ORDINANCE NO. 2010- ~
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING ITS COMPREHENSIVE
PLAN TO UPDATE THE CAPITAL IMPROVEMENTS ELEMENT FIVE
YEAR CAPITAL IMPROVEMENTS SCHEDULE PURSUANT TO
SECTION 163.3177(3)(b)1., FLORIDA STATUTES (F.S.) AND RULE
CHAPTER 9J-S.016(S), FLORIDA ADMINISTRATIVE CODE (F.A.C.);
PROVIDING THAT THE TEXT, AS AMENDED OR REVISED, SHALL
BE SUBSTITUTED FOR AND REPLACE IN FULL THE EXISTING
TEXT IN THE ADOPTED CAPIT AL IMPROVEMENTS ELEMENT;
PROVIDING FOR TRANSMITTAL OF THE ADOPTED AMENDMENT
TO THE STATE LAND PLANNING AGENCY; PROVIDING A
CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

WHEREAS, the Legislature of the State of Florida has mandated that all local
governments must annually update their Comprehensive Plan Capital Improvements Element,
including the Five Year Schedule of Capital Improvements; and
WHEREAS, all amendments to the comprehensive plan must be adopted in accordance
with detailed procedures which must be strictly followed; and
WHEREAS, the City of Sunny Isles Beach, Florida, has carefully prepared an
amendment to its comprehensive plan to update its Capital Improvements Element and Schedule
pursuant to Section 163.3177, Florida Statutes, and;
WHEREAS, the City of Sunny Isles Beach has held the duly required public hearing in
accordance with Section 163 .3177(3)(b )2., Florida Statutes, and;
WHEREAS, the City Commission desires to adopt the amendment to the current
comprehensive plan to guide and control the future development of the City, and to preserve,
promote and protect the public health, safety and welfare.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1: Incorporation of Recitals. The foregoing facts and recitations
contained in the preamble to this Ordinance are hereby adopted and incorporated by reference as
if fully set forth herein.
Section 2: Approving Text Amendments. The 2009 Update to the City of
Sunny Isles Beach Comprehensive Plan Capital Improvements Element Five Year Capital
Improvements Schedule, attached as Exhibit "A" and made a part hereof and of the current
Comprehensive Development Plan. The text adopted in Exhibit "A" shall be substituted for
and replace in total the previously adopted text in the Capital Improvement Element.
Section 3: COpy of Comprehensive Plan. A copy of the Comprehensive Plan, as
amended, shall be kept on file in the office of the City Clerk, City of Sunny Isles Beach, Florida.
Section 4: Directives of the City Clerk or City Manager. The City Clerk or City
Mapager is hereby directed to transmit three (3) copies of the amendment to the current
Comprehensive Plan to the State Land Planning Agency, along with a copy to the South Florida
Regional Planning Council and to another review agencies and adjacent local governments, within
ten (10) working days after adoption, in accordance with Section 163.3184(7), Florida Statutes.
Section 5: Repealer.

Section 6: Severability. Should any section or provision of this Ordinance or any
portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to
be invalid, such decision shall not affect the validity of the remainder of this Ordinance._

Section 7. Inclusion in the Code. It is the intention of the Commission, and it is
hereby ordained, that the provisions of this Ordinance shall become and be made a part of the
code of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be
changed to "section" or other appropriate word, as required
Section 8: Effective Date and Applicability. The effective date of this plan
amendment shall be the date a final order is issued by the Department of Community Affairs or

Administration Council finding the amendment in compliance in accordance with Section
163.3184(1)(b), Florida Statutes, whichever occurs earlier. No development orders, development
permits, or land uses dependent on this amendment may be issued or commence before it has
become effective. If a final order of noncompliance is issued by the Administration Council, this
amendment may nevertheless be made effective by adoption of a resolution affirming its effective
status, a copy of which resolution shall be sent to the Department of Community Affairs, Division
of Community Planning, Plan Processing Team.

COMPREHENSIVE PLAN CAPITAL IMPROVEMENTS ELEMENT AND
FIVE YEAR CAPITAL IMPROVEMENT SCHEDULE

Amend Policy 1G. as follows:
The City of Sunny Isles Beach 2008 - 2012 Capital Improvements Plan, and the Capital
Improvements Schedule included therein, contains a schedule of projects that the City
shall implement in order to maintain its adopted Level of Service standards or otherwise
achieve the goals, objectives and policies and/or ensure the financial feasibility of the
Comprehensive Plan. The 2008~ - 201~~ Capital Improvements Plan is hereby
adopted as part of the Capital Improvements Element.

Executive Summary
Proposed Update to the Capital Improvements Schedule
Section 163.3187, Florida Statutes (F.S.), mandates that all local governments annually
amend their adopted Comprehensive Plan to update the Five Year Capital Improvement
Schedule in the Capital Improvements Element. Policy 1 G in the City's Capital
Improvements Element is as follows: "The City of Sunny Isles Beach 2008 - 2012 Capital
Improvements Plan, and the Capital Improvements Schedule included therein, contains a
schedule of projects that the City shall implement in order to maintain its adopted Level of
Service standards or otherwise achieve the goals, objectives and policies and/or ensure the
financial feasibility of the Comprehensive Plan. The 2008 - 2013 Capital Improvements
Plan is hereby adopted as part of the Capital Improvements Element." In order to address
the aforementioned requirements, the dates in that Policy should be updated to 2009 -
2013, to reflect the City's adopted 2009 - 2013 Capital Improvements Plan, dated October
1, 2009.
Upon adoption, the proposed amendment will be transmitted to the Florida Department of
Community Affairs, other review agencies, and adjacent local governments in accordance
with State requirements. The effective date of this plan amendment shall be the date a final
order is issued by the Department of Community Affairs or Administration Council finding the
amendment in compliance in accordance with Section 163.3184(1)(b), Florida Statutes.
Recommendation
To adopt the proposed ordinance amending the Comprehensive Plan, and transmit the
amendment to the Department of Community Affairs and other review agencies.

Proposed Update to the Capital Improvements Schedule to the
Comprehensive Master Plan of the City of Sunny Isles Beach
RECOMMENDA TION:
To adopt the proposed ordinance amending the Comprehensive Plan, and transmit the
amendment to the Department of Community Affairs and other review agencies.
REASONS:
Section 163.3187, Florida Statutes (F.S.), mandates that all local governments annually
amend their adopted Comprehensive Plan to update the Five-Year Capital Improvement
Schedule in the Capital Improvements Element. This is a routine update of the
Comprehensive Master Plan. The attached memo from the planning consultants that
have done all the updates to the Comprehensive Plan explain the purpose for this
adoption.
