A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, APPROVING A LETTER OF
UNDERST ANDING BETWEEN THE CITY OF SUNNY ISLES
BEACH AND OCEANVIEW BUILDING A CONDOMINIUM
ASSOCIATION, INC., AND OCEANVIEW BUILDING B
CONDOMINIUM ASSOCIATION, INC. (COLLECTIVELY
"OCEANVIEW") RELATING TO THE CONSTRUCTION OF
HERITAGE PARK, IN SUBSTANTIALLY THE SAME FORM,
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE
CITY MANAGER AND CITY ATTORNEY TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING
FORAN EFFECTIVE DATE.
WHEREAS, on April 11, 2006 via Resolution No. 2006-911, the City Commission
approved the purchase of approximately 3.82 acres of real property located at 19200 Collins
A venue for open space/park purposes, and for the construction of Heritage Park; and
WHEREAS, Oceanview raised certain concerns about traffic impact subsequent to the
commencement of the construction of Heritage Park; and
WHEREAS, the City's traffic consultant prepared a traffic report, which concluded that the
construction of Heritage Park would not significantly impact the level of service on the private road
located adjacent to Heritage Park; and
WHEREAS, the City now wishes to enter into a Letter of Understanding with Oceanview to
alleviate the traffic concerns, in substantially the same form as Exhibit "A", attached hereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Letter of Understanding: The City Commission hereby approves the
terms and conditions of the Letter of Understanding with Oceanview Building A Condominium
Association, Inc., and Oceanview Building B Condominium Association, Inc., attached hereto as
Exhibit "A".
Section 2. Authorization of City Manager and City Attorney. The City Manager and the City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 3.
Effective Date. This Resolution shall become effective upon adoption.

Re: Traffic Impact Proposal.
Dear Messrs. Harrison and Lafaurie:
This letter is written as a follow-up to the meeting held on January 20th, 2010, at which Louis
Lafaurie, Tulia Badillo, Tina Campbell, the undersigned and Vice Mayor Thaler were present
wherein we discussed possible solutions to the traffic concerns raised by Oceanview Building
A Condominium Association, Inc., and Oceanview Building B Condominium Association,
Inc. (collectively "Oceanview") regarding Heritage Park and the parking garage to be located
therein (collectively "Heritage Park"). The traffic concerns were raised not only by
Oceanview through its Boards and residents, but by counsel, Jeffrey Bercow, of Bercow,
Radell & Fernandez, P.A., and its traffic consultant, Molly Hughes of Hughes Hughes, Inc.
(collectively "Professionals").
As you know, the City has a strong desire to address concerns raised by its residents. As City
Manager, I have an obligation to work with residents to improve the quality of life. I
certainly believe that the construction of Heritage Park will improve the quality of life of
residents. I know that you are in agreement with me. However you and other members of
your respective Boards, as well as the residents living within your respective condominiums,
individually and through their Professionals have expressed certain concerns about the traffic
impact of Heritage Park upon the residents of Ocean view A and Oceanview B. To address
these traffic concerns, the City contracted with Kimley-Horn and Associates, Inc., to conduct
an access analysis report ("Report"), which was shared with Oceanview. The Report
concluded that closing the curb cut currently located on Collins A venue and the rerouting of
traffic to utilize the parking garage via Galahad-Dade Boulevard and the private roadway
located within the Ocean Reserve property would not significantly impact the level of service
on Galahad-Dade Boulevard.
Notwithstanding the findings of the Report, the City agrees to take further steps to alleviate
the traffic concerns. These steps include but are not limited to the following:
(I) The City agrees to construct a third inbound lane on Galahad Dade Boulevard on the
western end to allow queuing for the cars (residents) approaching the automatic gate to
bypass the cars (non-resident) stopped at the guardhouse, providing that Oceanview A
and Oceanview B consents to such improvements. This third lane will start as far east
as allowable. Of the two remaining lanes going all the way to Collins, the southern one
will be for access to the park and park garage. The City agrees to pay for the
improvements and to maintain Galahad Dade Boulevard from Collins A venue to the
northwestern most portion of the park easement granted by Ocean Reserve (Building C),
this point being just east of the Oceanview guardhouse.
(2) The City will reconstruct Galahad-Dade Boulevard per attached Exhibit "A". This
reconstruction will introduce two new additional west bound lanes. One will be the
approximate length of the Heritage Park property to allow permitted residents of
Oceanview a segregated and unrestricted access. The second will be approximately two
hundred feet in length, and will be for visitors and guests who will have to stop at the
guard house. A third lane will allow direct access to the park and parking garage. In
addition, as shown, two exit lanes will also run essentially the full length of the park. One
will be for traffic turning northbound onto Collins, one will be for traffic turning
southbound onto Collins.
(3) The City shall require the A ventura Beach Club Condominium Association, Inc. or its
successors, to pay for sufficient police traffic patrol if attendance at an event held at the
A ventura Beach Club Condominium (more commonly referred to as the Ramada and/or
Marco Polo, for which the garage located within Heritage Park is primarily being
constructed) meets the special events guidelines established by the City from time to
time. The City will follow its customary guidelines for permitting such events and they
are shown in attached as Exhibit "B".
(4) The City's policy is to provide police traffic patrol at all appropriate City events at all
City parks and this policy will be applied to Heritage Park as well.
(5) The City has instructed the architects who designed Heritage Park to include a
structural opening on the northern face of the parking garage at the east end. A copy of
the plans showing this redesign of the parking garage is attached hereto and made a part
hereof. This opening will be covered with the decorative perforated aluminum that will
be used on the northern and eastern faces of the building. The purpose of this structural
opening is to permit ingress or egress to the parking garage from Collins other than
Galahad Boulevard in the event future traffic congestion makes the current anticipated
ingress and egress to the parking garage via Galahad-Dade Boulevard and the roadway
located with the Ocean Reserve Condominium property undesirable, dangerous, etc. and
less safe than the proposed opening as determined by the City's traffic consultant.
(6) The City will install a gate in the fence at the existing curb cut on Collins Avenue to
be used for servicing and maintaining Heritage Park as needed. The purpose of
maintaining the curb cut on Collins A venue and installing a gate in the fence at that
location is to enable the construction of a servicing and maintenance roadway therefrom
to the structural opening described in paragraph (5) directly above. This roadway shall be
used strictly for servicing and maintenance of the park unless changed by the City
Commission.
(7) The City will not in any way interfere with any exclusive easement rights belonging
to Oceanview A and B.
(8) The City agrees to examine the traffic patterns implemented as part of the initial
Heritage Park development, layout, and traffic ingress and egress pattern described above
if and when any of the following occur:
a. If the Level Of Service (LOS) at the intersection of Galahad-Dade
Boulevard Collins Avenue drops to a D or below as defined in the Manual
of Uniform Traffic Control Devices (MUTCD).
b. The City is able to obtain permission from FDOT to place a traffic signal at
the southern end of Heritage Park on Collins Avenue.
c. If the events listed in "a" or "b" above occur, the City will take remedial
appropriate actions to address the traffic issues.
If the terms of this letter are acceptable to you and your colleagues, please execute below.

