HomeMy WebLinkAboutReso 2010-1547 - RESOLUTION NO. 2010- 15t.l'l A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND UP TO FORTY-ONE THOUSAND DOLLARS ($41,000.00) FROM THE FEDERAL FORFEITURE (DOJ) FUNDS FOR SPONSORSHIP OF A COMMUNITY POLICING EVENT, AND FOR PURCHASE OF LIGHTNING PREDICTION AND WARNING SYSTEMS FOR CITY P ARKS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the request of the Chief of Police to the governing body of a municipality, federally forfeited funds may be expended if accompanied by written certification that the request complies with the provisions of the Comprehensive Crime Control Act of 1984; and WHEREAS, the Chief of Police has submitted a request for the expenditure of Forty-One Thousand Dollars ($41,000.00) in federally forfeited funds in compliance with the aforementioned. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to Forty-One Thousand Dollars ($41,000.00) in federally forfeited funds in compliance with the aforementioned from the established Department of Justice (DOJ) federal forfeitures account for the costs associated with sponsoring a community policing event, and for purchase of Lightning Prediction and Warning Systems for City parks. Maas, Chief of Police DATE: 4/15/20 I 0 RE: Approval to Expend Partial Forfeiture (DOJ) Funds for a Community Policing Event and Public Safety Equipment as Prescribed by DOJ Regulations. in the amount up to $41,000.00 RECOMMENDA TION: It is recommended that the City Commission approve the expenditure of partial Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as the results of investigative participation in forfeiture and seizure cases. These funds are permissible by laws to be spent for approved community policing events and other law enforcement activities. It is requested that we be permitted to utilize up to $41,000.00 of said funds on deposit for such purpose. REASONS: The Sunny Isles Beach Police Department actively participates in and sponsors approved events, activities, and scholarship programs, etc., designed for enhancing community policing events, public safety equipment and law enforcement relationships. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the continued enhancement of relationships between law enforcement and our community. This specific event will be a combined cultural and public safety event sponsored and hosted by the police department for a dual purpose of education and entertainment in public safety. In addition, a portion of these funds will be utilized to purchase and install a lightning prediction warning system for our recreation / community parks. These expenditures are authorized expenditure and are designed towards charitable, public safety and crime prevention programs.
