) of your annual salary. 4. Evaluation. Your performance as Clerk shall be evaluated by the City Commission at the first Commission meeting following the anniversary of the commencement of your employment. At that time, should the City Commission decide to retain you as the City Clerk, you shall be entitled to have your salary raised to a dollar amount between $50,000.00 and $52,000.00 as decided by the City Commission, you shall continue to receive benefits as described in Paragraph 3 hereinabove and the term of your employment shall be open ended at the pleasure of the Commission. As Clerk, you shall perform all duties normally associated with the Clerk's office, including but not limited to, the formulation of a plan to create the City Clerk's office, maintenance and distribution (as requested) of all public records for the municipality, assistance in preparation of City Commission or board agendae, preparation of resolutions, attendance, recording and transcription of minutes of any public meetings or workshops for all committees, advisory boards, zoning and code enforcement boards and/or City Commission meetings, maintenance of all office equipment and systems management, etc. Assuming my Commission supports my recommendation of you, I welcome you to the new City of Sunny Isles Beach.