The Sunny Isles Beach Police Department offers to its business and residents the service of
having a police officer(s) at their private events when available. The officers sign up for
these events on a voluntary basis and there is no guarantee that an officer will be available
when requested.
The charge to have an officer(s) at your event is outlined in the attached fee schedule. Marked
police vehicles are also available for private events. The cost is $5.00 per day.
Please fill out the below and return or fax it to the police department at least seven (7) days
prior to the event. Call the Sunny Isles Beach Police Department 48 hours prior to the event
to confirm that an officer has signed up. The Sunny Isles Beach Police Department reserves
the right to cancel an extra duty detail without prior notice due to unforeseen emergencies
beyond our control.

The fee covers the payment to the officers in addition to mandatory cost of
workmen's compensation, contributions to the Florida Retirement System,
Medicare, social security and other administrative fees.
Police Supervisor
$52.00 per hour
3 or more officers require a supervisor or designated supervisor.
The fee covers the payment to the officers in addition to mandatory cost of

Any Extra Duty details that fall on a city observed holiday will be
billed at the rate of $72.00 per hour.

8 hours prior to the start time of the detail.
There is a 3 hour minimum on all details.
Payment Terms:
For single day details, payments must be paid in advance for the entire detail
term. Payments must be in form of: Personal I Certified I Cashiers Check or
Money Order. All payments should be received at least 5 days in advance unless
other arrangements are agreed upon.

All jobs will be assigned an invoice number by the extra-duty coordinator and the
invoice number should be noted on the check upon making payment to assure

With regard to the hiring of extra-duty police officers, the Sunny Isles Beach Police Department
requires that all necessary permit requirements have been met prior to the authorization of extra-
duty police services. As there are many types of events / details where officers are requested, the
police department retains the right to determine what type of events will be authorized and the
number of officers necessary to safely handle the detail. This determination will always be based on
the safety of the officers, as well as the general public. Considerations as to the number of officers
required to work a specific detail include but are not limited to, the number of guests I patrons
invited to the event and the estimated impact on the flow of traffic in and around the site location.
A standard formula for scheduling a resort function where the event is expected to adversely
influence the normal flow of traffic would be a minimum of two officers. This allows for
predetermined points to be controlled, allowing for ease with ingress and egress to the event, while
providing the safe coordinated control of traffic along our roadways. Any event that requires three
or more officers will automatically require a supervisor to oversee the detail. The supervisor will
then determine if any specialized traffic enforcement equipment is required.
In the event that officers from this agency are not available to work an approved event, the extra-
duty coordinator will forward the request to law enforcement agencies who share a common
jurisdiction, i.e. Florida Highway Patrol, Miami Dade County Police Department or agencies with
which we share Mutual Aid.

RECOMMENDA TION:
The staff recommends approval of the Letter of Understanding.
REASONS:
The residents of Oceanview A&B expressed concerns to the City regarding possible
traffic issues that might be generated by the entrance to the Heritage Park Parking Garage
being on Galahad-Dade Road as opposed to Collins Avenue. In working with the
representatives from the two buildings, we were able to generate this Letter of
Understanding and would ask that you consider it for approval.
